Ordinance 003-1973 ~}..\,~ "3-~ t"e ~lQ.~;.jP--- ):'3.~~ ~ ,. library board created by this ordinance to be located in the county courthouse and branch courthouses of said County for the use of the judges and the officers of the several courts of Monroe County and of the County officials and residents desiring access thereto, which said libraries shall operate under such rules and regulations as the law library board shall prescribe and all debts against such County for the creation and conduct of the law libraries shall be paid solely from the fund created by this ordinance. There shall be taxed and collected by the Clerk of the Circuit Court the sum of seven dollars and fifty cents ($7.50) in each civil case in law commenced in the "...:4 of such County charged with the purchasing and spending of the public funds shall maintain such libraries under the direction of the law law libraries and the Board of County Commissioners and other officers general County purposes. It is hereby declared that the proper administration COUNTY, FLORIDA: BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT AND MAINTEN- ANCE OF LAW LIBRARIES IN THE COUNTY COURTHOUSE AND BRANCH COURTHOUSES IN MONROE COUNTY, FLORIDA, FOR THE USE OF THE JUDGES, OFFICERS OF THE COURTS OF SAID COUNTY AND OF COUNTY OFFICIALS AND RESIDENTS; DECLARING THE ESTABLISHMENT AND MAINTENANCE OF SAID LIBRARIES TO BE A PUBLIC NEED AND FOR GENERAL COUNTY PURPOSES; PROVIDING FOR A LAW LIBRARY BOARD TO OPERATE SAID LIBRARIES AND AUTHORIZING SAID LIBRARY BOARD TO PRESCRIBE AND ENFORCE RULES AND REGULATIONS AS TO SAID LIBRARIES; PROVIDING FOR THE MANNER FOR RAISING FUNDS OUT OF COSTS TO BE TAXED BY THE CLERK OF THE CIRCUIT COURT; PROVIDING THAT THE SAID LAW LIBRARIES SHALL SUCCEED THE PRESENT LAW LIBRARY CREATED BY CHAPTER 28,625, LAWS OF FLORIDA, 1953, AND CHAPTER 61-2491, LAWS OF FLORIDA, 1961, AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. ORDINANCE NO. 3 -1973 Circuit Court and all cases commenced in County Court with exception of cases in which Rules of Summary Procedure or Summary Procedure (Chapter 51, Florida Statutes) are applicable. All said sums so col- lected shall be set apart by said Clerk into a special fund to be known as the law libraries fund to be used exclusively for the pur- pose and maintenance of such libraries. Section 3. The said Board of County Commissioners shall pro- vide for adequate quarters within which to house the said law libraries. Section 4. The Chairman of the Board of County Commissioners, the judges of the County Court and Circuit Court of Monroe County, and the President or Presidents of any local Bar Association or Associations in Monroe County, Florida, shall constitute the law library board. Section 5. Until such time as the law library board may deem it expedient to employ a full time librarian, the law library board may employ a part time librarian or may delegate the duties to such other court personnel as determined by said board. Section 6. The law library board is hereby authorized and di- rected to purchase, sell, rent or exchange such books and other prop- erty as may be necessary for the use of said law libraries. Section 7. The law libraries hereby created shall succeed the present law library established in Monroe County, Florida, which was created by Chapter 28,625, Laws of Florida, 1953, and Chapter 61-2491, Laws of Florida, 1961, and is hereby declared to be the owner of all its property and subject to all outstanding obligations which it assumes. Section 8. All laws and parts of law in conflict with the pro- visions of this ordinance be and the same are hereby repealed. Section 9. If any clause, section or other part of this ordin- ance shall be declared unconstitutional, it shall not affect the re- mainder, it being the intent of the County that each part thereof shall stand alone. Section lO.
