Ordinance 007-1982ORDINANCE NO. 7 -1982 AN ORDINANCE OF THE COUNTY OF MONROE, FLORIDA, PROVIDING THAT THE CODE OF ORDINANCES, COUNTY OF MONROE, BE AMENDED BY REVISING CHAPTER 8, ARTICLE II, SECTION 8-33(a); PROVIDING FOR SEVERABILITY; PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDI- NANCE ARE HEREBY REPEALED TO THE EXTENT OF SAID CONFLICT; PROVIDING FOR INCLUSION IN THE MONROE COUNTY CODE OF ORDINANCES; PROVIDING AN EFFEC- TIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. That Chapter 8, entitled "Garbage, Trash and Refuse", Article II, entitled "Solid Waste Collection and Disposal", Section 8-33, entitled "Unlawful disposal of solid waste" subsec- tion (2), be amended so that such subsection shall hereafter read as follows: "Section 8-33. Unlawful disposal of solid waste. (a) No person shall dispose of any garbage or special waste, except through franchise collectors. In- habitants of the county may transport to the district solid waste vicinity yard trash from their individual premises, provided that such persons using district facilities shall be required to pay the fee established by the board and that said yard trash is so broken up as to be readily disposed of by incineration when de- livered to the facility. The disposal of sludge shall be permitted by special permit issued by the Municipal Service District. Fees for disposal of said sludge shall be established by the board." Section 2. If any section, subsection, sentence, clause or provision of this Ordinance is held invlaid, the remainder of this Ordinance shall not be affected by such invalidity. Section 3. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said con- flict. -2- Section 4. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appro- priately renumbered to conform to the uniform numbering system of the Code. Section 5. This Ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said Office.
