Ordinance 021-1983ORDINANCE NO. 021 -1983 AN ORDINANCE OF THE COUNTY OF MONROE, FLORIDA, PROVIDING THAT THE CODE OF ORDINANCES OF MONROE COUNTY, FLORIDA, BE AMENDED BY REVISING CHAPTER 6, BUILDINGS AND CONSTRUCTION, OF SAID CODE; REFLECTING CHANGES IN THE LATEST SUPPLEMENT TO THE NATIONAL ELECTRICAL CODE; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE OF ORDINANCES OF MONROE COUNTY, FLORIDA; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. That Section 6-110 of Chapter 6, Buildings and Construction, of the Code of Ordinances of Monroe County, Florida, be amended so that such Section shall read as follows: "Sec. 6-110. Wall switches for lights required in certain instances. All lights installed or used within six (6) feet of basins, sinks, toilets or bath tubs, or in any room which has a floor which is permanently damp, or which are installed or used in any location where a person operating the same might come in contact with any grounded objects, such as gas or water pipes or other grounded metal work, shall be controlled by a wall switch. A convenience outlet shall be installed in all residential bathrooms and is to be connected to a ground fault system." Section 2. That Section 6-125 of Chapter 6, Buildings and Construction, of the Code of Ordinances of Monroe County, Florida, be amended so that such Section shall read as follows: "Sec. 6-125. Application for permit. Before any electrical wiring or electrical apparatus or equipment for light, heat or power shall be installed, within or attached to any building or structure, either public or private within the limits of the County, a written application for a permit to do so must be made to the County BUILDING OFFICIAL. The application shall be accompanied by a complete set of plans and specifications completely describing all proposed electrical work. Plans must show size of main service in amperes, wire size and type, conduit size, all sub -feeds in amperes, type and size wire and size of conduit, type panels, disconnects. The location of services and their disconnects, location of distribution centers with a panel schedule of all circuits, list all special purpose outlets and fixed appliance circuits as may be necessary in the opinion of the County BUILDING OFFICIAL to determine whether the installation as described will be in conformity with the require- ments of this regulation. If it shall be found by the County BUILDING OFFICIAL that the installation as described will conform with the requirements of this regulation, and if the applicant has complied with all the provisions of this regulation, a permit for such installation shall be issued by the said County BUILDING OFFICIAL. The permit when issued shall be for such installation as is described in the application. An application for the service location, approved by the Power Company must be submitted when making application for permit." Section 3. That Section 6-134 of Chapter 6, Buildings and Construction, of the Code of Ordinances of Monroe County, Florida, be amended so that such Section shall read as follows: "Sec. 6-134. Rough -in inspection procedure. For an electrical rough -in inspection, all plumbing, framing and duct work must be inspected and passed. No concealed work to be covered with any materials before all inspections are passed. "only the electrical contractor or his authorized foreman can call for inspections." In the case of home owner doing his own wiring, only he can call for inspections. For rough - in inspection, all tubing or romex must be complete wiring system with all wires pulled, joints made and taped or scotch locks, mud rings on, pipe strapped where necessary. There must be a minimum of six (6) inches of free wire for all boxes that there will be devices in, all ground wires to be made up and connected in metal boxes per NEC 250-114(a). Work that does not pass inspection the first time, there is a $30.00 re - inspection fee, which is to be paid at the office of the Building Inspection Department. When the fee is paid and violations corrected, call for re -inspection." Section 4. That Section 6-136 of Chapter 6, Buildings and Construction, of the Code of Ordinances of Monroe County, Florida, be amended so that such Section shall read as follows: "Sec. 6-136. Issuance of certificate. When electrical wiring, apparatus or fixtures covered by a permit shall be found on inspection by the County BUILDING OFFICIAL to conform to the rules and regulations provided by this regulation, the County BUILDING OFFICIAL shall issue a final Certificate of Inspection certifying that the wiring, apparatus or fixtures have been inspected and found to comply with the terms of this regulation, but no such Certificate shall be issued until such equipment is made to conform to such rules and regulations. Section 5. That Section 6-150 of Chapter 6, Buildings and Construction, of the Code of Ordinances of Monroe County, Florida, be amended so that such Section shall read as follows: "Section 6-150. Main service disconnects. A single service fused disconnect or circuit breaker of a minimum of one hundred (100) AMP capacity shall be required in residential buildings of six hundred (600) square feet or more, located in a readily accessible place as near the point of entrance as may be possible, considering the character of the building and accessi- bility in case of fires or other reasons for opening the service disconnecting the premises from feeder mains, unless outside of building per NEC Section 230- 44, then the main breaker in the distribution panel may serve as the main disconnect. Service fused disconnect or circuit breaker protection at the meter location in a single family or duplex residences will not be required if all of the following conditions are met: (a) The distance from the meter to the main service protection disconnect is 20'-0 or under. (b) The area where the service raceway is run is open under the building. If the area is enclosed, then a service fused disconnect or circuit breaker will be required or the raceway encased in minimum two (2) inches concrete. The height of the main switch or breaker shall not be higher than seven (7) feet or less than four (4) feet from the ground or floor. Where more than one (1) main switch, they must be grouped in same location and readily accessible, plainly marked "Main #1, Main #2, etc...." The minimum service for buildings under 600 square feet when indicated load does not exceed 5,000 watts based on 200 watts per 115 volt current consuming outlets, plus maximum wattage for special purpose outlets, plus actual main pull wattage for direct connected loads, shall be 70 AMP and the service conductors shall not be less than three (3) #4 wires. The height of the main switch or breaker shall not be higher than seven (7) feet or less than four (4) feet from the ground or floor. When a main service entrance serves more than six (6) meters, a main service disconnect shall precede the meters. All service equipment to be above 100 year flood stage, or as approved by the local utility company. No split - buss or parallel panels to be used (except in some commercial work with permission of inspection department)." Section 6. That Subsection (b) of Section 6-151 of Chapter 6, Buildings and Construction, of the Code of Ordinances of Monroe County, Florida, be amended so that such Section shall read as follows: "(b) Service panels, meters and equipment shall not be located in closets, bathrooms, under stairs, behind doors, or in any location which shall cause it to be not readily accessible or create a hazzard to life or property." Section.7. That Subsection (c) of Section 6-151 of Chapter 6, Buildings and Construction, of the Code of Ordinances of Monroe County, Florida, be amended so that such Section shall read as follows: "(c) All buildings with more than six (6) meters, and two (2) or more stories in height must have a meter room, at least four (4) feet wide and seven (7) feet high, the length determined by the length of assembled equipment plus 30% for future use. Meter room to be of CBS construction and concrete roof, or to specifications of power company." Section 8. That Section 6-154 of Chapter 6, Buildings and Construction, of the Code of Ordinances of Monroe County, Florida, be amended so that such Section shall read as follows: "Sec. 6-154. Wiring methods. (a) Approved rigid conduits, intermediate metal conduit IMC, steel tube EMT, rigid non-metalic conduit PVC, surface metal raceways, underfloor raceways, cast -in -place raceways, wireways, and busways shall be required for all wires used to conduct current for light, heat or power, in the wiring of all new buildings and additions thereto WITHIN the limits of Monroe County. (b) PVC Schedule 40 with bond wire may be used in concrete slabs and underground in accordance with Article 300-5-197, National Electric Code. (c) A six (6) foot section of greenfield may be used where necessary. (d) Two (2) locknuts, one inside and one outside of boxes and cabinets shall be required on all conduit jobs. Approved bushings shall be used on any conduits entering or leaving a panel or cabinet if the conduits contain #8 wires or larger, where concentric knockouts are used and do not utilize the largest knockout, a grounding bushing bonded to the box is required on metal conduit. (e) Romex in single family or duplex residences only. Romex #12 minimum with ground -copper may be used in all wood frame construction only, including the wood floor. Romex run in all wood frame construction with concrete floor is to be minimum twelve (12) inches above concrete. When runs are parallel with joist they must be strapped along side of joist. When crossing joist, the runs shall be on a running board or bored holes, 1/3 the distance from a bearing wall or may lay on top of joist if less than one (1) foot between joist and rafter. In stud walls, holes shall be bored in center of studs, and must have at least thirty (3) inches clearance from bottom of joist to ground if run under wood floors on running boards. There are not to be any junction boxes in attic or any other location unless absolutely necessary. If used, junction boxes are to be readily accessible. Minimum size of metalic romex boxes: 3" X 2" X 22" only allows 1-12-2 cable. Maximum size: 3" X 2" X 32", maximum 6 wires in box (#12) over 6 wires use 4" square box or with extension box. See National Electric Code, Article 370-6. Leave 4 inch of the sheath on romex showing inside of the box. Allow two (2) spare circuits in panel for future use. All joints are to be made up and plaster rings on before calling for inspection. Romex sheath must be skinned about six (6) inches before clamping in box, not after, and ground wires made up and bolted to box." Section 9. That Subsection (c) of Section 6-157 of Chapter 6, Buildings and Construction, of the Code of Ordinances of Monroe County, Florida, be amended so that such Section shall read as follows: "(c) The service grounding conductor shall be run from the meter or main switch enclosure to ground, an approved driven grounding copper rod using an approved, exposed; accessible, ground fitting making an electrical connection with the grounding conductor. Also, from the same ground rod a #6 must be bonded to copper water system in the building. See Article 250-80 of latest edition of National Electrical Code." Section 10. That Subsection (d) of Section 6-157 of Chapter 6, Buildings and Construction, of the Code of Ordinances of Monroe County, Florida, be amended so that such Section shall read as follows: "(d) Service and grounding conduits shall be securely fastened to the building using approved straps. Wood plugs used in brick or concrete will not be approved." Section 11. That Chapter 6, Buildings and Construction, of the Code of Ordinances of Monroe County, Florida, be amended by adding a Section to be numbered Section 6-157(j), to read as follows: "(j) On buildings where a riser does not extend three (3) feet above roof and eye bolt must be installed within three (3) feet of service head that will hold the strain of the power company's drop from their pole to building and must be approved by the Power Company." Section 12. That Chapter 6, Buildings and Construction, of the Code of Ordinances of Monroe County, Florida, be amended by adding a Section to be numbered Section 6-157(k), to read as follows: "(k) Services, disconnect, panel, metering equipment, etc.... shall not be mounted on break- away walls (branch circuit general purpose outlets only) . " Section 13. That Subsection (c) of Section 6-159 of Chapter 6, Buildings and Construction, of the Code of Ordinances of Monroe County, Florida, be amended so that such Section shall read as follows: "(c) Permanently installed motors above i horse power and up to and including five (5) horse power will be connected to a 230 volt, single phase service or three (3) phase service." Section 14. That Section 6-160 of Chapter 6, Buildings and Construction, of the Code of Ordinances of Monroe County, Florida, be amended so that such Section shall read as follows: "Sec. 6-160. Metal conduit and fittings. All metal conduit and fittings, unless of corrosion resisting metal, shall be galvanized, sheradized or shall have an equivalent coating of corrosion resisting metal. No aluminum conduit, Article 345 - National Electric Code, intermediate metal conduit "IMC" NOT to be used for service mast." Section 15. That Section 6-161 of Chapter 6, Buildings and Construction, of the Code of Ordinances of Monroe County, Florida, be amended so that such Section shall read as follows: "Sec. 6-161. Electric range and water heater wiring. (a) All electrical water heaters or other heating appliances up to and including 1,650 watts may be connected 120 volts, over 1,650 watts to be connected 230 volts. (b) All electric ranges shall be connected 115- 230 volts, three (3) wire and grounded." Section 16. That Section 6-165 of Chapter 6, Buildings and Construction, of the Code of Ordinances of Monroe County, Florida, be amended so that such Section shall read as follows: "Sec. 6-165. Miscellaneous specifications. (a) In the case of individual oven and surface units (built-in ranges) will be permissible to install a minimum of three (3) #8 conductors to each of the units, provided that each run is separately circuited with proper overcurrent protection for the size of conductors and equipment used. (b) All wiring in conduit shall be open for roughing inspection before switches, panel fronts, receptacles or covers are installed. (c) All wiring in beauty parlors shall be installed in rigid conduit or EMT, and all equipment used therein shall be connected to the system with three (3) wire cords, plugs and receptacles, grounding the frames of all such equipment. (d) A separate sign circuit shall be installed in all store or public buildings (new or remodeled). This sign circuit must be installed in a separate conduit from panel. (e) Sign transformers shall not be placed in attic spaces. Drain holes shall be provided in metal transformer boxes, and when exposed to the weather the boxes shall be reamed or otherwise trimmed to remove burrs or rims that would hold water in the enclosure. If mounted on the roof, the transformer enclosure shall be elevated at least two (2) inches above the roof. Wood shall not be used to mount or elevate the transformer enclosure. The transformer shall be rigidly fastened to the metal enclosure. (f) Maximum number of outlets per circuit on commercial or residential buildings. Residences - 10 points to circuits, lights - 1 point, duplex receptacles - 2 points, except kitchen and dining room - only 2 receptacles to circuit. Commercial - 6 points to circuit, except special circuits. (g) All kitchen receptacles for general use - only 2 per circuit and 2 circuits are required. Fixed appliances such as refrigerator, dishwasher, disposal, trashmasher, freezer, etc .... shall be on separate circuits. (h) Light outlets in clothes closets must be eighteen (18) inches from shelving or stored combustible material. Receptacles no higher than one (1) foot from the floor will be permitted in clothes closets for the use of approved mildew lights or heaters. (i) Branch circuits in all installations feeding all outlets and switches shall not be smaller than #12 copper wires. (j) For every eighty (80) feet of a continuous run of wire, the conductor size must be increased one size. (k) Troughs or auxiliary gutters shall be so installed that main service and branch circuit wiring will not enter the same trough. Where branch circuit wiring shall pass through the main service trough, the branch circuit CONDUIT shall pass through the trough preventing any contact between the branch circuit and the main service conductors. (1) Portable cords attached to music boxes, pinball machines, soft drink dispensers and other similar equipment, shall not exceed six (6) feet in length when measured from the equipment to the outlet supplying the current. Cords shall not be nailed down, tacked, stapled or held with strings or other supports but shall be left free and clear. (m) Plaster rings shall be placed on all four (4) inch or larger boxes in concealed installations. (n) Requirements in multiple dwellings: On new buildings AND REWIRED BUILDINGS, no branch circuits shall be connected to serve more than one (1) apartment. Distribution panels shall be located in the apartment they serve or in a public space. IN RESIDENCES, PANELS SHALL NOT BE LOCATED IN CLOTHES CLOSETS, BEDROOMS, UNDER STAIRS, KITCHEN CABINETS, BEHIND DOORS or ANY PLACE THAT IS NOT READILY ACCESSIBLE. (o) Attic fans shall be on a separate circuit run direct from panel to the fan switch. (p) (Handy) 2 X 4 X 12" boxes only three (3) conductors plus device will be allowed. (q) Each window type air-conditioning unit shall be connected to a separate circuit using wires not smaller than # 12 copper wire and SHALL BE GROUNDED. (r) Stairway lighting is required and shall be controlled by three (3) or four (4) way switches located at top and bottom of stairways; except in multiple dwellings or apartments or other public buildings where the stair lighting is controlled on special hall, corridor or house circuits. (s) In new construction or remodeling where ceiling fans are to be installed, a 4" X 4" or equal is to be installed to support the fan. (t) In the wiring of new buildings, two (2) spare circuits shall be provided. (u) Circuit identification: The contractor shall identify all branch circuits at the panel showing the outlets so served BEFORE CALLING FOR FINAL INSPECTION. (v) Every electrical contractor shall stencil or provide a decal with the contractor's name and address and phone number on the main switch or panel. (w) Sub -feeder conductors to sub -panels shall be protected at the original point of the sub -feed for the maximum current carrying capacity of the sub -feed conductors. The sub -feed conductors shall be sized to meet the current consuming capacity of the connected load. (x) Design of customer owned vaults must be approved by local power company prior to construction and specification will be furnished by the power company in advance. (y) Separately metered conductors shall not be installed in the same raceway except in gutters in meter room. The line and load shall not be in the same raceway. (z) In multiple units the feeders shall be considered the same as services. (aa) A request for inspection of electrical work, such as rough -in, equipment installation, final inspection, etc...shall be made at the office of the Electrical Inspector as soon as the job is ready. (bb) The request for inspection must be made by the person, firm or corporation installing the wiring. Failure to request such inspections constitutes a violation of this code, and could cause your license to be suspended after a hearing of the CONTRACTOR'S LICENSING BOARD. (cc) PVC raceways shall not be used on services extended up poles or side of buildings and all PVC must have bond wires of proper size installed with conductors. All PVC must be schedule 40 or better. (dd) No PVC to be used exposed outdoors above ground unless approved for the purpose, or encased in minimum two (2) inches of concrete. (ee) PVC may be used in wet locations indoors, if not subject to physical damage. (ff) All service grounds must be enclosed in rigid metal conduit with thread hub type ground fitting with minimum #6 copper wire. (gg) NO WATER PIPE OR FITTING SHALL BE SUBSTITUTED FOR ELECTRICAL CONDUIT AND FITTING. (hh) Sub -feeds to mobile homes must be in conduit with wire capacity of the main panel inside of trailer. (ii) All backing boards for Electrical equipment must be exterior plywood and painted on both sides. Qj) No junction boxes in attic or concealed places unless there is at least thirty (30) inches of crawl space and not over twenty (20) feet from access hnle_ (kk) No direct burial cable for any purpose! Underground primaries over 250 volts across phases in PVC Schedule 40 must be at least thirty (30) inches deep with a minimum of six (6) inches concrete on all sides or as National Electric Code requirements. (11) All sub -feeds in apartments, stores, etc... to be a minimum of 14 inches raceway from meter room to panels. (mm) All underground services 225 AMP or under, from pole to building must have fuse or breaker protection at the pole. All conduits must be offset to hug poles or sides of surface they run on. (nn) No romex in buildings with metal floors or walls. See requirements on romex. (oo) When using existing meter base for a new sub -feed, a disconnect must be added along side of proper size and service wire from meter to service head increased if necessary. (pp) All conductors must be copper (no copper clad aluminum or aluminum). Minimum #12, no aluminum conduit underground - slabs or eighteen (18) inches of ground. (qq) There must be a licensed Monroe County Master Electrician in charge of and supervise any job where any electrical work is being installed, except a home owner doing his own work. (rr) There must be a licensed Monroe County Journeyman Electrician on the job at all times any electrical work is being done. The journeyman must be employed by a Master Electrician - Contractor. An apprentice must have a Master or Journeyman present at all times he is working. (ss) Home owners cannot engage a journeyman or apprentice without an electrical contractor. (tt) All electrical conduits in poured concrete must be PVC Schedule 40 and tied down to keep from floating when poured. (uu) Conduit, PVC or any raceway that runs on the surface must hug the surface and be strapped per latest edition of National Electric Code. Stand offs may be used when needed. When leaving the ground level up a pole or the side of a building, there must be at least one strap no more than two (2) feet from ground level. (vv) Voltage to under -water pool lights shall not be more than twenty-four (24) volts. (ww) Lighting wires or rods with 6'-0" of grounding rods are to be bonded to the grounding rod per National Electrical Code. 250-46." Section 17. That Chapter 6, Buildings and Construction, of the Code of Ordinances of Monroe County, Florida, be amended by adding a Section to be numbered Section 6-166, to read as follows: "Sec. 6-166. Penalty for Violation. Any person violating or permitting to be violated any of the provisions of this regulation shall upon conviction before the County Court, be punished by a fine of not more than FIVE HUNDRED ($500.00) DOLLARS, or by imprisonment in the County Jail not exceeding SIXTY (60) DAYS, or both such fine and imprisonment." Section 18. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 19. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 20. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appro- priately renumbered to conform to the uniform numbering system of the Code. Section 21. This Ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said Office.
