Ordinance 001-1985County Commission ORDINANCE NO. 001-1985 AN ORDINANCE OF MONROE COUNTY, FLORIDA, AMENDING ORDINANCE NO. 20-1980, CODIFIED AS SECTION 19-154 OF ARTICLE VI OF CHAPTER 19 OF THE MONROE COUNTY CODE OF ORDINANCES AND TITLED "LOBSTER TRAPS, CRAB TRAPS, FISH TRAPS AND FISH NETS;" PROVIDING FOR A TEMPORARY SUSPENSION OF THE LEGAL EFFECT OF SUBSECTION "B" OF SAID ORDINANCE AND THE USES AND ACTIVITIES PERMITTED UNDER SAID SUBSECTION "B" IN RU-1, RU-5, AND RU-5P ZONING DISTRICTS FOR A PERIOD OF TWO (2) YEARS COMMENCING APRIL 29, 1983; PROVIDING FOR RATIFICATION BY THE BOARD OF COUNTY COMMISSIONERS OF THE ACTIONS TAKEN BY SAID BOARD OF COUNTY COMMISSIONERS ON APRIL 29, 1983 IMPOSING A MORATORIUM ON THE EFFECTIVENESS OF SAID SUBSECTION "B" FOR A PERIOD OF TWO (2) YEARS BY MOTION AND UNANIMOUS APPROVAL DATED SAID DATE; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE TO THE EXTENT OF ANY SUCH CONFLICT; PROVIDING FOR INCLUSION OF THIS ORDINANCE IN THE MONROE COUNTY CODE OF ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Ordinance No. 20-1980, codified as Section 19-154 of the Monroe County Code of Ordinances is the subject matter of litigation now pending before the Circuit Court of the Sixteenth Judicial Circuit in Case Number 81-1017-CA-17 captioned Middle Keys Citizen's Association, et. al. vs. George Dolezal, et. al. challenging the legality and constitutionality of said Ordinance, and WHEREAS, on April 29, 1983, at a regular meeting of the Board of County Commissioners of Monroe County, Florida, a Motion was made, seconded and unanimously approved imposing a moratorium upon and suspending the provisions of subsection "B" of Ordinance No. 20-1980 for a period of two (2) years commencing said date, now, therefore, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows: Section 1. (A) Subsection "B" of Ordinance No. 20-1980, Codified as Subsection (b) of Section 19-154 of Article VI of Chapter 19 of the Monroe County Code of Ordinances is hereby suspended and to be of no legal effect for a period of two (2) years commencing on April 29, 1983, and the uses and activities described in said subsection "B" on RU-1, RU-5 and RU-5P shall not, during such time, be permitted uses and activities in such zoning districts. (B) No vacant RU-1 property shall be used for the purpose of constructing new lobster traps, crab traps, fish traps or fish nets, including new ropes and buoys. It shall c prohibited to dip, repair or store used lobster traps, crab traps or fish traps in any RU-1, RU-5 or RU-5P zoning districts. Section 2. The action taken on April 29, 1983 imposing a moratorium on and suspending the provisions of said Subsection "B" of Ordinance No. 20-1980 are hereby approved, reaffirmed and ratified. Section 3. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 4. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 5. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered as set forth hereinabove. Section 6. This Ordinance shall take effect immediately upon receipt of official notice from the office of the Secretary of State of the State of Florida that this Ordinance has been filed with said Office.
