Ordinance 023-1977 w • •VL„ .._ -- 3 ORDINANCE NO. 234977 AN ORDINANCE AMENDING ORDINANCE NO. 15-1975, THE SAME BEING AN ORDINANCE ENTITLED "AN ORDINANCE PERTAINING TO MONROE COUNTY, FLORIDA, ADOPTING THE NATIONAL ELECTRICAL CODE 1975 EDITION, ETC. , " BY AMENDING SECTION 3 THEREOF TO ADOPT A NEW SUPPLEMENT TO THE NATIONAL ELECTRICAL CODE 1975 EDITION AND TO REPEAL THE SUPPLEMENT ADOPTED IN 1975, SAID NEW SUPPLEMENT RELATING TO APPLICATION FOR PERMIT PRIOR TO ELECTRICAL WIRING, REQUIRING PERMITS, INSPECTION FEES, INSPECTIONS; PRESCRIBING STANDARDS FOR PERSONS ENGAGED IN ELECTRICAL WORK, PROVIDING PENALTIES FOR VIOLATIONS, PRESCRIBING MINIMUM ELEVATIONS FOR ELECTRICAL RECEPTACLES, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA as follows: Section 1. That Section 3 of Monroe County Ordinance No. 15-1975 be and the same is hereby amended to repeal the Supplement to the 1975 Edition of the National Electrical Code adopted by said ordinance and to place in its stead and hereby adopt the Supplement attached hereto and made a part of this Ordinance entitled'1977 Monroe County Electrical Code Supplement." Section 2. Violations of this Ordinance shall be prosecuted in a County Court by the prosecuting attorney thereof, and upon conviction shall be punished by a fine not less than $15. 00 nor to exceed $500. 00 or by imprisonment in the county jail not to exceed 60 days or by both such fine and imprisonment. Section 3. This Ordinance shall not apply to any municipality located in Monroe County, Florida, Section 4. All Special Laws, Ordinances, Resolutions, rules and regulations in conflict herewith are hereby repealed to the extent of said conflict. Section 5. This Ordinance shall take effect upon receipt of the official acknowledgment from the Department of State acknowledging receipt of certified copy of this Ordinance and that said Ordinance has been filed in said office by the Department of Administration, Division of State Planning pursuant to the requirements of Florida Statutes Section 380. 05 and Florida Statutes Chapter 120. APPLICATION FOR PERMIT: Before any electrical wirinr, or electrical apparatus or equipment for light, heat or pOller shall be installed, within or attached to any building or structure either public or private within the limits of the County a written application for a permit to do so must be made to the County BUILDING OFFICIAL. The application shall be accompanied by a co~plete set of plans, specifications, "and schedule, as may be necessary in the opinion of the County BUILDING OFFICIAL to determine whether the installation as described will be in con=ormity with the requirements of this regulation. Plans shall be mechanically reproduced prints. Isometric or riser diagram need not be to scale. The plans shall show the size of service and feeder wires and conduit, the location of service switches a..dcenters of distribution. The arrangement of circuits snol~ing numbers of outlets and special purpose outlets and load schedule for each panel shall also be shown. If it shall be found by the C6unty BUILDING OFFICIAL that the installation as desciibed will ingen.rkl' corif~rm with ~he.requirment~ of this regulation and if ihe applicant has compl1ed with all the provisions of thisCregulation, a permit for such installation shall be issued by said County BUILDING OFFICIAL. The permit when issued shall be for such installation as is described in the application. 2. PERMITS: A permit will be required to do any electrical construction of any character, install any electrical wiring) apparatus or equipment) or make any extensions or changes to existing system or wiring for light, heat or power, within the limits of the County, excepting work done by employees of Public Utility Companies, for said companies, and further excepting the repairing of damaged apparatus or equipment a^d the ordinary work necessary for the proper maintenance of same. No permit will be required on service calls involving normal maintenance. 3. INSPECTION ,FEES: Before any permit is issued for the ibstallation Or alteration of electrical wiring, device or equipment, the person making application for such permit shall pay to the County a fee in such amount as specified in "Requirements and Schedule of Fees for Building Permits _ Nonroe County Building and Zoning Department". 4. INSPECTIONS: Any Electrical Contractor who "FREQUENTLY FORGETS" to call for inspections or to take out permits for the "SMALL" jobs shall be brought before the Licensing Board. If work is concealed before ,inspection has been made and approved, - 2- ... .~ it I depending on circumstances, the Electrical Contractor will be required to secure and present to the Electrical Inspector a notarized letter from the Owner and General Contractor stating they will accept the job without a rough-in electrical inspection before proceeding with other work. It will also be noted on the Certificate of Occupancy that no inspection was made. If the Electrical Contractor is unable to secure letter, the laih, plastering, paneling, etc....covering the electrical work shill be removed and inspection made before continuing with job. On any job requiring a permit) if the permit is not taken o~t the fee will be doubled. Repeated violatioris of this or other sections of this Code shall result in the Contractor being brought before the Licensing Board to show cause why his License should not be suspended or revoked. 5. SERVICE GROUNDING: The service grounding conductor shall be run ~rom the meter or main switch enclosure to an approved driven grounding electrode using an approved, exposed, accessible, ground fittine making an electrical connection with the GROUNDING conductor. From the same ground rod a number six (6) conductor must be bonded to any metal water system in the building. See article 250-80 footnote of 1975 National Electric Code. 6. OWNER - BUILDING: Anyone, other than t~e owner, installing wiring in an owner-builder permitted house shall be required to have a Monroe County Certificate of Competency. An owner - building is required to follow the National Electrical Code and the Monroe County Electrical Code, which in some instances supercedes the National Electrical Code, and to do the same quality of work that the Electrical Contractor is required to do. If defects, omissions, or violations exist on any part of the wiring system, approval will be withheld until corrections have been made to comply to Code. Where home owners are attempting to wire their own homes and three (3) inspections have been turned down for violations or sloppy \lork,' the Electrical Inspector may put a Stop Ivork Order on the electrical portion of the job and require a Honroe County Licensed Contractor to complete the job. 7. LICENSED .REQUIREMENTS: Except in the case of an owner doing his Olin work, there~must be a licensed nonroe County Journeyman Electrician on the job at all times any electrical work is being done. The Journeyman must be employed by a tIaster Electrician - Contractor. An Apprentice must have a Master or Journeyman present at all times he is working. 8. DUTIES AND POWERS OF THE MONROE COUNTY INSPECTOR: R. It shall be the duty of the County nUILDING OFFICIAL 11 ~ -3- ~ I. !1t l~ '. to issue permits for, and inspect all electrical wiring apparatus or equipment for lights, heat or power inside of or attachedtb buildings within the limits of ~lonroe County, and to look after the enforcement of laws, rules and regulations, relating to same, and to exercise a general supervision over all electrical construction. b. It shall be unlawful for any person, firm or corporation to use any electrical current in or through any wiring system until all inspections have been made and approved. Houses, ~ulilple units and other buildings whichre4uire a Certificate of Occupancy must have all final inspections, which include air conditioning duct and equipment, plumbing, electrical, building, septic system, or sewer treatment plant and any other related work which must be inspected, and approved. Upon approval of inspections a Certificate of Occupancy will be issued and the power company notified to connect the power. A TEMPORARY ELECTRICAL CONNECTION \~ill be approved only after receipt and consideration by t~e po0er company and the Electrical Inspector of a written and . notarized statement from the owner giving reason why he requests same before a Certificate of Occupancy is issued. c. On all wiring installations where an increase or decrease of load is to be made, the power company must be notified before appliances or equipment are connected, so that proper arrangements may be made by them. d. When electrical wiring, apparatus or fixtures covered by a permit shall be found on inspection by the County BUILDING OFFICIAL to conform to the rules and regulations provided by this regulation, the County BUILOrNG OFFICIAL shall issue a final Certificate of Inspection certifying that the wiring, apparatus or fixtures have been inspected and found to comply with the terms of this regulation. e. The County BUILDING OFFICIAL or any of his assistants are hereby empowered to inspect or re-inspect all interior wires and apparatus, conducting or using electric current for light, heat or power, and when said condutors or apparatus are found to be un~afe to life or property, he shall notify the person, firm or corporation owning, using or operating them, or either of them to place same in a safe and secure condition within twenty- four (24) hours, or within such further time as the County BUILDING OFFICIAL shall reasonably determine is necessary. f. Whenever any wiring, apparatus or fixtures conducting or using current for light, heat or power is found upon inspection by the County BUILDING OFFICIAL to be immediately hazardous to life or property, the said County BUILDING OFFICIAL or one of his duly ~~ -4- authorized assistants shall immediately open the switch or ciF~uit breaker controling the supply of current to such ,~iring, apparatus or fixture, and shall post in a conspicuous place near such switches or circuit breaker, a notice, as follows: "NOTICE ----- WIRING CONDEHNEDIt. "THE USE OF ELECTRICAL CURRENT IS PROHIBITED THROUGH THIS WIRING OR EQUIPHENT UNTIL PROPER REPAIRS HAVE BEEN MADE AND APPROVED BY "THE COUNTY BUILDING OFFICIAL....REPAIRS MUST BE MADE AN~ THE COUNTY BUILDING OFFICIAL HUST BE NOTIFIED". After such notice is posted as provided in the foregoing, no person shall close the switch or circuit breaker which has been opened by the County BUILDING OFFICIAL or one of his duly authorized assistants, nor use or attempt to use any current through such wiring apparatus or fixtures which have been condemned, until necessary rc?airi have been made and approved by the County B1JILDING OFFICIAL. T:",;) CouI)ty BUILDING OFFICIAL may also notify the person, firm or corporation . furnishing current to such wiring, apparatus or fixtures to disconnect the supply wires and cut off the current from the premises where such wiring, apparatus or fixtures are located. IT SHALL BE UNLAWFUL FOR ANY PERSON, FIRM OR CORPORATION TO HINDER OR INTERFERE WITH THE COUNTY BUILDING OFFICIAL, OR ANY ASSISTANT IN THE DISCHARGE OF HIS DUTIES UNDER THIS REGULATION. (Also see Article 90-4 enforcement in National Electric Code). 9. INSPECTION OF WORK: All Plumbing and other piping or tube work and air conditioning duct work must be in place on work to be concealed before the electrical wiring is inspected, and no such wiring shall be considered as complete until all such plumbing or piping is in place. Upon making an inspection of any electrical wiring or equipment when same is found to have been installed in satisfactory manner and in accordance with the provisions of this regulation, the County BUILDING OFFICIAL shall place a notice at the service switch or other suitable place stating that the electrical work has been inspected and found to be_in accordance with the rules as prescribed and the provision of this regulation. It shall be unlawful to lath, seal or in any manner conceal any electrical wiring or equipment until same has been inspected and the notice posted as herewith required. It shall be unlawful to cover or fill any switch or outlet box with plaster, cement or other materials. When the electrical work in any building for which a permit has been obtained is ready for inspection notice shall be given to the County BUILDING OFFICIAL at his office, stating the location of the work, name of the owner, and the name of the electrician doing the work. As soon as possible thereafter the County BUILDING OFFICIAL shall notify the ~ ""~''''~.";''':<'"''''-';''; ,.,,~,. <.l .... ,.~.__.,,....-... -5- electrician in charge of the work when he will inspect s~me and- the County BUILDING OFFICIAL may test the work in the presence of the electrician or in any manner necessary to demonstrate that the work has been installed in a proper manner and in accordance with the provisions of this regulation. After the final completion of the work, a notice shall be given at the office of the County BUILDING OFFICIAL for a final inspection, and if the work has been property done, he shall issue a final Cert,ificate. Said Certificate of Inspection is not to be Temoven by any person other than the inspector. This Certificate shall not relieve the electrician of responsibility for any defective work which may have escaped the notice of the County Inspector. Where a written electrical inspection is required by a State, County or Federal Agency, the inspection shall be made and the report signed by the Monroe County BUILDING OFFICIAL. 10. I PE~'\L.TY FOR VIOLATION: Any person violating or permitting t 0 b e v i 0 1 .1 t e d any 0 f t 11 e pro v 1 s 1. 0 n s 0 f t his reg u 1 at i on s hall up on conviction before the County Court, be punished by a fine of not nore than FIVE HUNDRED ($500.00) DOLLARS, or by imprisonment in the County Jail not exceeding SIXTY (60) DAYS, or both such fines and imprisonment. 12. HISCELLANEOUS: a. All kitchen receptacles for general use - shall be limited to two (2) per circuit. Fixed appliances such as refrigerator, dishwasher, disposal) trashnasher, freezer, etc. shall be on separate ciruits. b. Light outlets in clothes closets shall be installed on the ceiling. Receptacles no higher than one (1) foot from the floor will be permitted in clothes closets for the use of approved mildew lights or heaters. c. Branch circuits in all installations feeding all outlets and switches shall not be smaller than nunber twelve (12) copper wires. d. Requirements in multiple dwellings: On new buildings and rewired buildings, no branch circuits shall be connected to serve more than (1) apartment. Distribution panels shall be located in the ~partrnent they serve or in a public space. IN RESIDENCES, PA~ELS SHALL NOT BE LOCATED IN CLOTHES CLOSETS, BEDROOMS, UNDER STAIRS, KITCHEN CABINETS, OR ANY PLACE THAT IS NOT. READILY ACCESSABLE. e. Every electrical contractor shall stencil or provide a decal with the contractor's name and address and phone number on the main switch or panel. g. All service grounds must be enclosed in ~onduit with thread hub type ground fitting with minimum number six (6) copper Hire. h. NO WATER PIPE OR FITTING shall be substituted f6r electrical conduit and fitting. i. Sub-feeds to mobile homes must be in conduit with wire capacity of the main panel inside of trailer. Between the bottom of the trailer and the ground where sub-feed comes up, a short piece of WP Greenfield, approximately eighteen (18") inches shall be installed. j. All condutors must be copper (no copper clad aluminum or aluminum) minimum number twelve (12), no aluminum conduit underground, in slabs or within eighteen (18") inches of ground. k. When electrical power is requested to a building that is not completed far enough for a final inspection, the General Contractor and the owner of the property must sign a release before the power company is notified to connect the building. Such service will be allowed only if all interior work is finished. 1. Delete Note 8 to tables 210-16 through 310-19, National Electric Code, (this deletion elimiates the de-rating of allowable load current to allow increased nUMber of conductors in a conduit). m. All electrical conduits burried in concrete must be PVC, schedule 40, and shall be tied in place. n. Non-metallic sheathed cable (Romex) may be used in wood frame construction only. Non-metallic sheathed cable will not be used in masonry, concrete or steel frame construction. o.
