Resolution 091-1973 RESOLUTION NO. 91 -1973 WHEREAS, the Zoning Board of Monroe County, Florida, at a public hearing on March 23, 1973, duly called and held in accordance with the zoning regulations of Monroe County, Florida, and the law s of the State of Florida, considered the request of America Outdoors Key Largo, Inc" a Florida cor- poration, for a change of zoning on part of Lot 9 of George Mac Donald's Subdivision of U. S. Gov. Lots 5 & 6 and NW 1/4 of NW 1/4 of Section 6, Township 62 South, Range 39 East (Key Largo) containing 5.05 acres, as re- corded in Plat Book I, Page 59 of the Public Records of Monroe County, Florida, from Classification GU to RU-5 with a variance to permit campsites In an R U-5 zone as defined in the Monroe County zoning regulations, and WHEREAS, after taking testimony and hearing all persons desiring to be heard, said Board denied the request for the change of zoning and allowed the applicant to amend his application and granted a change of zoning from Classification GU to RU-3 as defined in the Monroe County zoning regulations, and WHEREAS, the Upper Keys Citizens Association through its President, Don Schlosser, filed an appeal with the Board of County Commissioners of Monroe County, Florida, asking the Board to reverse the decision of the Zoning Board, in accordance with the law s applicable thereto, and WHEREAS, on the 19th day of June, 1973, the Board of County Com- missioners held such appeal and Don Schlosser, President of the Upper Keys Citizens Association appeared on its behalf and Mr. Jeff Gautier appeared on behalf of America Outdoors Key Largo, Inc., and after taking testimony from Mr. Kermit Lewin, Monroe County Planning and Zoning Director, concerning testimony and documents presented at the hearing held on March 23, 1973, and hearing information from Mr. Tom Roberts, Chairman of the Monroe County Zoning Board, and Zoning Board Member, Mr. Ted Carter, and after the intro- duction into the record of letters from the Florida Keys Coop and the Florida -2- Keys Aqueduct Authority concerning the availability of electricity and water, and hearing the arguments of attorney Jeff Gautier and remarks of Mr. Don Schlosser, President of the Upper Keys Citizens Association, voted to uphold the decision of the Zoning Board in approving the amended request for change of zoning from Classification GU to RU-3, and WHEREAS, it is necessary to pass a Resolution confirming the above action of said Board of County Commissioners, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the decision of the Zoning Board made at the public hearing held on March 23, 1973, approving the request of America Outdoors Key Largo, Inc. I s amended application in changing the zoning from Classification GU to RU-3 on part of Lot 9 of George MacDonald's Subdivision of U. S. Gov. Lots 5 & 6 and NW 1/4 of NW 1/4 of Section 6, Township 62 South, Range 39 East (Key Largo) containing 5.05 acres, as recorded in Plat Book 1, Page 59 of the Public Records of Monroe County, Florida, be and the same is hereby upheld.
