LIMITS OF ACCESS TO HARRY HARRIS PARK; PROVID;lNG Fat' CERTAIN EXCEPTIONS TO THRESHOLD LIMITS TO HARRY:'HARRI:& PARK; PROVIDING FOR DELAY IN CERTAIN IMPROVEMENTS A~ HARRY HARRIS PARK AND PROVIDING ALTERNATIVE FUNQJNG: F~ THOSE IMPROVEMENTS; PROVIDING FOR EFFECTIVE DATE. ,., r- rrJ ---. . --:~~1 :J e.'..! ::-:) 'I~ C) ::0 WHEREAS, certain sanitary facilities at Harry Harris Park are in such condition so as to need extensive repair and replacement, and WHEREAS, the extensive utilization of Harry Harris Park during the time period required for such replacement and repairs will materially affect the health, safety and welfare of those utilizing Harry Harris Park, and WHEREAS, Harry Harris Park's location and attractions have caused documented increased utilization by persons not residing in Monroe County, to the detriment and disadvantage of residents of Monroe County who wish to utilize such facilities, as well as unwarranted intrusion into the residential neighborhood surrounding Harry Harris Park, and WHEREAS, certain improvements previously approved for Harry Harris Park may no longer be able to be funded through grant sources which prohibit admission fees, and WHEREAS, those improvements are needed to serve the boating needs of residents of the Upper Keys, and WHEREAS, the Board of County Commissioners remains committed to providing those boating improvements for Monroe County residents, and WHEREAS, the Board of County Commissioners is desirous of promulgating procedures so as to continue to permit Monroe County residents to utilize Harry Harris Park both during the interim of sanitary facilities repair and replacement and subsequent time periods in such a manner as to not intrude unduly into the normal peace, quiet, and enjoyment of residential rights in the vicinity of Harry Harris Park, now. therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, Section 1. There is hereby established a user fee imposed at Harry Harris Park of $3.00 on all non-county residents and/or property owners over the age of sixteen (16) years entering said park by automobile, motorized or non-motorized vehicles, or on foot, per day, per person. Persons under the age sixteen (16), whether by automobile, motorized or non-motorized vehicle or on foot, regardless of residency shall not be charged. There is hereby established an additional user fee of $10.00 per trailer entering Harry Harris Park which conveys any boat, vessel, personal watercraft or other waterborne vehicle in the possession of any non-county resident and/or property owner. Evidence of county residency and/or county property owner shall be submission of Florida Driver's License, Monroe County automobile license tag on vehicle, whether self-propelled or towed, or proof by tax receipt for property taxes paid to Monroe County. Substantiation of date of birth may additionally be , ' required from those entering Harry Harris Park on non-motorized vehicles or on foot. Such user fees shall be charged only each weekend day (Saturday and Sunday) and on any weekday on which an officially declared National, State of Local holiday falls. The Board of County Commissioners hereby directs that such user fee funds accumulated be placed in a special account whose purpose is solely for those improvements delineated in Section 5 below which are unable to be funded under grant conditions that prohibit grant implementation where user fees are collected. Upon completion of such facilities improvements from such special fund, if any, such user fees shall then be utilized to offset Harry Harris Park normal operations and maintenance. Section 2. There is hereby established a temporary occupancy limitation, on any weekday or weekend day of one hundred fifty (150) persons in their attendant vehicles and twenty (20) trailers conveying any boat, vessel, personal watercraft or other waterborne vehicle. Such temporary occupancy limitations shall remain in effect for the months of June, July, August and September, 1992, or until such sanitary repairs and replacements have been deemed complete, whichever occurs later. Section 3. All other provisions relating to the governing of Harry Harris Park shall remain in force, including hours of operation, utilization of the recreation area beyond the boat ramp, scheduling of activities, regular softball or baseball activities, events charging admissions, and persons and/or I ' vehicles remaining within Harry Harris Park after normal closing hours. The Sheriff's Department of Monroe County is hereby requested to respond to and to enforce Ordinance No. 9-1977 as amended by Ordinances 18-1977, 9-1982, 9-1987, 26-1988, 36-1988 and 1-1992 as codified in Monroe County Code Chapter 13.5, Section 13.5-1 hereby attached, and as requested by park personnel. The Sheriff's Department of Monroe County is additionally hereby requested to routinely patrol the streets bordering Harry Harris Park to enforce No Parking zones as established. Section 4. Exceptions to the above admission fee and capacity limitations shall be for those events approved through the County Administrator's Office and approved by the Board of County Commissioners (as may be required) for special group utilization of the Harry Harris Park facilities. Those events shall utilize, within all practical limitations, the recreational area to the north of the boat ramp and shall abide by the hours and parking conditions as established in Monroe County Code Section 13.5-1. All other applicable County Park Rules, Regulations and/or Procedures shall continue to apply to those groups and special activities. Section 5. The Board of County Commissioners hereby directs that any improvements directed to be accomplished on October 9, 1991 (BOCC Minutes Page WW104-105) (attached) which are to be funded from sources which are expressly prohibited by grant funding conditions shall be henceforth funded from funds which accumulate in the special account established in Section 1 I ' above, and any other county funding which may be recommended by the County Administrator. Section 6. The Board of County Commissioners hereby declares that the contents of this Resolution shall become effective as soon as is practicable after its passage.
