Resolution 152-1975 RESOLUTION NO. 152-1975 WHEREAS, pursuant to Chapter 195,106 Florida Statutes 1974 Supplement, refunds of ad valorem taxes ordered to be made by the Department of Revenue are to be separately and severally pro- vided for and paid by each of the affected taxing authorities, with each taxing agency budgeting for its pro rata share of such refund and issuing and delivering its separate warrant in payment of its pro rata share of the total refund ordered by the Depart- ment of Revenue, and WHEREAS, the Attorney General of the State of Florida in Attorney General's Opinion 075-239 has ruled that pending legis- lative or judicial clarification or direction, such refunds may be made by the tax collector in an aggregate sum made up of the pro rata shares of the respective taxing agencies from undistributed funds collected and held for distribution to the respective taxing authorities upon the direction and approval of the governing boards of such taxing authorities, if funds for the payment thereof have been duly appropriated and budgeted for in existing budgets by the affected tax authorities, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the Monroe County Tax Collector be and he is hereby authorized to deduct from current funds due the Board of County Commissioners of Monroe County, Florida, any refunds of ad valorem taxes ordered to be made by the Department of Revenue. BE IT FURTHER RESOLVED BY SAID BOARD that the Clerk is hereby directed to forward a certified copy of this resolution to the Monroe County Tax Collector. DATED October 14, 1975.
