AN ORDINANCE OF THE COUNTY OF MONROE, FLORIDA
AUTHORIZING EXPENDITURE OF BUDGETED FUNDS FOR
THE USE OF OLD TAVERNIER TOWN ASSOCIATION, INC.,
A FLORIDA CORPORATION NOT -FOR -PROFIT; PROVIDING
FOR THE DECLARATION OF A PUBLIC PURPOSE; PRO-
VIDING FOR SEVERABILITY AND EFFECTIVE DATE HEREOF.
WHEREAS, the Old Tavernier Town Association, Inc. has as its
purpose the furthering of understanding and the dissemination of
information relative to the area in and about the town of Tavernier,
unincorporated, and the lower part of Key Largo, and
WHEREAS, the County Commission has been advised of said purpose
and has examined the charter of said non-profit corporation and has
concluded that the use of funds to be appropriated to the Old Tavernier
Town Association, Inc. is indeed to be used for a public purpose under
Florida Statutes annotated 125 and the provisions of Chapter 2,
Section 9 of the Code of Ordinances of Monroe County, Florida, now,
therefore,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, that:
1. The sum of $4,200.00, non -reoccurring, shall be appropriated
and expended from the current fiscal year budget of this County for
this purpose, the same to be paid over to the Old Tavernier Town
Association, Inc. in accordance with the contractual agreement attached
hereto and made part hereof and numbered as Exhibit "A".
2. The charter and amendments to the charter of Old Tavernier
Town Association, Inc., a list of its directors, officers and the
offices that they hold for this current year shall be afforded to
the County as a condition to the monies heretofore referred
to as being set aside for said public purpose.
3. In all respects, the monies herein appropriated shall be
utilized in accordance with Chapter 125 of the Florida Statutes,
and Section 2.9 of the Monroe County Code of Ordinances.

4. This Ordinance shall take effect immediately upon receipt
of official notice from the Office of the Secretary of State of the
State of Florida that this Ordinance has been filed with said Office.
5. That if any clause, paragraph or a portion hereof is
declared unconstitutional, it shall have no effect on the remaining
part of said ordinance.
6. That any ordinance or part of ordinances in conflict
herewith are hereby repealed and declared null and void.

CONTRACT AGREEMENT
THIS CONTRACT AGREEMENT, entered into this day
of , 1983, between BOARD OF COUNTY COMMIS-
SIONERS OF MONROE COUNTY, hereinafter referred to as "Commis-
sioners" and OLD TAVERNIER TOWN ASSOCIATION, INC., a Florida
Not-For-Proft Corporation, hereinafter referred to as Associa-
tion; and pursuant to Monroe County Code of Ordinances, Section
2--9, and by resolution of COMMISSIONERS;
WITNESSETH THAT, said Association is a Florida non-
profit corporation existing under the laws of the State of
Florida under Charter Number 759392. Charter and amendments
to Charter of Association, certification of United States
Internal Revenue Service tax exempt status as a publicly supported
organization and list of Directors, officers and their respective
offices for the current year are hereto attached and incorpora-
ted by reference.
WITNESSETH THAT, said Association and Commissioners
are bound by Monroe County Code of Ordinances Chapter 2, Section
91 "Contracts with non -governmental organizations for performance
of valid county purposes" copy of which is attached hereto and
incorporated by reference.
TO HAVE AND TO HOLD THE SAME for the full term of one
year from the date hereof until
1984, the
following express stipulations and conditions are made a part
of this Contract Agreement and are hereby assented to by the
Commissioners and Association, to -wit:
FIRST: Commissioners agree to make lump sum advance
payment, per Chapter 2, Section 9(b)(1) in the amount of THREE
THOUSAND AND N0/100 DOLLARS ($3,000.00) to Association for the
completion of renovation of the building known as the Old Taver-
nier Town Association, Inc., located in Tavernier, Monroe County,
Florida, at Mile Marker 91.5 on U. S. Highway #1, subdivision
TAVERNIER #2, Block E, Lots 4, 5, 6 as recorded in Plat Book 2,
Page 8 of the public records of Monroe County, Florida; Personal
Representatives Deed dated October 25, 1982 and filed November
19, 1982 in Official Records Book 867 at Pages 93-94 of the -
Public Records of Monroe County gives proper deed to the Associa-
tion.
SECOND: Commissioners agree to make lump sum payment
in the amount of ONE THOUSAND TWO HUNDRED AND N0/100 DOLLARS
($1,200.00) to Association for the preparation and publication
by Association, of three brochures, tentatively designated as
a) "On the Road to Key West - Things to See and Do"'
b) "The Great Hurricane of 1935" and
c) "Historic Tavernier - Tours: Driving, Bicycling,
Walking".
Said brochures are to be prepared by and under the direction of
the Association in folded 8 1/2 x 11 inch format and printed in
a quantity lot of five thousand (5,000) each, for utilization in
the Tavernier Community Center and Tourist Information Center,
and for distribution through the various Chambers of Commerce in
Monroe County and County Governmental agencies, as requested by
the agencies.
THIRD: Association shall make the Tavernier Community
Center available to any and all non-profit organizations in the
Tavernier and Upper Keys area., on a no charge basis, for their
meetings and events on a scheduled controled basis.
FOURTH: Association shall provide meeting facilities
in the Tavernier Community Center for scheduled Monroe County
Governmental activities to include but not be limited to public
meetings, area meetings, committee meetings, receptions, meetings
by Commissioners and various other activities of a like nature.
FIFTH: Association shall provide access to Association's
collection of historic information, photographs, geneology and
all other accumulated data concerning the Tavernier area, to
visitors and residents of Monroe County, Florida.
SIXTH: Association shall provide a focal point for

community and visitor information and activity through programs
in the public interest on a monthly basis.
SEVENTH: Association shall undertake and complete
within a reasonable length of time any and all survey data work
for the certification at Florida State level of a Tavernier
Historic District.
EIGHTH: Association shall file with -the Commissioners a
report of its annual activities, designating those activities
of the organization to which County funds were applied.
NINTH: Association shall file a copy of the Associa-
tions's annual aduit report, submitted by a certified public
accountant licensed to do business in the State, with the
Commissioners.
TENTH: Reports mentioned in EIGHTH and NINTH above
shall be file with the Commissioners and Monroe County by Associa-
tion within thirty (30) days of receipt by Association, of its
annual report.
ELEVENTH: Association shall comply with Chapter 2-,.
Section 9(d) of the Monroe County Code of Ordinances for each
audit year concurrent in whole or in part with the term of this
Contract Agreement.
