RESOLUTION NO.

RESOLUTION APPROVING PLAT FOR RECORD
WHEREAS, Sexton Cove Estates, Inc., a Florida corporation, has
requested that the Board of County Commissioners of Monroe County,
Florida approve for record a plat known as "SEXTON COVE ESTATES, a
Resubdivision of a Portion of Model Land Company's Subdivision of Section
1, Township 61 South, Range 38 East (Plat Book 1, page 68), Key Largo,
Monroe County, Florida", and
WHEREAS, in lieu of the bond required by the provisions of Chapter
59-1577 and Chapter 59-1578, Laws of Florida, Acts of the Legislature Year
1959, the platter of said subdivision will enter into an Agreement with the
County of Monroe, State of Florida, to convey to said County Lots 1 thru
25, Block 1, of said subdivision, as security for the construction and paving
of streets in said subdivision, and
WHEREAS, the County Tax Assessor and County Zoning Director
have recommended that said Board approve said plat for record, provided
said Board waives the provisions contained in the above referred to laws,
now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, that the provisions of Chapter 59-1577
and Chapter 59-1578, Laws of Florida, Acts of the Legislature Year 1959,
be, and the same are hereby waived, in that property is being accepted and
pledged in lieu of a bond, so far as the plat known as "SEXTON COVE ES-
T A TES, a Resubdivision of a Portion of Model Land Company's Subdivision
of Section 1, Township 61 South, Range 38 East (Plat Book 1, page 68),
Key Largo, Monroe County, Florida" is concerned, and that said plat be,
and the same is hereby approved for record, and the Chairman and Clerk
of said Board are hereby authorized to sign the certificate of approval on
said plat, upon delivery to said Board of the executed Agreement above re-
ferred to, and delivery of executed Deed conveying the above referred to
property to said County.

In reference to your letter dated January 5, 1970, we have reviewed the
proposed plats of Sexton Cove Estates and Sunset Acres.
The streets and avenues dedicated for right-of-way as shown on the
attached plats are adequate easements as far as the Telephone Company is con-
cerned.
Please furnish us with final plats when they become available.

Dear Mr. Cormack:
Enclosed are 7 prints of the tentative plat entitled "Sexton Cove Estates"
for your review. Please distribute these prints to the other agencies
that are required to review plats.
The platted property is zoned RU-4 (mobile homes) with the exception of the
front 1037.85 feet along U. S. No 1 which is zoned BU-2. The developer
directed us to design the lots in the RU-4 section so as to comply with the
zoning regulations rather than the plat regulations. Thus, these lots have
a minmum area of 3600 sq. ft. and are 40 ft. in width. The required mini-
mum for the plat filing regulations are 6000 sq. ft. and 60 ft. width.
Other than these two items the plat fully complies with the plat filing
regulations.
The state law requLrLng mobile home subdivisions in Monroe County to have
lots with a minimum area of 6000 sq. ft. was abolished at the 1969 Spring
Session of the Legislature. Prior to the enactment of this law the County
Commission would waive the plat regulations for mobile home subdivisions
favoring requirements of the zoning regulations. For residential subdivi-
sions the two regulations are in agreement with each other.
The estimated cost of paving the streets is $92,000. Under separate cover,
Sextion Cove Estates, Inc., will furnish you with the appraisal, deed and
agreement for deeding the County some property to cover this amount.
We trust that the plat will be presented to the Board of County Commissioners
for consideration at your earliest convenience.
