Ordinance 010-1984ORDINANCE NO. 010-1984 AN ORDINANCE OF MONROE COUNTY, FLORIDA, AMENDING SECTION 13-26 AND SECTION 13-29 OF DIVISION 2, ENTITLED "TELEVISION TRANSLATOR TAXING DISTRICT", OF ARTICLE II OF CHAPTER 13 OF THE MONROE COUNTY CODE OF ORDINANCES OF MONROE COUNTY, FLORIDA, PROVIDING FOR THE INCLUSION OF THE CITY OF KEY WEST AND/OR THE CITY OF KEY COLONY BEACH IN THE TRANSLATOR DISTRICT; PROVIDING THAT UPON PASSAGE BY REFERENDUM, SAID CITY OF KEY WEST AND/OR THE CITY OF KEY COLONY BEACH SHALL BECOME A PART OF THE TRANSLATOR DISTRICT; PROVIDING FOR A TAX TO BE ASSESSED AGAINST ALL REAL PROPERTY IN KEY WEST AND/OR KEY COLONY BEACH FOR SAID TRANSLATOR DISTRICT NOT TO EXCEED ONE -QUARTER OF ONE MILL ($0.00025) ON EACH ONE DOLLAR ON ASSESSED VALUE OF REAL PROPERTY IN KEY WEST, FOR A PERIOD NOT TO EXCEED TEN (10) YEARS, WHICH BEGAN IN 1982; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE; PROVIDING FOR INCLUSION IN THE CODE OF ORDINANCES OF MONROE COUNTY, FLORIDA; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND COUNTY COMMISSION OF MONROE COUNTY, FLORIDA, that: Section 1. Section 13-26 of the Code of Ordinances of Monroe County, Florida, entitled "Created", be amended so that such section shall read as follows: "Sec. 13-26. Created. A special tax district is hereby created in Monroe County for the purpose of providing for the funding of a translator system when and if approved by referendum. Said district will be as follows: All of Monroe County, Florida, except North Key Largo Beach, and such that the City of Key West and the City of Key Colony Beach shall independently and separately vote on said question." Section 2. Section 13-29 of the Code of Ordinances of Monroe County, Florida, entitled "Ad Valorem Tax Levied", be amended so that such section shall read as follows: "Sec. 13-29. Ad valorem tax levied. An ad valorem tax of one -quarter of one mill ($0.00025) on each one dollar on assessed value of real property in Key West and/or the City of Key Colony Beach for a period of not to exceed ten (10) years commencing in 1982 is hereby established for the purpose of funding a translator system for Monroe County including the City of Key West and the City of Key Colony Beach. This tax created for the special district aforesaid shall be for the purpose of creating a translator system for the special district, the same consisting of five (5) translator towers which shall provide for the reception of five (5) channels through said system." Section 3. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 4. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 5. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 6. This Ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said Office.
