Ordinance 021-1985ORDINANCE NO. 021 -1985 AN ORDINANCE DECLARING THE BUILDING OF THE ADDITION OF SUGARLOAF SHORES ELEMENTARY SCHOOL TO BE AN EMERGENCY AND PROVIDING FOR THE SAME TO BE PERMITTED IN A GU ZONE; PROVIDING FOR SEVERABILITY; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SAID CONFLICT; PROVIDING FOR INCLUSION IN THE CODE OF ORDINANCES OF MONROE COUNTY, FLORIDA; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, an emergency has arisen concerning the furnishing of proper school facilities for the Sugarloaf Shores Elementary, and WHEREAS, the addition for said school is necessary in the furtherance of the health, welfare and safety of the citizens in Monroe County, in that it provides for the necessary facility for the education of the youth in the Sugarloaf Shores area, and WHEREAS, the County Commission deems that public schools are a necessity in the training and education of the youth of Monroe County, and WHEREAS, to accomplish the addition of the Sugarloaf Shores Elementary School as alluded to herein that the County Commission finds an emergency threatening the health, welfare and safety of the citizens of this County in that the same could not be con- structed in accordance with the now existing requirements other than through the declaration of an emergency, now, therefore, BE IT ORDAINED BY THE MAYOR AND THE COUNTY COMMISSION OF MONROE COUNTY, FLORIDA, that: 1. This Commission does declare that an emergency has arisen and that the building of the addition to the Sugarloaf Shores Elementary School is required to preserve the health, welfare and safety of the citizens of Monroe County, and that the same is thereby threatened by not permitting such addition. 2. That this Commission by unanimous vote finds that such emergency has arisen, and that such addition shall be permitted to be constructed and the cause of the plans in the contract are already in being. 3. That said school shall be permitted in the zone in which it is to be constructed which is a GU Zone. 4. If any section, subsection, sentence, clause or pro- vision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. 5. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of any such conflict. 6. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. 7. This Ordinance shall be deemed to be filed and shall take effect when a copy has been accepted by the postal author- ities of the government of the United States for special delivery by registered mail to the Department of State of the State of Florida.
