RESOLUTION NO. 67-1974
WHEREAS, the Zoning Board of Monroe County, Florida, at a public hear-
ing on March 22, 1974, duly called and held in accordance with the zoning regula-
tions of Monroe County, Florida, and the laws of the State of Florida, considered
the request of Joseph Cates, Jr. for a change of zoning of the West 100 feet of
Lot 4, Block 1 of Cudjoe Gardens, recorded in Plat Book 4, page 78, located in
Section 29, Township 66 South, Range 28 East (Cudjoe Key) Monroe County, Florida,
and
WHEREAS, after taking testimony and hearing all persons desiring to
be heard, said Board approved the request of change of zoning from RU-l to
BU-l, for landscaping business only, and if sold, it would revert back to its
original zoning of RU-l, and
WHEREAS, JOHN D. SHEA, JR., filed an appeal with the Board of County
Commissioners of Monroe County, Florida, asking the Board to reverse the
decision of the Zoning Board, in accordance with the laws applicable thereto,
and
WHEREAS, on the 11th day of June, 1974, the Board of County Commis-
sioners held such an appeal and after reviewing the record and proceedings and
said action taken at said public hearing on March 22, 1974, and taking testi-
mony and hearing all persons desiring to be heard, voted to uphold the action
of the Zoning Board in approving the request for change of zoning from RU-l
to BU-l, for landscaping business only, and if sold, it would revert back to
its original zoning of RU-l, as set forth in the petition filed by the said
Joseph Cates, Jr., with the Zoning Board of Monroe County, and
WHEREAS, it is necessary to pass a Resolution confirming the upholding
of the above action of said County Commission, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA, that the decision of the Zoning Board made at the public hearing on
March 22, 1974, approving the request of Joseph Cates, Jr., for change of zoning
on the West 100 feet of Lot 4, Block 1 of Cudjoe Gardens, recorded in Plat
Book 4, page 78, located in Section 29, Township 66 South, Range 28 East (Cudjoe
Key) Monroe County, Florida, from RU-l to BU-l, for landscaping business only,
and if sold, it would revert back to its original zoning of RU-l, be and the
same is hereby upheld.
