Ordinance 019-1976 ORDINANCE NO. 19 - 1976 AN ORDINANCE AUTHORIZING AND ENABLING THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, TO APPROPRIATE FUNDS OUT OF THE GENERAL REVENUE FUND OF THE MONROE COUNTY BUDGET FOR THE PURCHASE OF AND PLACEMENT OF FILL UPON STATE LANDS LOCATED TO THE EAST OF THE CONCH KEY FIRE DEPAR TMENT ON CONCH KEY, MONROE COUNTY, FLORIDA, PROVIDING THA T THE DEPARTMENT OF TRANSPORTATION OF THE STATE OF FLORIDA ENTER INTO AN AGREEMENT WITH THE COUNTY OF MONROE AND THE CONCH KEY VOLUNTEER FIRE DEPAR TMENT THAT SAID PROPER TY BE USED BY THE FIRE DEPAR TMENT FOR ONLY MAINTENANCE AND PARKING PUR- POSES, DECLARING THE USE OF SAID FILLED PROPER TY TO BE A COUNTY, WELFARE AND PUBLIC PURPOSE; REPEALING ALL SPECIAL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT WITH THE ORDINANCE TO THE EXTENT OF SAID CONFLICT AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. The Board of County Commissioners of Monroe County, Florida, may appropriate funds out of its General Revenue Fund of the Monroe County Budget for the purposes of providing 600 cubic yards of fill, the cost for which shall not exceed $2, 000.00 including labor for placement of said fill upon property owned by the State of Florida, Department of Transportation which lies immediately east of the existing Conch Key Volunteer Fire Department on Conch Key, Monroe County, Florida providing that said Department of Transportation and said Volunteer Fire Department enter into an agreement with the County of Monroe to the effect that said property may be filled by the County and that its use shall only be for maintenance and parking for said Fire Department. Section 2. Any funds appropriated hereunder shall be expended directly by the County of Monroe for fill only and for the placement of fill as herein approved by the County of Monroe. Section 3. The placement of fill on said property and the expenditure of funds therefor are hereby decreed to be a County, Welfare and Public Purpose. Section 4. All Special Laws, Ordinances, Resolutions, rules and regulations in conflict herewith are hereby repealed to the extent of said conflict. Section 5.
