ORDINANCE NO. 026-1985
AN ORDINANCE REPEALING SECTION 6-42 OF THE
CODE OF ORDINANCES AMENDING THE SAME TO
PROVIDE FOR A LIMITATION ON WAIVERS OF
BUILDING FEES ON EXEMPT BUILDING FEE PERMITS;
PROVIDING FOR EXCEPTIONS ONLY ON CERTAIN
CIRCUMSTANCES; PROVIDING FOR SEVERABILITY;
REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT WITH THIS ORDINANCE TO
THE EXTENT OF SAID CONFLICT; PROVIDING FOR
INCLUSION IN THE MONROE COUNTY CODE OF
ORDINANCES; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1. That Section 6-42 of the Code of Ordinances of
Monroe County is hereby repealed.
Section 2. That Section 6 of the Code of Ordinances of
Monroe County, entitled Building and Construction, shall be
amended to include a new section to be known as 6-42 entitled FEE
EXEMPTIONS. That said section shall henceforth read as follows:
"The County of Monroe, the State of Florida, the United
States of America, all corporate municipalities situated
wholly within the boundaries of Monroe County, the City
Electric System, the Florida Keys Electric Cooperative, the
Florida Keys Aqueduct Authority, the Monroe County
School District, and other governmental entities shall be
exempt for the requirements for a Building fee for
construction in Monroe County. There shall be no waiver of
building fees for any other applicants than those enumerated
in the preceding sentence."
Section 3.
If any section, subsection, sentence, clause or
provision of this Ordinance is held invalid, the remainder of
this Ordinance shall not be affected by such invalidity.
Section 4. All ordinances or parts of ordinances in
conflict with this Ordinance are hereby repealed to the extent of
said conflict.
Section 5.
The provisions of this Ordinance shall be
included and incorporated in the Code of Ordinances of the County
of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform
numbering system of the Code.
Section 6. This Ordinance shall take effect immediately
upon receipt of official notice from the Office of the Secretary
of State of the State of Florida that this Ordinance has been
filed with said Office.

NOTICE IS HEREBY GIVEN TO WHOM IT MAY CONCERN that on
Friday, August 2, 1985 at 8:30 A.M. at Courtroom "B" of the
Monroe County Courthouse Annex, 500 Whitehead Street, Key West,
Monroe County, Florida, the Board of County Commissioners of
Monroe County, Florida, intends to consider the adoption of the
following County Ordinance:

Pursuant to Section 286.0105, Florida Statutes, notice is
given that if a person decided to appeal any decision made by the
Board with respect to any matter considered at such hearings or
meetings, he will need a record of the proceedings, and that, for
such purpose, he may need to ensure that a verbatim record of the
proceedings is made, which record includes the testimony and
evidence upon which the appeal is to be based.
