RESOLUTION NO. 273-1992
A RESOLUTION BY THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS REQUESTING THAT THE
FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS
UTILIZE THE AREA OF CRITICAL STATE CONCERN
TRUST FUND FOR COMPREHENSIVE PLAN
IMPLEMENTATION AND LAND AUTHORITY FUNDING,
AS WELL AS SOLICITING THEIR SUPPORT FOR
MONROE COUNTY'S RESOLUTION THAT THE
LEGISLATURE OF THE STATE OF FLORIDA ENACT
LAWS AND APPROPRIATE FUNDS TO RELIEVE THE
CITIZENS OF MONROE COUNTY OF THE BURDEN OF
BEARING THE ENTIRE COST OF MEETING STATE
MANDATED GROWTH MANAGEMENT PROGRAMS.
WHEREAS, THE Legislature has enacted laws (F.S. Sec. 380.0052
et. seq.) designating Monroe County an Area of Critical State
Concern; and
WHEREAS, Florida Administrative Code Sec. 28-29 et. seq. pro-
vides the principles for guiding development in the Florida Keys
Area of Critical State Concern; and
WHEREAS, the Legislature through the "Local Government Compre-
hensive Planning and Land Development Regulations Act" (F.S.
Chapter 163) has required that Monroe County adopt a Comprehen-
sive Plan and Land Development Regulations which must also be
consistent with all of the above; and
WHEREAS, Monroe County, by complying with the above mandates,
will be forced to adopt mechanisms which, of necessity, will have
huge fiscal impacts on a small tax base; and
WHEREAS, the Area of Critical State Concern designation is
intended to benefit all of the citizens of the state of Florida;
and
WHEREAS, the Department of Community Affairs, under Florida
Administrative Code 9J-5, has oversight over Monroe County;
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMIS-
SIONERS OF MONROE COUNTY, FLORIDA THAT:
Section 1. We hereby request that the Florida Department
of Community Affairs support the Monroe County Resolution request-
ingthat the Legislature of the State of Florida enact laws and
appropriate funds consistent with relieving the citizens of Mon-
roe County of the burden of bearing the entire cost of meeting
the state-wide benefits of the State Growth Management laws.
Section 2. We additionally hereby request that the Flori--
da Department of Community Affairs draw from and utilize its dis-
cretionary Area of Critical State Concern Trust Fund mechanism to
aid Monroe County in its implementation of Monroe County's re-
vised Comprehensive Plan and Regulations, to include, but not be
limited to, implementation of studies and funding to the Monroe
County Land Authority for acquisition of lands as a direct conse-
quence of Monroe County's revised Comprehensive Land Use Plan and
Regulations.
Section 3.
The Monroe County Director of Growth Manage-
ment is hereby directed to forward a copy of this Resolution to
the Secretary of the Department of Community Affairs Linda
Shelley, as well as to Representative Ron Saunders for dissemina-
tion to the Legislature.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a special meeting of said Board held
on the 28th day of May, A.D., 1992.
