HomeMy WebLinkAboutResolution 032-1974 RESOLUTION NO. 32 -1974 RESOLUTION CANCELLING TAXES ON CERTAIN LAND ACQUIRED FOR PUBLIC PURPOSES WHEREAS, the County of Monroe, State of Florida, a political subdivision of the State of Florida, has recently purchased certain lands in Monroe County, Florida, for public purposes; and WHEREAS, the Board of County Commissioners of each county of the state is given full power and authority to cancel and discharge any and all taxes de- linquent or current upon lands conveyed to, or acquired by any agency, govern- mental subdivision or municipality of the State, or of the United States, for road purposes, defense purposes, recreation or other public purpose; and WHEREAS, the statute further provides that said lands shall be exempt from county taxation so long as the same are used for such public purposes; and WHEREAS, Section 196.28 and Section 196.29, Florida Statutes 1971, provides that the Board of County Commissioners by resolution duly adopted and entered upon its minutes properly describing such lands and setting forth the public purpose to which the same are to be used and devoted shall have authority to remove the lands from the tax roles when used by governmental agency for recreational or other public use, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: 1. That by and under the authority of Section 196.28 and Section 196.29, Florida Statutes 1971, the Tax Assessor of Monroe County, Florida, shall assess and the Tax Collector of Monroe County, Florida, shall collect money on the lands described hereafter to reflect an assessment and collection of $628.22 on the following lands: A parcel of land on Boot Key, Monroe County, Florida, lying in Government Lot 7, Section 15, Twp. 66 S, Rge. 32 E, being a portion of that particular portion of said Government Lot 7, described in Deed Book G 68 at Page 385 of the Public Records of Monroe County, Florida, together with the adjoining parcel of submerged land being a portion of that certain parcel of submerged land conveyed by the Trustees of the Internal Improve- ment Fund Deed No. 20538 and being more particularly described as follows: Commence at the point of intersection of the East line of said Government Lot 7 with the Southerly Right-of-Way line of Sombrero Beach Road (State Road S~931) as shown on the plat of Waloriss Subdivision recorded in Plat Book 3 at Page 113 -2- of the said Public Records; thence run S81040"OO'" W along said Southerly Right;"of-Way line for 9 37. 50 :feet to the Point of Beginning of the herein described parcel; thence continue S81040'OO" W along said Southerly Right;"of-Way line and along the Southwesterly prolongation thereof, for 886.00 :feet to the point of intersection with the Westerly boundary line of said TIIF Deed No. 20538; thence run S 10030'00'" E along said Westerly boundary line for 944.03 feet to the point of inter- section of the Southerly boundary line of said TIIF Deed No. 20538; thence run N 79030 '00'" E along said Southerly boundary line for 806.54 feet; thence run N 5033'11" W for 913.94 feet to the Point of Beginning. AND ALSO A parcel of land on Boot Key, MonrOE:! County, Florida, lying in Government Lot 7, Section 15, Twp. 66 S, Rge.32 E, being a portion of that particular portion of said Government Lot 7, described in Deed Book G 68 at Page 385 of the Public Records of Monroe County, Florida, together with the adjoining parcel of submerged land being a portion of that certain parcel of submerged land conveyed by the Trustees of the Internal Improvement Fund Deed No. 20538 and being more particularly described as follows: Commence at the point of intersection of the East line of said Government Lot 7 with the Southerly Right;"of-way line of Sombrero Beach Road (State Road S..,931) as shown on the plat of Waloriss Subdivision recorded in Plat Book 3 at Page 113 of the said Public Records, thence run S 81040"00" W along said Southerly Right-of-Way line for 512~50 fbetto the Point of Beginning of the herein described parcel; thence continue S810'40'OO" W along said Southerly Right-of-Way line for 425.00 feet; thence run S 5033'11" E for 913.94 feet to the point of intersection of the Southerly boundary line of said TIIF Deed No. 20538; thence run N 79030 '00'" E along said Southerly boundary line for 386.89 feet; thence run N 3004'19" W for 902'.04 feet to the Point of Beginning. AND ALSO A parcel of land on Boot Key, Monroe County, Florida, lying in Government Lot 7, Section 15, Twp.66 S, Rge. 32 E, being a portion of that particular portion of said Government Lot 7, described in Deed Book G 68 at page 385 of the Public Records of Monroe County, Florida, together with the adjoining parcel of submerged land being a portion of that certain parcel of submerged land conveyed by the Trustees of the Internal Improve- ment Fund Deed No. 20538 and being more particularly described as follows: From the point of intersection of the Southerly Right-of-Way line of Sombrero Beach Road (State Road S-931) with the East line of said Government Lot 7, as shown on the plat of Waloriss Subdivision as recorded in Plat Book 3 at Page 113 of the said Public Records, said point being the Point of Beginning of the herein described parcel; thence run South along said East line of Government Lot 7 and along thE:! East line of the aforementionedTIIF Deed No. 20538, for 890.00 feet to the Southeast corner of said TIIF Deed No. 20538; thence run S 79039'99" W along the Southerly boundary of said TIIF Deed No. 20538 for 466.55 feet; thence run N 3C>04'l9" W for 902.04 feet to the point of intersection with the aforementioned Southerly Right-of-Way line of Sombrero Beach Road (State Road S..,93l); thence run N 81040'00" E along said Southerly Right-of- Way line for 512. 50 :feet to the Point of Beginning. . -3- 2. The Tax Collector of Monroe County, Florida, is hereby ordered to accept as full payment the sum of $628.22 as and for the complete payment of taxes on that property heretofore conveyed by STANLEY SWITLIK and WANDA SWITLIK, husband and wife, heretofore conveyed to the County of Monroe, State of Florida, a political subdivision of the State of Florida. 2nd day of April' , 1974.
