RESOLUTION No. 56-1976
A RESOLUTION AUTHORIZING THE EXECUTION
OF A "CONTRACT FOR SALE AND PURCHASE" OF
REAL ESTATE
WHEREAS, the Board of County Commissioners of Monroe County, Florida, filed
an application to obtain Federal funds under the Community Development Block Grant
Program for the acquisition of real property for the purpose of low- and moderate -
income housing under the Section 8 Housing Assistance Payments Program; and
WHEREAS, the Department of Housing and Urban Development on September 3, 1975
approved said application for Non -Metropolitan Discretionary Funds in the amount
of Three -Hundred Thousand Dollars ($300,000); and
WHEREAS, all of the conditions imposed in the conditional funding approval of
September 3, 1975 and December 23, 1975 have been complied with; and
WHEREAS, the Department of Housing and Urban Development has acknowledged
compliance with all of the aforementioned conditions required for the completion
of the certification process and has provided Monroe County with this final
notification; and
WHEREAS, Monroe County has met all compliances necessary for the release of the
authorized grant in the amount of Three -Hundred Thousand Dollars ($300,000) under
their "Letter of Credit #86-00-4575" dated January 7, 1976; and
WHEREAS, Monroe County has complied With the Department of Housing and Urban
Development's appraisal requirements for the purchase of real property under the
Community Development Block Grant; and
WHEREAS, the Board of County Commissioners has examined and hereby acknowledges that
the Review Appraisal Report establishes just compensation for the realproperty; and
WHEREAS, the Monroe County Housing Authority was authorized on March 2, 1976
to proceed with the negotiations for the purchase of..re:a:l; pro perty. fon. Iow-imcome
housing and has secured an executed "Contract for Sale and Purchase"; and
.WHEREAS, the "Contract for Sale and Purchase", dated March 11, 1976, was
executed by the owner for a price consistent with the appraisal for just
compensation all of which was certified by the Monroe County Housing Authority
in their Resolution #18 adopted by their Board on March 22, 1976 to be in
compliance with all of the applicable Federal, State and County laws and the
requirements of the U.S. Department of Housing and Urban Development together
with all assurances extended to the U.S. Department of Housing and Urban Development
by Monroe County under Resolution #76-1975 dated May 13, 1975 in consideration
of approval of the aforementioned grant; and
WHEREAS, the Board of County Commissioners of Monroe County has recognized the
need for low- and middle -income housing in their Housing Assistance Plan and their
Community Development Plan;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Monroe County, Florida as follows:
1. That the estimated market value of the real property as of February 3, 1976,
submitted by the designated and approved review appraisers, Quality Appraisal and
Realty Services, Inc., in the amount of $272,050 is hereby approved to be just
compensation (fair market value) for acquiring marketable title to the real
property owned by Mr. Richard I. Goss and identified as "a parcel of land located
in part of Government Lot 2, Section 11, Township 66 South, Range 32 East, on Key
Vaca, Monroe County, Florida".
2. That the Mayor and Chairman of the Board of County Commissioners is hereby
authorized and directed to execute on behalf of the County of Monroe, State of
Florida, the "Contract for Sale and Purchase" between Richard I. Goss and the
County of Monroe, State of Florida, together with all other closing documents
required for the purchase of the real property as set forth in Schedule "A" of
the contract, and more particularly described as follows:
"A tract of land in a part of Government Lot 2, Section 11, Township 66
South, Range 32 East, on Key Vaca, Monroe County, Florida, and being more
particularly described by metes and bounds as follows:
COMMENCING at the intersection of the Southerly line of U.S. Highway No. 1
and the Easterly line of State Road No. S 931, bear South 15 degrees and
40 minutes East along the Easterly line of State Road No. S 931, 500 feet
to the point of beginning of the tract of land hereinafter described;
Thence continue bearing South 15 degrees and 40 minutes East along the
Easterly line of State Road No. S 931, 408.99 feet; thence bear North
84 degrees and 00 minutes East, 1260 feet, more or less, to a point on
the East line of Government Lot 2; thence bear North along the East line
of Government Lot 2, 630 feet, more or less, to a point which is bearing
North 74 degrees and 20 minutes East from the point of beginning; thence
bear South 74 degrees and 20 minutes West, 1441.02 feet, back to the
point of beginning, containing 15.61 acres, more or less.
