A RESOLUTION REVERSING THE DECISION OF ~Mfi' . ii;!
MONROE COUNTY PLANNING COMMISSION
MEMORIALIZED IN PLANNING COMMISSION RESOLU-
TION NO. P22-92 WHICH DENIED THE DISTRICT
SCHOOL BOARD OF MONROE COUNTY A MINOR CONDI-
TIONAL USE PERMIT FOR AN ELEMENTARY SCHOOL ON
BIG PINE KEY.
WHEREAS, in Planning Commission Resolution No. P22-91, the
Planning Commission affirmed the decision of March 12, 1992, by
Planning Director Lorenzo Aghemo in development order 106-92
that denied the District School Board of Monroe County a minor
conditional use for an elementary school at the following 10-
cation:
[A] portion of Linda Loma subdivision, sec.
26, township 66 south, range 29 east,
Tallahassee meridian, Big Pine Key, Monroe
County, Florida, Real Estate numbers 111530,
111690 - 000600 & 111690 - 000800.
WHEREAS, the District School Board of Monroe County, pursu-
ant to Sec. 9.5-521, Monroe County Code, timely perfected an
appeal to this Board.
WHEREAS, the appeal having come before this Board on
September 4, 1992, and this Board having reviewed the record
below and heard the arguments of counsel for the School Board and
the Planning Commission; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA,
Section 1.
Based on the supervening principles of
comity, this Board will respect the decision of the District
School Board acting within the scope of its authority under
Article 9, Section 4, of the Florida Constitution, pursuant to
Section 235.193, Florida Statutes. Accordingly, the appeal of
the District School Board of Monroe County is granted and the
decision of the Planning Commission is reversed.
Section 2.
The Clerk is directed to send a certified
copy of this resolution to the State of Florida Department of
Community Affairs at the Department's Key West field office and
to the District School Board of Monroe County.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the
