AN ORDINANCE OF MONROE COUNTY, FLORIDA,
AMENDING ORDINANCE NO. 1-1973, AS AMENDED,
CODIFIED AS CHAPTER 19 OF THE MONROE COUNTY
CODE OF ORDINANCES, BY CREATING, DESIGNATING
AND DESCRIBING A NEW ZONING DISTRICT TO BE
KNOWN AS "INSTITUTIONAL DISTRICTS" AND PRO-
VIDING FOR HOSPITAL DISTRICTS WITHIN SAID
DESIGNATION; PROVIDING A STATEMENT OF INTENT
FOR THE CREATION OF HOSPITAL ZONING DISTRICTS;
PROVIDING FOR LOCATIONAL REQUIREMENTS, PRIN-
CIPAL AND ACCESSORY PERMITTED USES, USES PER-
MITTED UPON SPECIAL APPROVAL AND CERTAIN PRO-
HIBITED USES; PROVIDING FOR LOT SIZE, AREA
SETBACK AND BUILDING REQUIREMENTS IN SAID
HOSPITAL ZONING DISTRICTS AS WELL AS LOT
COVERAGE PERCENTAGES AND HEIGHT REQUIREMENTS;
PROVIDING FOR HOSPITAL ROOM, FLOOR SPACE, FOOD
PREPARATION AND DENSITY REQUIREMENTS; PROVID-
ING FOR PARKING FACILITIES AND FOR APPROPRIATE
SIGNS; PROVIDING FOR THE REPEAL OF SECTION
19-216(a)(8) TO THE EXTENT SAID SECTION
CONFLICTS WITH THIS ORDINANCE AS TO THE PROPER
ZONING DISTRICT IN WHICH HOSPITALS MAY EXIST
AND DO BUSINESS AS DESCRIBED IN THIS
ORDINANCE; PROVIDING FOR INCLUSION OF THIS
ORDINANCE IN THE MONROE COUNTY CODE OF ORDI-
NANCES AS ARTICLE XV, SECTION 19-400 OF SAID
CODE; PROVIDING FOR SEVERABILITY; PROVIDING
FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT
OF ANY SUCH CONFLICT AND PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1. Chapter 19 of the Monroe County Code of
Ordinances is hereby amended by the inclusion of the following to
be numbered as set forth therein:
"Article XV. Institutional Districts
Sec. 19-400. HU Hospital Zoning District.
a. Purpose: This district is intended to provide a place
on which:
1. Hospitals, private and public, for profit and not
for profit, can be built, established, operated and
maintained.
2. Health Care Support facilities can be built,
established, operated and maintained.
3. Associated Health Care Business can be built,
established, operated and maintained.
b. Location: Such a facility shall be located adjacent to
a major arterial street. Access to the facility shall be in such
a manner so as to allow for ambulance service and the access of a
large number of private vehicles.
c. Principal Uses Permitted: Inpatient and outpatient care
of the sick and injured, including all medically related
activities usually and customarily associated with such
activities. Medical education and the maintenance of medical
standards in the community. Prevention of disease and the pro-
motion of health. The advancement of medical research.
d. Accessory Uses Permitted: Those business activities for
profit and non-profit that would support a Hospital, Health Care
Support Facility and support businesses are as follows: Medical
Services, Medical Records, Radiology, Laboratories, Pharmacy,
Dietary, Obstetrical Services, Surgical, Anesthesia Services,
Inhalation Therapy, Occupational Therapy, Physical Therapy,
Denistry, Nursing Services, Emergency Department, Medical -Surgi-
cal Supply, Control of Infectious Diseases, Housekeeping
Services, Maintenance Services, Fire Control, Disaster Control,
support services found in other hospitals, nursing home, congre-
gate living facilities, ambulatory surgical center, School train-
ing institution, laboratory or health care community support
services, business support services to health care support
facilities, community services and community needs related to
health care, laundries, day care centers, cafeterias, material
handling, physician offices, personnel agencies, health insurance
services, health maintenance organization, philanthropic
endeavors, garages, maintenance shops, Cancer Registry, Coroner's
office, volunteer services, helicopter pad, professional
services, communication systems including requisite antenna, gift
shops, and storage of volatile liquids.
e. Uses Permitted Upon Special Approval:
1. Associated business which support any or all of the
above named uses not specifically mentioned in (c)
and (d) above.
f. Uses Prohibited: Heavy industry, fee simple resi-
dential, all other uses except (c), (d) and (e) above, unless
they can be shown to be associated with other Hospitals in the
State of Florida or are required by State or Federal rules and
regulations.
g. Lot and Building Requirements:
1. Minimum project area;
a. two (2) acres.
2. Minimum lot width: one hundred fifty (150) feet.
3. Minimum lot depth: one hundred fifty (150) feet.
4. Minimum front yard: Fifty (50) feet.
a. Abutting a road, fifty (50) feet from closest
edge of right of way.
5. Minimum rear yard:
a. Abutting another parcel of land or subdivision,
twenty (20) feet.
b. Abutting a road, thirty (30) feet from closest
edge of right of way.
c. Abutting U.S. Highway No. 1, fifty (50) feet
from closest edge of right of way.
6. Minimum side yards:
a. Between buildings up to two (2) stories:
Twenty (20) feet.
b. Between buildings up to four (4) stories:
Thirty (30) feet.
c. Abutting a road or another parcel: Twenty (20)
feet.
d. Abutting U.S. Highway No. 1 (Overseas Highway):
Fifty (50) feet.
7. a. Minimum setback from any man-made waterway:
Twenty (20) feet.
b. Minimum setback from mean high water mark from
any natural waterway: Fifty (50) feet.
8. Overall height shall not exceed forty-four (44)
feet AGL and shall not exceed four (4) stories.
9. Maximum percentage of lot coverage, including
required vehicle parking areas and appurtenant
driveways or access drives: Eighty (80) percent.
10. Density: Per Current State Licensing and

14. Off Street Parking Requirements: One (1) space for
each hospital bed. All other parking facilities will be provided
as required in sections 19-125, 19-126 and 19-127 of this
chapter.
15. Signs permitted: Class "A" signs complying with
the sign requirements provided in Article XII of this chapter.
Section 2. Section 19-216(a)(8) is hereby repealed to the
extent that said section conflicts with this ordinance by provid-
ing that "hospitals" be a principal permitted use in BU-1 zoning
districts.
Section 3. Hospitals licensed and in existence and in
operation prior to the effective date of this ordinance and in
conformance to the requirements of the zoning district in which
it is located shall be considered to conform to this Institu-
tional District and shall be treated as though such hospitals
were situated in an Institutional District for the purposes and
enforcement of this Chapter and shall not be deemed to be non-
conforming.
Section 4. If any section, subsection, sentence, clause or
provision of this Ordinance is held invalid, the remainder of
this Ordinance shall not be affected by such invalidity.
Section 5. All ordinances or parts of ordinances in
conflict of this Ordinance are hereby repealed to the extent of
said conflict.
Section 6. The provisions of this Ordinance shall be
included and incorporated in the Code of Ordinances of the County
of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered as set forth hereinabove.
Section 7. This Ordinance shall take effect immediately
upon receipt of official notice from the Office of the Secretary
of State of the State of Florida that this Ordinance has been
filed with said Office.
