Resolution 129-1974 RESOLUTION NO. 129 -1974 WHEREAS, Section 145.022, FLORIDA STATUTES, authorizes the Board of County Commissioners by resolution, with the concurrence of the county official involved, to guarantee and appropriate a salary to the county official in an amount as provided in Chapter 145, FLORIDA STATUTES, in lieu of fees, if all fees collected are turned over to the Board of County Commissioners; and WHEREAS, the Clerk of the Circuit Court of Monroe County has requested in writing that he be paid a salary in lieu of fees and be placed on the budget system; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT: 1. The Board of County Commissioners of Monroe County, Florida, does hereby guarantee and appropriate to the Clerk of the Circuit Court of Monroe County, Florida, an annual salary in an amount as provided in Chapter 145, FLORIDA STATUTES, in lieu of all fees, and all fees collected by the Clerk shall be turned over to the Board. 2. The statutory and constitutional authority of the Clerk of the Circuit Court to control the operation of his office, de- termine and expend funds, to appoint deputies and employ persons, and to do any other things necessary for the proper operation of his office is hereby agreed to and shall remain under his direction and control. An annual appropriation shall be set aside by the Board of County Commissioners for the proper operation of the office of the Clerk of the Circuit Court and shall be provided for out of funds in the General Revenue Fund. The determination of the ap~ro- ! priation shall be upon joint agreement between the Clerk of the Cir- cuit Court and the Board of County Commissioners. Expenditures of funds a~propriated for operation of the Clerk's office shall be made by the Board of County Commissioners and accounted for only in the Board's financial accounts in accordance with approved account- ing procedure established by the Office of the State Comptroller and the Auditor General of the State of Florida. " I \ "~ -2- 3. Certified copies of this resolution shall be filed by the Clerk with the Department of Banking and Finance and with the Auditor General of Florida. 4. This resolution shall be retroactive to the date that the Clerk was actually placed on the budget system, which date was October 1, 1974.
