Ordinance 024-1984Commissioner Edwin 0. Swift ORDINANCE NO.024-1984 AN ORDINANCE OF MONROE COUNTY, FLORIDA, CREATING A SPECIAL ROAD AND BRIDGE DISTRICT CONSISTING OF ALL PROPERTY ON GULF DRIVE, BIG COPPITT KEY; PROVIDING FOR THE PURPOSES OF THE DISTRICT; DESIGNATING THE GOVERNING BODY THEREOF; PROVIDING FOR THE POWERS AND DUTIES THEREOF; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1. ESTABLISHMENT There is hereby created and established a Special Road and Bridge District comprised of all property bordering on Gulf Drive, Big Coppitt Key, Florida, pursuant to the provisions contained in Section 336.28, et seq., of the Florida Statutes, and the results of a Special Referendum of the duly qualified elec--ors of the said District, held on August 7, 1984. Section 2. PURPOSES The purposes of this Special Road and Bridge District are to construct or reconstruct, repair or repave Gulf Drive, a permanent road within the District, which is not a dedicated County road. Section 3. GOVERNING BODY The governing body of the Gulf Drive Special Tax Road District shall be the Board of County Commissioners of Monroe County, Florida, as elected or appointed from time to time. Section 4. POWERS AND DUTIES The Board of County Commissioners of Monroe County, Florida, acting as the governing body of the District shall have the following powers and duties: 1. The Board may advertise for bids and let contract or contracts for the construction or reconstruction, repair or repaving of Gulf Drive within the District to be performed in conformance with the standards and requirements for public roads within the County. 2. The cost of the construction or reconstruction, repair or repaving of Gulf Drive within the District, which shall not exceed $2g.5oo_oo dollars, shall be paid for by the Board from ad valorem tax revenues as authorized by this Ordinance, and with funds otherwise designated for the use of this District, but shall not be paid for with other tax revenues generated by the County of Monroe or the State of Florida. 3. The Board if authorized to impose a tax not to exceed 7.868 mills on the assessed valuation of the taxable real property in the District, to be levied and collected annually each year for a period of time not exceeding ten (10) years. The Board may issue tax anticipation warrants or notes, to be paid from the ad valorem taxes hereby authorized, in accordance with the general law, in order to fund the construction or reconstruction, repair or repaving of Gulf Drive in the District. Section 5. SEVERABILITY If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 6. EFFECTIVE DATE This Ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said Office.
