ORDINANCE NO. 13 -1982
AN EMERGENCY ORDINANCE OF THE COUNTY OF MONROE,
FLORIDA, AUTHORIZING THE EXPENDITURE OF BUDGETED
FUNDS FOR THE USE OF THE NEIGHBORHOOD IMPROVEMENT
ASSOCIATION, INC., A FLORIDA CORPORATION NOT FOR
PROFIT; PROVIDING FOR THE WAIVING OF NOTICE OF
ENACTMENT; REPEALING ORDINANCE NO. 12-1982; PRO-
VIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.
WHEREAS, the Neighborhood Improvement Association, Inc. is a
not for profit corporation, organized under the provisions of
Florida Statutes, and is a corporation in good standing under those
Statutes, and
WHEREAS, the corporation has as its purposes the improvement
of the community of Key West by improving the living environment,
confronting the problems of juvenile delinquency, poor housing
conditions and other social ills and attempting to solve these
problems, and
WHEREAS, the Board of County Commissioners of Monroe County,
Florida considered these purposes to be in the public interest,
and any contribution of County funds to the Neighborhood Improve-
ment Association, Inc., to be for a public purpose, and
WHEREAS, this Board finds that there exists a public emergency
affecting the public, health, welfare & safety of Monroe County
and that it is in the best interest of the citizens of Monroe
County to enact this emergency ordinance, and
WHEREAS, this Board previously adopted Ordinance No. 12-1982
which said Board now desires to repeal, now, therefore,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, as follows:
Section 1. There now exists an emergency ln Monroe County,
Florida, affecting the public health, welfare & safety of the
citizens of Monroe County, Florida.
Section 2. The notice requirements for regular enactment of
County Ordinances are hereby waived, as immediate enactment as an
emergency ordinance is necessary.
Section 3.
Ordinance No. 12-1982 entitled "An Ordinance
of the County of Monroe, Florida, authorizing the expenditure of
budgeted funds for the use of the Neighborhood Improvement
Association, Inc., a Florida Corporation not for profit; providing
for severability and an effective date" be and the same is hereby
repealed.
Section 4. The sum of $25,000.00, non-reoccuring, which
has been provided in the current fiscal year budget of the County
for the purpose, be appropriated and expended and paid over to the
Neighborhood Improvement Association, Inc., to be utilized for the
public purposes of that corporation.
Section 5. Should any portion of this ordinance be found to
be unconstitutional or unenforceable, it shall not affect the
remaining portions of this ordinance.
Section 6. That the Articles of Incorporation of the applicant
be amended to delete any "religious purpose", and that a contract be
entered into reflecting that the use of said monies herein allocated
will be for public purpose.
Section 7. This ordinance shall take effect when a certified
copy of this Ordinance has been accepted by the postal authorities
of the Government of the United States for special delivery by
registered mail to the Secretary of State of the State of Florida.
