Resolution 341-1992 Monroe County Cc ion F!LEO r:: nr; ~~r-f\ORI- RESOLUTION NO. 341-1992 '92 JUL 23 AlO :41 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS 'U$; MONROE COUNTY, FLORIDA, EXPRESSING THE BOARD'S CONCERNCLr WITH RESPECT TO THE DISPARITY IN DISTRIBUTION OF s1~OF f SCHOOL FUNDS AND THE UNFAIR IMPACT OF TAXES ON MONROE COUNTY CITIZENS AS A RESULT THEREOF. K I iilNf, "L'. i " I I. f-"., WHEREAS, Article IX of the Florida Constitution requires the State to provide a uniform system of free public schools, and WHEREAS, to guarantee the quality of education in Florida schools, the Legislature has enacted the Florida Educational Finance Program as the cost of providing an education for students in individual school districts varies because of the cost of living differences and the special needs of individual students within each district, and WHEREAS, the Florida Educational Finance Program was intended to provide for a cost differential to equalize the funds allocated by the State regardless of property, wealth variation, and other factors, and WHEREAS, because of the unique economic and demographic qualities of the population of Monroe County the current Florida Educational Finance Program adjustment formula is grossly inequitable and deprives Monroe County of any significant benefit from these State funds and instead imposes the cost of the Monroe County school system totally upon the abilities of the local taxpayers, and WHEREAS, the Board of County Commissioners of Monroe County did, in 1986, file an action against the Governor and others with respect to the unfair impact of the distribution system upon Monroe County, and WHEREAS, that action was thereafter dismissed by the Court which found that the Commissioners of Monroe County Board of County Commissioners are without standing to maintain the action in their capacities as elected officials, and WHEREAS, Monroe County has thereafter encouraged the Board of Public Instruction of Monroe County to enter such a suit against the State and its appropriate agencies, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, do hereby declare their support of the Commissioners of the Monroe County Board of Public Instruction in any efforts that they may undertake with respect to litigating against the Governor's Office or other appropriate State agencies in an effort to secure a more appropriate distribution of the State funding formulas for educational expenses, and further, BE IT RESOLVED BY SAID BOARD, that the Board of County Commissioners of Monroe County will join in any efforts as an amicus curiae, or in any other capacity available to them in support of the Board of Public Instruction's efforts in these premises.
