At the BaCC meeting of actober 20, 2004 the Board approved a Sewer Utility
Easement between Monroe County and the City of Key West for a 10 foot easement in
favor of the City through a section of the Key West International Airport property, and
recording of same,
Please be sure that your office relays to the City of Key West that this document
requires recording in the Official Records of Monroe County. The cost is $78.00 and the
enclosed DR-219 form needs to be completed. Should you have any questions concerning
the above, please do not hesitate to contact this office.

SEWER UTILITY EASEMENT
TIDS SEWER UTILITY EASEMENT is made this 20th day of October. 2004,
by and between the - BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA, Grantor, whose address is 500 Whitehead Street, Key West, Florida 33040, to BOARD
OF CITY COMMISSIONERS OF KEY WEST, MONROE COUNTY, FLORIDA, Grantee.
WITNESSETH:
WHEREAS, the Grantor is the owner of property known as the "Key West Airport
Property", and situated at KW PT Salt Pond Lts & Land Marked P On the S Side of Flagler Ave or
County Road Meacham Air Port Pt Parcel 1 065-396 ORSO, Parcel Number 64810, physical
address of 3471 South Roosevelt Blvd, Key West, Florida 33040 as depicted on Exhibit "A"
attached hereto and made a part hereof (hereinafter County Property"); and
WHEREAS, the Grantee owns property located adjacent to US Highway #AIA (South
Roosevelt Blvd.) known as the Bridle Path, property crosshatched on Exhibit "B" attached hereto
and made a part hereof (hereinafter ''City Property"); and
WHEREAS, the County Property is contiguous to the City Property; and
WHEREAS, the Grantee needs to utilize the existing Lift Station and sewer line located
on the County Property, extending the existing sewer line to the City Property, as shown in Exhibit
"C-l" for use, repair and maintenance, for future development and other public purposes; and
WHEREAS, it is necessary for Grantee to maintain an easement over a segment of the
County Property for purposes of providing sewer lines, use, service, repair and maintenance; and
WHEREAS, it is in the best interest of the public to grant to Grantee a utility easement;
NOW THEREFORE, in consideration of the mutual covenants and obligations contained
herein, and for other good and valuable consideration, the receipt and sufficiency of which are
hereby acknowledged, the parties agree that the Grantor does grant to Grantee, its successors and
assigns, a perpetual and non-exclusive easement on, over and above the above-described County
Property for the purpose of ingress, egress, and utility installation and maintenance within said
described property, providing that Grantee has the right to construct, alter, maintain and connect to
a sewer line and all necessary laterals to a lift station that is presently existing on the County
Property, conditioned upon the Grantee restoring any of the Grantor's property disturbed in the
construction,. alteration, repair, maintenance and connection of said sewer lines and laterals to its
original state and Grantee holding Grantor harmless for the acts and omissions of its officers,
employees, agents and contractors, and upon the representation that Grantee is a state governmental
agency as defined by Florida Statutes and shall maintain suitable Public Liability insurance or be
self-insured, in amounts adequate to respond to any and all claims within the limitations of Florida
Statute 768.28 arising out of the activities authorized in this easement., as reflected by the Grantee's
acceptance of the conditions below. This Easement across the County Property to the City Property
is more particularly set forth on the diagram and crosshatched area on Exhibit "C-l" and described
in exhibit "C-2".
IN WITNESS WHEREOF, the G~r has caused these presents to be executed in its
name by its Board of County Commissioners of Monroe County, Florida., acting by its Mayor or
