Resolution 149-1975 RESOLUTION NO~49 -1975 WHEREAS, under the provisions of Florida Statutes 112.061 and 145.121 no express authorization is found for the allowance of per diem and travel expenses for county commissioners for travel to and from regular and special meetings of the board of county com- missioners, and WHEREAS, by opinion of the Attorney General of the State of Florida No. 075-237 dated August 28, 1975, it was found by statu- tory construction that the provisions of Florida Statute 112.061 did not expressly authorize the payment of per diem and travel ex- penses for members of district school boards while travelling from their homes to and from regularly scheduled school board meetings, and WHEREAS, said Attorney General's opinion appears likewise to be applicable to boards of county commissioners, and WHEREAS, county commission members and school board members are required to reside in the member residence district from which he or she was elected and which in some counties, such as the County of Monroe may be many miles from the place where administrative offices are located and their meetings regularly held so that said travel without reimbursement for mileage is a financial burden and hardship, and is inequitable, and WHEREAS, under said regressive provisions otherwise qualified persons may be discouraged from seeking public office due to said financial sacrifice or inability to have sufficient personal finances to afford same, and WHEREAS, said inequities could be cured by amendment to Florida Statutes 112.061 and 145.121 setting forth express authori- zation for travel expenses for board members who are required to travel from their homes to regular or special board meetings which are distances in excess of fifty (50) miles one way, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the Legislature of the State of Florida be and it is hereby requested to enact appropriate general legis la- -2- tion applicable to elected officials of the State of Florida express- ly providing for payment of travel expenses for any elected official who must travel a distance greater than fifty (50) miles one way from his home to and from any regular or special board meeting. BE IT FURTHER RESOLVED BY SAID BOARD that certified copies of this resolution be forwarded to the members of the Monroe County, Florida, delegation in the Florida Legislature and to the State Asso- ciation of County Commissioners and that they be asked to sponsor and support the enactment of same.
