WHEREAS, the Zoning Board of Monroe County, Florida, at a
public hearing on December 14, 1973, duly called and held in accord-
ance with the zoning regulations of Monroe County, Florida, and the
laws of the State of Florida, considered the request of Riggers'
Survivors & Pension Fund, Inc., for a change of zoning on Parcels
1 through 6, located in Sections 8 & 9, Township 66 South, Range
32 East, containing 5 acres more or less (Key Vaca), and
WHEREAS, after taking testimony and hearing all persons de-
siring to be heard, said Board denied the request for the change of
zoning, and
WHEREAS, Riggers' Survivors & Pension Fund, Inc., filed an
appeal with the Board of County Commissioners of Monroe County,
Florida, asking the Board to reverse the decision of the Zoning
Board, in accordance with the laws applicable thereto, and
WHEREAS, on the 5th day of March, 1974, the Board of County
Commissioners held such appeal, and Mr. Fred A. Bee, attorney,
appeared on behalf of Riggers' Survivors & Pension Fund, Inc., and
after reviewing the record and proceedings and said action taken
in said public hearing held on December 14, 1973, and hearing the
argument of counsel of the above parties, voted to reverse the
Zoning Board in denying said request for change of zoning from
RU-5 to RU-3, with the provision that the owners agree that no more
than a total of 40 condominum apartments can be constructed on said
property at a density no greater than 13.8 units per acre as set
forth in the attached affidavit which is made a part hereof, and
WHEREAS, it is necessary to pass a resolution confirming the
above action of said Board of County Commissioners, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, that the decision of the Zoning Board made at the
public hearing on December 14, 1973, denying the request of Riggers'
Survivors & Pension Fund, Inc., for a change of zoning from RU-5 to

RU-3 on Parcels 1 through 6, located in Sections 8 & 9, Township
66 South, Range 32 East, continaing 5 acres more or less (Key Vaca)
is hereby reversed and the said Riggers' Survivors & Pension Fund,
Inc., is hereby granted a change of zoning from RU-5 to RU-3 pro-
vided that the owners agree that no more than a total of 40 condo-
minium apartments can be constructed on said property at a density
no greater than 13.8 units per acre as set forth in the attached
affidavit which is made a part hereof.
BE IT FURTHER RESOLVED BY SAID BOARD that the Clerk of said
Board be and he is hereby instructed to record this resolution and
the attached affidavit in the official records of Monroe County,
Florida.

or zoning was made to change the present clasification of zoning

y the Zoning Board of Monroe County, and this application was
ppealed to the Board of Zoning Appeals and heard on March 5, 1974.
t this hearing the Board of Zoning Appeals reversed the Zoning

upon my representation that no more than a total of forty condomin-
um apartments would be constructed on the subject property at a
ensity of no greater than 13.8 units per acre. I will not submit
building permit for construction on the subject property for more
han 40 apartment units and if I transfer title to this property I
ill place a deed restriction on the subject property restricting
construction on the property to 40 apartments or less."
