ORDINANCE NO. 026 -1983
AN ORDINANCE AMENDING MONROE COUNTY ORDINANCE
NO. 017-1983 BY AMENDING SUBSECTION 1 OF
SECTION 1 OF SAID ORDINANCE; DECLARING SAID
ORDINANCE AN EMERGENCY; REPEALING ALL ORDI-
NANCES OR PARTS OF ORDINANCES IN CONFLICT
WITH THIS ORDINANCE; PROVIDING FOR SEVER-
ABILITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, it is the desire of the Mayor and County Commission
of Monroe County, Florida, to amend Ordinance No. 017-1983 to
provide for a reduced annual special assessment for the
availability of waste collection, transfer and disposal, and
WHEREAS, the requirements of the bonding of the Municipal
Service District can be met by a reduction thereof, and
WHEREAS, an emergency has arisen because of the fact that
billing for this particular service is imperative immediately so
as to secure the funds necessary and needed to meet the bond
obligations for the Municipal Service District, now, therefore,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1.
That Section 1, subsection 1, entitled Annual
Special Assessment for the availability of waste collection,
transfer and disposal service shall be amended to read as fol-
lows:
"I. Annual Special Assessment for the avail-
ability of waste collection, transfer and disposal
service.
Twenty-eight Dollars ($28.00) per annum for
parcels of land of one acre or less.
For parcels of land that are in excess of one acre
the charge for the special assessment created herein
shall be in the sum of Twenty-eight Dollars ($28.00)
for each acre or major fraction thereof."
Section 2.
In all other regards and respects the contents
of Ordinance No. 017-1983 are hereby affirmed and will continue
in force and effect as written.
Section 3.
All ordinances or parts of ordinances in
conflict with this ordinance are hereby repealed.
Section 4.
If any section, subsection, sentence, clause or
provision of this ordinance is held invalid, the remainder of
this ordinance shall not be affected by such invalidity.
Section 5.
This ordinance shall take effect when a cer-
tified copy of this ordinance has been accepted by the postal
authorities of the Government of the United States for special
delivery by registered mail to the Secretary of State of the
State of Florida,
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 10th day of November, A.D. 1983.
