'", \' Mayor Harvey "92 OCT -1 A 9 :25 RESOLUTION NO. 440 -1992 C.,N~ C l_ "A H .RESOLUTION OF THE BOARD OF COUNTY ~tONROF CObWI[S$I0NERS OF MONROE COUNTY, FLORIDA, REQUESTING THAT THE LEGISLATURE OF THE STATE OF FLORIDA MAKE THE UNFUNDED MANDATE LEGISLATION SPECIFICALLY APPLICABLE TO EXPENDITURES INCURRED BY LOCAL GOVERNMENTS WHICH ARE ATTRIBUTABLE TO STATE GROWTH MANAGEMENT MANDATES. WHEREAS, the State of Florida's growth management legislation, particularly Sees. 163.3161, et seq., Fla. Stat., known as the Local Government Comprehensive Planning and Development Regulation Act, and Sees. 380.05, et seq., Fla. Stat., the area of critical state concern sections of the Florida Environmental Land and Water Management Act of 1972, have created a large appetite for local tax dollars for capital projects that range from roads to the purchase of preservation lands; and WHEREAS, the County Commission has no choice except to tax and spend revenue on those expensive proj ects because, without such expenditures, the State legis lation would cause a development moratorium in most of Monroe County with a consequent disaster for the local economy; and WHEREAS, the point has been reached in Monroe County where many taxpayers can no longer bear the financial grind of the taxes directly caused by the State mandated growth management legislation and other State social, welfare, transportation and regulatory actions; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: The Legislature of the State of Florida is hereby requested to tie the effectiveness of its growth limitation mandates, especially Chaps. 163 and 380, Fla. Stat., to the provision by the State of adequate funds for the capital projects made necessary by such legislation.
