WHEREAS, the Monroe County Board of County Commissioners, on February 28, 1986,
adopted the Official land Use District Map, and therefore, designated the properties set
forth below with various zoning categories on the land Use District Map; and
WHEREAS, the Planning Department initiated a request to change the zoning from the
various existing designations as set forth below to Conservation District (CD); and
WHEREAS, the Development Review Committee recommended approval of the request to
the Planning Commission during a regular meeting on July 16, 1998, and the Planning
Commission recommended approval of the request to the Board of County Commissioners
during a public hearing on September 2, 1998; and
WHEREAS, the Board of County Commissioners, during a public hearing held on November
12, 1998, conducted a review and considered a request for a change in zoning filed by
Monroe County to change the various zoning designations to Conservation District (CD) for
the below described properties; and
WHEREAS, the Board of County Commissioners held a second public hearing on February
17, 2000 to consider the proposed amendment; and
WHEREAS, in November, 1999, portions of Monroe County incorporated to form the City
of Marathon; and
WHEREAS, at this time, the Board of County Commissioners no longer has jurisdiction
inside the city limits; and
WHEREAS, CoCo Plum Beach lies within the city's jurisdiction and was a property under
consideration for this zoning change; and
WHEREAS, the proposed zoning change for CoCo Plum Beach will be provided to the City
of Marathon to process; and
WHEREAS, the Board of County Commissioners hereby makes the following Findings of
Fact and Conclusions of law:
1. Based on Section 9.5-511 of the Monroe County Code (MCCl, the Board of County
Commissioners may consider a land use change if at least one of six criteria is met.
Goal 102 and Objective 101. 11 of the Year 2010 Comprehensive Plan stipulate that

Monroe County must implement measures to direct future growth away from
environmentally sensitive land. These properties were purchased by the County to
prevent development on environmentally sensitive land. Therefore, the proposed land
use changes are consistent with the requirements enumerated in Section 9.5-
511 (5){d)b.(v) (Need for Additional Comprehensiveness) of the Monroe County Code.
2. Based on the Monroe County Existing Conditions Maps and site visits by Monroe
County Biologists (Niko Reisinger and Dianna Stevenson), it has been determined that
these properties contain significant natural habitat worthy of preservation. Goal 102
and Objective 101. 11 direct Monroe County to encourage conservation and protection
of environmentally sensitive lands. Therefore, the proposed land use changes are
consistent with the standards enumerated in Goal 102 and Objective 101.11 of the
Year 2010 Comprehensive Plan.
3. Based on Section 9.5-225 of the Monroe County Code, the principal purpose of the
Conservation District (CD) land use category is to provide an area acquired for
conservation purposes. These properties were purchased by Monroe County with the
intent of conserving natural habitat. Therefore, the Conservation District (CD) land use
category is most applicable to these environmentally sensitive properties.
4. The environmental preservation of these sites, through limiting the use to passive
recreation, will greatly reduce the development potential on these properties.
Therefore, the proposed land use changes will not negatively impact existing public
facilities.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT:
Section 1. This Board specifically adopts the findings of fact and conclusions of law
both of the Planning Commission and those stated above.
Section 2. The below described properties, which currently have various zoning
designations, shall now be rezoned Conservation District (CD) as shown on the attached
maps, which are hereby incorporated by reference and attached as exhibit 1.

The Official Land Use District Map shall be amended as delineated in Section
Section 4. If any section, subsection, sentence, clause, item, change, or prOVISion of
this ordinance is held invalid, the remainder of this ordinance shall not be affected by such
invalidity .
Section 5. The Clerk of the Court shall provide a certified copy of this ordinance to the
Director of Planning.
Section 6. This ordinance shall be transmitted by the Director of Planning to the State
Land Planning Agency for consistency review.
Section 7. This ordinance shall be filed in the Office of the Secretary of the State of
Florida, but shall not be deemed effective until approved by the State Land Planning
Agency.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
Florida, at a regular meeting held on the 17th day of February , 2000.

Ordinance No. 013-2000 approving amendments to residential ROGO's affordable housing
provisions of the Monroe County Year 2010 Comprehensive Plan, including portions of policies

The Department of Community Affairs (the "Department") hereby issues its Final Order,
pursuant to§§380.05(6)and(11),Fla. Stat.,and§380.0552(9),Fla. Stat. (1999),which require the
Department to enter a final order approving or rejecting land development regulations adopted by
Monroe County. This Final Order approves Monroe County Ordinance No. 018-2000 as set forth
below.
FINDINGS OF FACT
1. The Florida Keys Area is a statutorily designated area of critical state concern, and
Monroe County is a unit of government within the Florida Keys Area.
2. On September 11, 2000, the Department received for review Monroe County
Ordinance No. 018-2000 which was adopted by the Monroe County Board of County
Commissioners on February 17, 2000 ( "Ord. 018-2000"). Ord. 018-2000.approved a request to
amend the County's zoning map from various zoning designations to Conservation District(CD)for
certain County-purchased properties described as: (a)Key Largo City,Garden Cove Section,Block
6, at approximately Mile Marker 106, Key Largo, Florida (Real Estate # 00558070); (b) Lots 1
through 8,Block 2,Bay Haven Subdivision, at approximately Mile Marker 95,Key Largo, Florida
(Real Estate #s 00516070 through 00516140); and (c) Lots 47-48, Block 3, Lots 8-9 and 45-48,

Block 4, and Lot 4, Block 6, Cutthroat Harbor Subdivision, at approximately Mile Marker 22.5,
Cudjoe Key, Florida(Real Estate #s 00176900, 00176910, 00178080, 00177040, 00177050, and
00177410 through 00177440).
3. Section 1 of Ord. 018-2000 adopts certain findings of fact and conclusions of law as
set forth in the body of the ordinance. Section 2 of Ord. 018-2000 changes the zoning designation
of the afore-described properties from various designations to Conservation District(CD); Section
3 amends the County's Official Land Use District Map in accordance with the foregoing; Section
4 contains a severability provision; Section 5 provides transmittal of this ordinance to the Director
of Planning; Section 6 requires transmittal of the ordinance to the Department for approval; arid
Section 7 requires filing with the Florida Secretary of State Office.
4. Ord. 018-2000 is consistent with and furthers Goal 102 and Objective 101.11 of the
County's 2010 Comprehensive Plan.
CONCLUSIONS OF LAW
1. The Department is required to approve or reject any and all land development
regulations that are enacted, amended or rescinded by any unit of government in the Florida Keys
Area of Critical State Concern within 60 days of receipt by the Department. §§ 380.05(6)and(11),
Fla. Stat., and § 380.0552(9),Fla. Stat. (1999).
2. Monroe County is a unit of government within the Florida Keys Area of Critical State
Concern. § 380.0552, Fla. Stat. (1999) and Rule 28-29.002 (superseding Chapter 27F-8, Fla.
Admin. Code) and Chapter 28-30,Fla. Admin. Code.

3. "Land development regulations"include local zoning,subdivision,building and other
regulations controlling the development of land. § 380.031(8), Fla. Stat. (1999). The regulations
adopted by Ord. 018-2000 are land development regulations, as defined by statute.
4. All land development regulations enacted,amended or rescinded by Monroe County
must be consistent with the Principles for Guiding Development(the"Principles"). §380.0552(7),
Fla. Stat.; see Rathkamp v. Department of Community Affairs, 21 F.A.L.R. 1902 (Dec. 4, 1998),
aff'd, 740 So. 2d 1209 (Fla. 3d DCA 1999). In reviewing the land development regulations for
consistency,the Principles shall be construed as a whole and no specific provision shall be construed
or applied in isolation from the other provisions. § 380.0552(7),Fla. Stat. (1999).
5. The Department has reviewed all provisions of Ord. 018-2000 for consistency with
the Principles and has determined that Ord. 018-2000 is consistent with the Principles as a whole.
Ord. 018-2000 changes the land use designation of certain properties which are environmentally
sensitive to Conservation District (CD) in furtherance of paragraphs (a), (c), (e), (f) and (1) of the
Principles. §§ 380.0552(7) (a), (c), (e),(f), and (1),Fla. Stat. (1999).
WHEREFORE, IT IS ORDERED that Ord. 018-2000 is found to be consistent with the
Principles found at § 380.0552(7), Fla. Stat. (1999), as a whole, and is hereby APPROVED.
This Order becomes effective 21 days after publication in the Florida Administrative Weekly
unless a petition is filed as described below.
