RESOLUTION APPROVING PLAT FOR RECORD

WHEREAS, Tavernaero, Inc., a Florida corporation, has
requested that the Board of County Commissioners of Monroe County,
Florida, approve for record a plat known as "TAVERNAERO, INC. ,
a Resubdivision of Property Belonging to Tavernier Enterprises, Inc. ,
Located in SW 1/4, Section 33, Twp. 62 S, Rge. 38 E, Plantation Key,
Monroe County, Florida" and
WHEREAS, the County Tax Assessor, County Zoning Director
and County Engineers have recommended that said Board approve said
plat for record, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, that the plat known as "TAVERNAERO,
INC., a Resubdivision of Property Belonging to Tavernier Enterprises,
Inc., Located in SW 1 /4, Section 33, Twp. 62 S, Rge. 38 E, Plantation
Key, Monroe County, Florida" be, and the same is hereby approved for
record, and the Chairman and Clerk of said Board are hereby authorized
to sign the certificate of approval on said plat.

This is to certify that I have examined Abstract of Title
covering:
Commencing at a point 828 feet North of the Southwest
corner of Section 33, Township 62 South, Range 38 East,
from said point run North.350 fee; thence run East 130
30' North (magnetic) 2230 feet to the bank of Tavernier
Creek; thence Southerly along the bank of said creek
500 feet more or less to a point East 100 North (magnetic)
from starting point; thence west 100 South (magnetic)
2160 feet to starting point. Being part of Lot 3,
Section 33, Township 62 South, Range 38 East.
I find that as of January 7, 1972, fee title thereto vested
in TAVERNAERO, INC. subject to the exceptions contained in
Schedules A and B hereinafter set forth.
The abstract examined by me and upon which this Opinion of
Title is based is described in detail on the last page hereof.
This Opinion of Title is intended for the addressee only and
the undersigned Examining Counsel assumes no responsibility for
same to any third party.
SCHEDULE A - General Exceptions:
1. Zoning and use regulations promulgated by the State of
Florida or any of its political subdivisions.
2. Rights of third parties in possession, if any.
3. Unrecorded claims for labor and unpaid labor and mater-
ials furnished upon the property within 12 months immediately

Proposed Plat
Dear Sir:
We have reviewed the proposed plat entitled, "Tavernaero, Inc.," and
make the following comments:
1. The new plat filing law, Chapter 71-339, Section 177.091,
requires that the fact that this is a re -subdivision, be
stated in the sub -title following the second subdivision
name, and that the proper Chapter and Section be sited in
the Surveyor's certificate.
2. The description of the subdivision includes one-half of
the right-of-way width of Sunshine Boulevard which is a
State Road right-of-way and should not be included in
this plat.
3. The description contains an incorrect call, in that it
reads "running thence S 83' 30' 25" W along the Southerly
boundary of said Plantation Tropical Park Section 2";
this call should be along the "Northerly boundary of said
Plantation Tropical Park Subdivision Section 2".
In addition to the items listed above, it should be noted that there
are no public streets dedicated within this plat. Bot.fx North Airport
Road and South Airport Road are designated thereon as private streets.

Dear Mr. Lewin:
We have examined the proposed plot titled '"favernaero Inc.% r
We note there has been provided a 10' utility easement following the northerly
and the southerly line of the developments Presumably the erection of an electric
distribution line in these easements will be acceptable to Federal Aviation Admin-
istration, we have not inquired as to clearances for the air strip.
The Cooperative constructed and presently maintains a primary line to serve the
Edonaire Subdivision to the north of the proposed subdivision, such line having
been constructed in a 20' dedicated street, Plat Book 2, page"51, which crossed
what is now proposed as southerly Lot 26, the air strip, and northerly Lot 26. In
constructing this line, the Cooperative brought overhead line too riser pole about
40' southerly of the northern lot line of southerly Lot 26 thence by underground
cable under the remainder of southerly Lot 26, under the air strip and under northerly
Lot 26 to a riser pole at the northerly line of northerly Lot 26.
This primary line serves all of Edenaire Subdivision. When constructed, the lino
was situated in the right-of-way of the dedicated street. It would appear from the
proposed platting that such dedicated street has boon abandoned although this
Cooperative has no record of having received a notice of abandonment or a notice
of any proceeding to abandon. If such notice had been received, the Cooperative
Would have opposed the abandonment of the street unless an appropriate easement
was provided for the maintenance +end repair of the underground circuits from the
southerly to the northerly riser poles as well as an easement for the overhead portion
of the line from the southerly,,..riser pole southerly to the nearest Cooperative pole in
Plantation Tropical Park.

provides on easement from the southerly lot line of southerly Lot 26 to the
northerly lot fine of northerly Lot 26 to permit the Cooperative to maintain and

This is in reply to your letter of October Sth concerning the proposed
plat titled "Tavernaero Inc.
The acce-:>tance of the plat as proposed will not affect the present
installation of water piping in the general area and therefore, the
F K A is not in the position to object to the platting per 'se. However,
it Lhould be noted that the. proposed plat shows private roads leadi11"
?w '> into both the north and south lots. The F'i� AA does not maintain wG�er
pi ,�;s on private roads so that ary n water service to these lots would
have to G maintained by the owne,- or owners of the whole subdiv=.aion.
It further noted that a strip of land. to •che north and south, 10'
wiuth labied "Utility Easements" is not of sufficient size for water
Piping and other utilities. It is recon—mended that the owners of this
property contact the F'KAA to determine the most feasible way to supply
water to tine various lots. It is further recommended that this be done
