ORDINANCE NO .13 -1975
AN ORDINANCE AMENDING SECTION 2, REQUIREMENTS AND
SCHEDULE OF FEES FOR BUILDING PERMITS, AS ADOPTED
BY SAID SECTION 2 OF ORDINANCE NO. 7-1973 THE
SAME BEING ENTITLED "AN ORDINANCE PERTAINING TO
THE ADOPTION OF THE SOUTHERN STANDARD BUILDING
CODE 1973 REVISION AS ADOPTED BY THE SOUTHERN
BUILDING CODE CONGRESS, EXCEPT AS OTHERWISE PRO-
VIDED FOR HEREIN; PROVIDING FOR REQUIREMENTS AND
SCHEDULE OF FEES FOR BUILDING PERMITS; PROVIDING
FOR A PENALTY FOR ANY VIOLATIONS OF THIS ORDI-
NANCE; REPEALING ALL SPECIAL LAWS, ORDINANCES,
RESOLUTIONS, RULES AND REGULATINS IN CONFLICT
HEREWITH TO THE EXTENT OF SAID CONFLICT; AND PRO-
VIDING FOR AN EFFECTIVE DATE." BY AMENDING SEC-
TION VI. EXPIRATION OF BUILDING PERMITS OF SAID
REQUIREMENTS BY CHANGING THE METHOD OF VOIDING
BUIDING PERMITS, THE EXTENSION OF SAME, REQUIR-
ING NEW PERMITS UNDER CERTAIN CIRCUMSTANCES,
AUTHORIZING THE BUILDING OFFICIAL TO HAVE RE-
MOVED FROM BUILDING SITES WORK COMMENCED OR COM-
PLETED UNDER CERTAIN CIRCUMSTANCES, DEFINING WHEN
WORK SHALL BE CONSIDERED TO HAVE COMMENCED AND BE
IN ACTIVE PROGRESS, AND REQUIRING OF PERMIT
HOLDERS ISSUED PRIOR TO THE PASSAGE OF THIS SEC-
TION TO CONFORM WITH THE PROVISIONS OF THIS SECTION
WITHIN 90 DAYS FROM SAID PASSAGE; BY AMENDING
SECTION X. FEES OF SAID REQUIREMENTS AND SCHEDULE
OF FEES FOR BUILDING PERMITS BY ADDING SUBSECTION
15A TO SAID SECTION X REQUIRING A FEE FOR FILLING
LAND OR PLACING FILL IN WATER; PROVIDING FOR A
PENALTY FOR ANY VIOLATIONS OF THIS ORDINANCE; RE-
PEALING ALL SPECIAL LAWS, ORDINANCES, RESOLUTIONS,
RULES AND REGULATIONS IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1.
Section VI, Expiration of Building Permit,
Requirements and Schedule of Fees for Building Permits, Monroe
County Building and Zoning Department, as adopted by Section 2 of
Ordinance No. 7-1973 is hereby amended to read as follows:

Expiration of Building Permit
Permits shall expire and become null and void if
work, authorized by such permit is not commenced
within 30 days from the date of the permit or if
such work when commenced is suspended or abandoned
at any time for a period of 90 days.
If the work covered by the permit has not commenced
or has been commenced and been suspended or aban-
doned, the Building Official may extend such permit
for a single period of 60 days from the date of
expiration of the initial permit, if request for
extension is made prior to the expiration date of
the initial permit.

3. If the work covered by the permit has commenced,
is in progress, has not been completed and is
being carried on progressively in a substantial
manner, the permit shall be in effect until com-
pletion of the job.
4. If work has commenced and the permit becomes null
and void or expires because of lack of progress or
abandonment, a new permit covering the proposed
construction shall be obtained before proceeding
with the work.
5. If a new building permit is not obtained within
90 days from the date the initial permit became
null and void, the Building Official shall require
that any work which has been commenced or completed
be removed from the building site, or he may issue
a new permit, on application, providing the work
in place and required to complete the structure
meets all applicable regulations in effect at the
time the initial permit became null and void and
any regulations which may have become effective
between the date of expiration and the date of
issuance of the new permit.
6. Work shall be considered to have commenced and be
in active progress when, in the opinion of the
Building Official, a full compliment of workmen
and equipment is present at the site to diligently
incorporate materials and equipment into the struc-
ture throughout the day on each full working day,
weather permitting. This provision shall not be
applicable in case of civil commotion or strike or
when the building work is halted due to legal
action.
7. All permits issued prior to the passage of this
Section shall have 90 days to conform with the
provisions of this Section, before becoming liable
to its provisions.
Section 2.
Section X, Fees, Requirements and Schedule of
Fees for Building Permits, Monroe County Building and Zoning De-
partment, as adopted by Section 2 of Ordinance No. 7-1973 is hereby
amended by adding the following:
15A.
Filling land or placing fill in water.
For every $1,000.00 worth of fill or
fractional part thereof
Every additional $1,000.00

Section 3.
Violations of this Ordinance shall be prose-
cuted in a county court by the prosecuting attorney thereof, and
upon conviction shall be punished by a fine not less than $15.00
nor to exceed $500.00 or by imprisonment in the county jail not to
exceed 60 days or by both such fine and imprisonment.
Section 4.
This Ordinance shall not apply to any munici-
pality located in Monroe County, Florida.

Section 5. All Special Laws, Ordinances, Resolutions,
rules and regulations in conflict herewith are hereby repealed
to the extent of said conflict.
Section 6. This Ordinance shall take effect upon receipt
of the official acknowledgment from the Department of State acknowl-
edging receipt of certified copy of this Ordinance and that said
Ordinance has been filed in said Office.
