Ordinance 019-2000 ORDINANCE #019 -2000 AN ORDINANCE BY THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS APPROVING THE REQUEST BY MONROE COUNTY TO CHANGE THE LAND USE DISTRICT MAP FROM VARIOUS ZONING DESIGNATIONS TO PARK AND REFUGE DISTRICT (PRl FOR FRIENDSHIP PARK, KEY LARGO COMMUNITY PARK, HARRY HARRIS PARK, OLD SETTLER'S PARK, BLUE HERON PARK, WATSON FIELD, RAMROD KEY SWIMMING HOLE, BAY POINT PARK, WILHELMINA HARVEY CHILDREN'S PARK, AND BERNSTEIN PARK. :r o 0 :.;: )> ::::Onz Or- =r::: f"Tl;x-< no r- On. ~~3 -in. ~ :<. ..::x:: "'Fl. > ,.- /- ;;, WHEREAS, the Monroe County Board of County Commissioners, on February 28, 1986, adopted the Official Land Use District Map, and therefore, designated the properties set forth below with various zoning categories on the Land Use District Map; and WHEREAS, the Planning Department initiated a request to change the zoning from the various existing designations set forth below to Park and Refuge District (PRl; and WHEREAS, the Development Review Committee recommended approval of the request to the Planning Commission during a regular meeting on July 16, 1998, and the Planning Commission recommended approval of the request to the Board of County Commissioners during a public hearing on September 2, 1998; and WHEREAS, the Board of County Commissioners, during a public hearing held on November 12, 1998, conducted a review and considered a request for a change in zoning filed by Monroe County to change the various zoning designations to Park and Refuge District (PRl for the below described properties; and WHEREAS, the Board of County Commissioners held a second public hearing on February 17, 2000 to consider the proposed amendment; and WHEREAS, in November, 1999, portions of Monroe County incorporated to form the City of Marathon; and WHEREAS, at this time, the Board of County Commissioners no longer has jurisdiction inside the city limits; and WHEREAS, Marathon Park and Jesse Hobbs Park lie within the city's jurisdiction and was a property under consideration for this zoning change; and WHEREAS, the proposed zoning change for Marathon Park and Jesse Hobbs Park will be provided to the City of Marathon to process; and Parks/CPR) Page 1 of 4 Initials o o ~ N en 2:! r- rn c;:j ." o ;:0 ;::0 ", C'"') <:> ;:0 o - - .. .r. ..... WHEREAS, the Board of County Commissioners hereby makes the following Findings of Fact and Conclusions of Law: 1. Based on Section 9.5-511 of the Monroe County Code (MCC), the Board of County Commissioners may consider a land use change if at least one of six criteria is met. Policy 1201.4. 1 of the Year 2010 Comprehensive Plan stipulates that existing County-owned neighborhood and community parks be assigned to the Park and Refuge land use district. In addition, Policy 1201.4.2 states that upon fee simple acquisition, new County-owned neighborhood and community park sites shall be reassigned to the Park and Refuge land use district. Therefore, the proposed land use changes are consistent with the requirements enumerated in Section 9.5-511 (5)(d)b.(v) (Need for Additional Comprehensiveness) of the Monroe County Code. 2. Based on Section 9.5-224 of the Monroe County Code, the principal purpose of the Park and Refuge District (PR) land use category is to establish and protect areas as parks, recreational areas, and wildlife refuges. These properties are currently used as public parks. Therefore, the Park and Refuge District (PR) land use category is most applicable to these existing County park sites. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT: Section 1. This Board specifically adopts the findings of fact and conclusions of law both of the Planning Commission and those stated above. Section 2. The below described properties, which currently have various zoning designations, shall now be rezoned Park and Refuge District (PR) as shown on the attached maps, which are hereby incorporated by reference and attached as exhibit 1. Stat. (1999), which require the Department to enter a final order approving or rejecting land development regulations adopted by Monroe County. This Final Order approves Monroe County Ordinance No. 019-2000 as set forth below. FINDINGS OF FACT 1. The Florida Keys Area is a statutorily designated area of critical state concern, and Monroe County is a unit of government within the Florida Keys Area. 2. On September 13, 2000, the Department received for review Monroe County Ordinance No. 019-2000 which was adopted by the Monroe County Board of County Commissioners on February 17, 2000 ( "Ord. 019-2000"). Section 2 ofOrd. 019-2000 changes the zoning designation of the afore-described properties from various designations to Park and Refuge District (PR); Section 3 amends the County's Official Land Use District Map in accordance with the foregoing; Section 4 contains a severability provision; Section 5 provides transmittal of this ordinance to the Director of Planning; Section 6 requires transmittal of the ordinance to the Department for review; and Section 7 requires filing with the Florida Secretary of State Office. 4. Ord. 019-2000 is consistent with the County's 2010 Comprehensive Plan. 2 DCA Final Order No. DCAOO-OR-293 CONCLUSIONS OF LAW 1. The Department is required to approve or reject any and all land development regulations that are enacted, amended or rescinded by any unit of government in the Florida Keys Area of Critical State Concern within 60 days of receipt by the Department. ~~ 380.05(6) and (11), Fla. Stat., and ~ 380.0552(9), Fla. Stat. (1999). 2. Monroe County is a unit of government within the Florida Keys Area of Critical State Concern. ~ 380.0552, Fla. Stat. (1999) and Rule 28-29.002 (superseding Chapter 27F-8, Fla. Admin. Code) and Chapter 28-30, Fla. Admin. Code. 3. "Land development regulations" include local zoning, subdivision, building and other regulations controlling the development of land. ~ 380.031 (8), Fla, Stat. (1999). The regulations adopted by Ord. 019-2000 are land development regulations, as defined by statute. 4. All land development regulations enacted, amended or rescinded by Monroe County must be consistent with the Principles for Guiding Development (the "Principles"). ~ 380.0552(7), Fla. Stat.; see Rathkamp v, Department of Community Affairs, 21 F.A.L.R. 1902 (Dec. 4, 1998), afJ'd, 740 So. 2d 1209 (Fla. 3d DCA 1999). In reviewing the land development regulations for consistency, the Principles shall be construed as a whole and no specific provision shall be construed or applied in isolation from the other provisions. ~ 380.0552(7), Fla. Stat. (1999). 5. The Department has reviewed all provisions ofOrd. 019-2000 for consistency with the Principles and has determined that Ord. 019-2000 is consistent with the Principles as a whole. Ord. 019-2000 changes the land use designation of certain properties which are County-owned parks 3 DCA Final Order No. DCAOO-OR-293 to Park and Refuge (PR) and is in furtherance of paragraphs (a), (c), (e), (f), (h), and (1) of the Principles. ~~ 380.0552(7) (a), (c), (e), (f), (h), and (1), Fla. Stat. (1999). WHEREFORE, IT IS ORDERED that Ord. 019-2000 is found to be consistent with the Principles found at ~ 380.0552(7), Fla. Stat. (1999), as a whole, and is hereby APPROVED.
