ORDINANCE NO.II -1975
AN ORDINANCE PROHIBITING THE BUILDING AND ZONING
DEPARTMENT OF MONROE COUNTY, FLORIDA, TO ISSUE
BUILDING PERMITS FOR ANY MULTI-HOUSING DEVELOP-
MENTS WITHIN THE UNINCORPORATED LIMITS OF MONROE
COUNTY, FLORIDA; PROHIBITING SAID DEPARTMENT
FROM ISSUING PERMITS FOR EXCAVATION, FILLING
LANDS, OR FOR COMMERCIAL MINING PURPOSES; SETTING
INTERIM DENSITY FACTORS FOR ALL TYPES OF BUILDING
UNITS OF NOT MORE THAN FIVE (5) UNITS PER ACRE;
AUTHORIZING THE ISSUANCE OF BUILDING PERMITS FOR
SINGLE FAMILY AND DUPLEX UNITS AND ADDITIONS TO
EXISTING BUILDINGS, INCLUDING COMMERCIAL BUILD-
INGS, IF THE PROPERTY IS PROPERLY ZONED AND
FILLED; LIMITING THE PERIOD OF TIME IN WHICH THIS
ORDINANCE SHALL REMAIN IN EFFECT; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1.
No building permit for the construction of
any multi-housing development within the unincorporated limits of
Monroe County, Florida, shall be issued by the Building and Zoning
Department of Monroe County, Florida, while this Ordinance is in
effect.
Section 2.
No permit for any excavation for the purpose
of filling land or for the purpose of commercial mining shall be
issued by said Building and Zoning Department.
Section 3.
There is hereby set an interim density factor
for all types of building units of not more than five (5) units per
acre.
Section 4.
Building permits may be issued for single
family units, duplex units, and additions to existing buildings,
including commercial buildings, if the property is properly zoned
and filled.
Section 5.
This Ordinance shall stay in effect until
December 31, 1975, after which time same shall become null and void
and of no force and effect.
Section 6.
This Ordinance shall be deemed to be filed and
shall take effect when a copy has been accepted by the postal
authorities of the government of the United States for special
delivery by registered mail to the Department of State.
