RESOULTION NO. 123-1973
.RESOLUTION OF THE COUNTY COMMISSION, OF MONROE-COUNTY
FLORIDA, DETERMINING THAT REPAIR OF REPLACEMENT PARTS
FOR AUTOMATIC.VOTING MACHINES ARE AVAILABLE FROM BUT
A SINGLE SOURCE; PROVIDING FOR PURCHASE ORDER FOR NE-
CESSARY REPAIR OR REPLACEMENT PARTS TO BE SUBMITTED TO
THE DEPARTMENT _OF GENERAL SERVICES, STATE OF FLORIDA,-
FOR APPROVAL; OF
AN EFFECTIVE DATE.
WHEREAS, the Supervisor of Elections, Monroe County,
Florida, has indicated various repair or replacement parts are
necessary to service the A.V.M.-owned by the county and,
WHEREAS, it has been determined that the aggregated cost
of such repair or replacement parts will exceed the sum of One Hundred
Dollars ($100.00), and
WHEREAS, the Statutes of the State of Florida require com-
petitive bidding for voting machines and/or equipment -for amounts in
excess of One Hundred Dollar-s ($100.00), and
WHEREAS, the County Commission of Monroe County, Florida,
does hereby determine that the needed.repair or replacement parts
.cannot -be obtained but from a single source, i.e., the manufacturer
of A.V.M., and
WHEREAS, F-.S..101..293 (b) provides that if a governing body
determines ther.e-is but a single source of suitable equipment that
the competitive bid process may waived.
NOW, THEREFORE, BE IT RESOLVED BY -THE COUNTY COMMISSION
OF MONROE COUNTY, FLORIDA, IN OPEN MEETING DULY ASSEMBLED IN THE
COUNTY COURT HOUSE IN THE CITY OF KEY WEST, FLORIDA THIS 2nd DAY
OF Oct. ,A.D. 1973, AS FOLLOWS.:.
SECTION I: That the County Commission of Monroe County,
Florida does hereby find that repair and/or replacement parts for
A.V.M..can be obtained but from one'_source, i.e., the manufacturer.
SECTION II: That the Supervisor of Elections is hereby di-
rected.to prepare..a purchase order for those necessary repair or re-
placement parts.
SECTION III: That the Chairman of the County Commission is
hereby authorized to submit a copy of this Resolution, together
with the proposed purchase order, to the Department of General Ser-
vices, Purchasing Division, State of Florida, for the purpose of
having the purchase order approved without -bid.
SECTION IV: That this Resolution shall take effect immediately
upon its adoption.
