1A ;RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, EXPRESSING THE BOARD'S CONCERN
OF THE PRACTICE OF DISCRIMINATION BY THE STATE OF
FLORIDA WITH RESPECT TO THE DISPARITY IN DISTRIBUTION
OF STATE EDUCATION FUNDS AND OF THE LACK OF MONIES IN
LIEU OF TAXES ON THE VAST HOLDING BY THE STATE ON
REFUGES, RECREATION AREAS, PARKS AND OTHER STATE
FACILITIES, AND THE PRACTICE OF DISCRIMINATION BY THE
UNITED STATES OF AMERICA IN LACK OF FUNDS IN LIEU OF
TAXES ON ITS LARGE LAND HOLDINGS IN MONROE COUNTY ;
AUTHORIZING THE COUNTY TO JOIN WITH THE CITY OF KEY
WEST IN LITIGATION IN FEDERAL COURT IN AN EFFORT TO
RECTIFY THIS UNFAIRNESS, INJUSTICE AND DISCRIMINATION;
AND TO INVITE THE BOARD OF PUBLIC INSTRUCTION AND ALL
OTHER TAXING BODIES OF MONROE COUNTY TO ALSO JOIN IN A
FEDERAL LAWSUIT.
WHEREAS, Article IX of the Florida Constitution requires the
state to provide a uniform system of free public schools; and
WHEREAS, the Florida Educational Finance Program provides
less than ten percent of the local budget as compared to as much
as ninety four percent (94%) of other counties of the state thus
imposing a severe hardship on the property owners and renters of
Monroe County, and the State appropriates no monies in lieu of
taxes for its vast holdings in the Florida Keys; and
WHEREAS, the Government of the United States of America
appropriates Six Hundred and Thirty Million ($630,000,000) in
lieu of taxes for ownership of forty one percent (41%) of
property in the District of Columbia as opposed to Two Hundred
and Sixty Three Thousand ($263,000) for property within Monroe
County, which is ninety five point twenty seven percent (95.27%)
tax exempt; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA,
Section l.
That the County of Monroe join with the City
of Key West and invite the Board of Public Instruction and all
other Monroe County taxing bodies to enter into a Federal lawsuit
to alleviate the heavy burden of discrimination which will, in
turn, lift a heavy financial burden off all Monroe County
taxpayers and renters.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a special meeting of said Board held
on the 27th day of
August
1992.
