AN ORDINANCE OF THE COUNTY OF MONROE, FLORIDA,
PROVIDING THAT THE CODE OF ORDINANCES OF THE
COUNTY OF MONROE, FLORIDA, BE AMENDED BY ADDING A
SECTION TO BE NUMBERED 6.6, ENTITLED "COUNTY FIRE
MARSHALL", THEREBY PROVIDING FOR THE POSITION OF
COUNTY FIRE MARSHALL AND PROVIDING FOR THE DUTIES
AND RESPONSIBILITIES OF SAID COUNTY FIRE MARSHALL;
PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL-
ING OF ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT WITH THIS ORDINANCE TO THE EXTENT OF SAID
CONFLICT; PROVIDING FOR INCLUSION IN THE MONROE
COUNTY CODE OF ORDINANCES; DIRECTING THAT COPIES
OF THIS ORDINANCE BE FILED WITH THE DEPARTMENT OF
COMMUNITY AFFAIRS AND THE DEPARTMENT OF STATE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Board of County Commissioners of Monroe County,
Florida, is authorized by Chapter 125, Florida Statutes, to adopt
ordinances for the purpose of providing fire protection; to adopt
and enforce building, housing and related technical codes and
regulations; to employ personnel; and to adopt ordinances
necessary for the exercise of its power; and
WHEREAS, the Board has determined that it is necessary to
create Chapter 6.6, COUNTY FIRE MARSHALL, as part of the Code of
Laws and Ordinances of Monroe County;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, that:
Section 1. The following Chapter 6.6 is added to the Monroe
County Code:
"CHAPTER 6.6. COUNTY FIRE MARSHALL.
Sec. 6.6-1(a). Appointment of County Fire Marshall and
responsibilities.
The Board of County Commissioners shall appoint a
County Fire Marshall who shall be responsible for the
enforcement and administration of local and state fire
codes.
Sec. 6.6-1(b). Job Description of County Fire
That the job description and requirements for the
position of Fire Marshall are set forth as an addendum to
this Ordinance and is incorporated herein by reference.
Sec. 6.6-2. Duty to enforce certain laws and
ordinances.
It shall be the duty of the County Fire Marshall to
enforce all laws and ordinances of Monroe County, covering
the following:
(a) The prevention of fires;
(b) The storage and use of explosives and
flammables;
(c) The installation and maintenance of automatic
and other fire alarm systems and fire extin-
guishing equipment;
(d) The maintenance and regulation of fire
escapes;
(e) The means and adequacy of exits in case of
fire, from factories, schools, hotels,
restaurants, lounges, lodging houses,
asylums, hospitals, churches, halls,
theaters, amphitheaters, and all other
places in which numbers of persons work, live
or congregate, from time to time, for any
purpose;
(f) The investigation of the cause, origin and
circumstances of fire;
(g) The maintenance of fire cause of loss
records;
(h) This shall specifically grant the Fire
Marshall authority to issue citations for
violations of this Ordinance.
Sec. 6.6-3. Duty to investigate and make recommenda-
tions.
It shall be the duty of the County Fire Marshall to
investigate and to recommend to the Monroe County Board of
County Commissioners such additional ordinances or amend-
ments to existing ordinances, as he may deem necessary for
safeguarding life and property against fire.
Sec. 6.6-4. Duty to inspect.
(a) The Fire Marshall shall inspect or cause to be in-
spected all prem#aea buildings on a periodic basis that are
two (2) floors in elevation or more and those properties in
an RU-7 zone and BU, BU-1, BU-2 and BU-3 zones, including
public buildings, and shall make such orders as may be
necessary for the enforcement of the laws and ordinances
governing the same and for safeguarding of life and property
from fire.

(b) The Fire Marshall shall inspect all-new-kuildiRg
multiple building and commercial plans to see that the same
complies with all fire prevention and control provisions of
the Ordinances of Monroe County and the State of Florida.

Section 2. If any section, subsection, sentence, clause or
provision of this Ordinance is held invalid, the remainder of
this Ordinance shall not be affected by such invalidity.
Section 3. All ordinances or parts of ordinances in
conflict with this Ordinance are hereby repealed to the extent of
said conflict.
Section 4. The provisions of this Ordinance shall be
included and incorporated in the Code of Ordinances of the County
of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform
numbering system of the Code.
Section 5. The Clerk of the Board of County Commissioners
of Monroe County, Florida, is hereby instructed to forward a
certified copy of this Ordinance to the Secretary, Department of
Community Affairs, 2571 Executive Center Circle, East,
Tallahassee, Florida 32301.
Section 6. This Ordinance shall take effect immediately
upon official notice from the Office of the Secretary of State of

Office.

ADDENDUM
JOB DESCRIPTION
DEFINITION:
A. This position requires highly skilled, technical, clerical
and administrative work at the supervisory level in fire preven-
tion. The fire marshall will be responsible for the enforcement
of local and state fire codes and work with other local agencies
and state agencies in fire prevention.
B. He will work laterally with the Department of Emergency
Services, the Monroe County Building Department, and the local
volunteer fire departments.
C. He will work under the supervision of the County Admini-
strator.
AREAS OF RESPONSIBILITY:
A. Reviews building plans, existing premises and structures for
fire hazards and conformance with applicable fire prevention
ordinances and codes.
B. Makes recommendations, after review, for licensing and certi-
ficates of occupancy for business, industrial, multi -family and
institutional buildings. Reviews plans required for the instal-
lation of flammable liquid tanks, spray painting operations,
standpipe and sprinkler systems and other fire protective equip-
ment.
C. Upholds National Fire Protection Association standards as
incorporated into the Monroe County Building Code, and regula-
tions necessary to keep the County fire codes updated; assists in
the development of other County codes and regulations pertaining
to fire safety.
D. Develops fire prevention and fire inspection education pro-
grams for presentation to civic, institutional and fraternal
organizations. Conducts and directs programs to various
agencies.
E. Initiates all arson investigations of any fires of suspicious
origin.
F. Compiles statistical data and reports to reflect the
operation of the Fire Marshall's office; records data on all
fires including owner, occupant, loss, insurance coverage,
insurance paid and other pertinent information.
G. Has the authority to issue citations for violations for
appearance before the Code Enforcement Board.
H. Performs related work as required.
KNOWLEDGE, SKILLS AND ABILITIES:
A. Ability to maintain composure in a demanding environment.
B. Knowledge of rules, regulations, statutes and ordinances
affecting the Division function.
C. Knowledge of the Southern Building Code and demonstrated
ability to work from blueprints, electrical schematics, plans and
specifications.
D. Knowledge of supervised fire alarm circuits, standpipe and
sprinkler installations.
