RESOLUTION APPROVING PLAT FOR RECORD
WHEREAS, Vincent M. Drost and Wilver I, Drost, husband and
wife, have requested that the Board of County Commissioners of Monroe
County, Florida, approve for record a plat known as I'CUDJOE GARDENS
SIXTH ADDITION, a Subdivision of part of Government Lots 1 & 2 - Section
31 and part of Government Lot 2 - Section 32, in Township 66 S, Range 28
East, on Cudjoe Key, Monroe County, Florida!', and
WHEREAS, in lieu of the bond required by the provisions of Chapter
59-1577 and Chapter 59-1578, Laws of Florida, Acts of the Legislature
Year 1959, the platters of said subdivision will enter into an Agreement
with the County of Monroe, State of Florida, to convey to the county that
part of Lot 7 of Section 30 in Township 66 South of Range 28 East of the
Tallahassee Meridian, Florida, lying and being North of the right-of-way
of U S Highway No. 1 (SR# 5), in Township 66 South, Range 28 East of the
Tallahassee, Meridian, Florida, containing 45 acres, according to the
Official Plat of the Survey of the said land, returned to the General Land
Office by the Surveyor-General: Except the following described portion
of said Lot 7, Section 30, Township 66 South, Range 28 East and the
North boundary of the right-of-way of the Over Sea Highway as a point of
beginning; thence North for a distance of 416 feet, more or less; thence
East for a distance of 624 feet, more or less, thence South for a distance
of 416 feet, more or less, to the intersection of the North boundary of the
right - of-way of the Over Sea Highway; thence along the North boundary of
the right- of-way of the Over Sea Highway for a distance of 624 feet, more
or less, to the point of beginning, to be recorded in the Public Records
of Monroe County, Florida, in Plat Book

ity for the construction and paving of streets in said subdivision, and

WHEREAS, The County Tax Assessor and County Zoning Director
have recommended that said Board approve said plat for record, provided
said Board waives the provisions contained in the above referred to laws,
now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, that the provisions of Chapter 59-1577
and Chapter 59-1578, Laws of Florida, Acts of the Legislature Year 1959,
and the plat filing regulations of Monroe County, Florida, be, and the
same are hereby waived, in that the property is being accepted and pledged
in lieu of a bond, so far as the plat known as "CUDJOE GARDENS SIXTH
ADDITION, a subdivision of part of Government Lots 1 & 2 - Section 31,
and part of Government Lot 2 - Section 32, in Township 66 S - Range 28
East on Cudjoe Key, Monroe County, Florida," is concerned, and that
said plat be, and the same is hereby approved for record, and the Chairman
and the Clerk of said Board are hereby authorized to sign the certificate
of approval on said plat, upon delivery of executed Deed conveying the
above referred to property to said County.

Dear Mr. Cormack:
We have reviewed the above captioned plat for conformance to the Monroe
County Plat Filing Regulations and the plat, as far as the surveyor's
work is concerned, has been prepared in compliance with the Monroe County
Plat Filing Regulations, except that the drainage easements designated
as 2 1/2 feet wide on each lot should be at least 6 feet wide on each lot.
~therefore recommend that the plat be revised to increase the width of
the drainage easements.
We have estimated the cost of paving the three avenues on the plat
at $35,000.

THE DEVELOPER HAS FILED APPLICATION FOR A CHANGE OF ZONING TO RU-1
(SINGLE FAMILY RESIDENTIAL DISTRICT) AND SHOULD THIS BE GRANTED THEN
THE LOT SIZES ON THE PROPOSED PLAT WOULD BE AMPLE. THE PUBLIC HEAR-
ING AT WHICH THE REQUESTED CHANGE OF ZONING WILL BE HEARD, IS TO
BE HELD FEBRUARY 26, 1971.
