ORDINANCE NO. 5 -1981
AN ORDINANCE CREATING THE MONROE COUNTY TELEVISION
TRANSLATOR BOARD; PROVIDING FOR MEMBERSHIP AND
QUALIFICATIONS ON SUCH BOARD; PROVIDING FOR THE
ORGANIZATION OF THE BOARD; PROVIDING FOR THE
FUNCTIONS OF SAID BOARD; PROVIDING FOR SEVER-
ABILITY FOR INVALID PORTIONS; REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
WITH THIS ORDINANCE; PROVIDING FOR INCLUSION AND
INCORPORATION OF THIS ORDINANCE IN THE CODE OF
ORDINANCES OF THE COUNTY OF MONROE, FLORIDA; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Florida Statutes, Section 125.01(1) (f), gIves the
Board of County Commissioners of Monroe County the power to provide
the services of a television translator system, and
WHEREAS, it is the purpose of this ordinance to establish a
Monroe County Television Translator Board and to operate and main-
tain television translator services within Monroe County, now,
therefore.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA:
SECTION 1.
DECLARATION OF LEGISLATIVE INTENT
It is hereby declared that the purpose and intent of the Board
of County Commissioners through this ordinance is to create and
establish a television translator board for the purpose of obtaining
the benefits of accurate, comprehensive information, advice and
counsel concerning all matters relating to television translators.
This ordinance shall not be construed as delegating to such advisory
board or its members any power or authority of a governmental,
legislative or administrative nature beyond those specifically
enumerated herein.
SECTION 2.
CREATION OF A TELEVISION TRANSLATOR BOARD
There is hereby created and established in Monroe County,
Florida a board to be known as the Monroe County Television Trans-
lator Board.

SECTION 3. MEMBERSHIP, QUALIFICATIONS AND TERMS
The Monroe County Television Translator Board shall consist of
five (5) members to be appointed by the Board of County Commissioners
of Monroe County. Each member shall be a resident and elector of
Monroe County; shall possess a reputation for integrity, responsi-
bility, civil accomplishment and professional or business ability;
and shall have demonstrated an active interest in the development
of a television translator system. Members are appointed for a
one-year term. The initial appointments shall be as follows:

Additional members may be appointed or removed representing
geographically affected entities, as deemed appropriate by the
Board of County Commissioners. Terms of the members of this Board
will expire at the concusion of one year from the effective date
of the enactment of this Ordinance.
SECTION 4.
REMOVAL OF MEMBERS
Any member of the Board who ceases to be a qualified elector,
resident, or who becomes a candidate for public office, shall im-
mediately forfeit his office. Any member may be removed from office
with cause by a majority vote of the Board of County Commissioners.
SECTION 5. ORGANIZATION, QUORUM AND MEETINGS
The Board shall elect a Chairman and such other officers as may
be deemed necessary or desirable, who shall serve at the pleasure
of the Board. A majority of the members of the board shall consti-
tute a quorum. A majority vote of the quorum present at any meeting
shall be sufficient to enable taking any action. The Board shall
meet normally at a location accessible to the public. Special meet-
lngs of the Board may be called by the Chairman, by written notice

signed by three (3) members of the Board, or by action of the Board
at any meeting, general or special. The Board may further adopt such
rules of procedure and elect such other officers as it may deem
necessary.
SECTION 6.
DUTIES AND POWERS OF ADVISORY BOARD
The Monroe County Television Translator Board shall have the
following duties, functions and responsibilities:
(1) Serve in an advisory capacity to the Board of County Com-
missioners and the County Administrator with respect to all matters
pertaining to the Monroe County Television Translator System;
(2) Furnish information, feasibility, advice, and counsel to
the Board of County Commissioners with respect to the appropriate
means and methods by which adequate television broadcasting serVlces
may be provided to all residents of Monroe County;
(3) To evaluate bids before acceptance and make recommenda-
tions to the Board of County Commissioners of Monroe County for
the award of contracts for: the design and construction of the
system; its operation and maintenance; its progressive improvement;
and, upon award of such contracts by the Board of County Commis
sioners, shall supervise and administer their execution;
(4) Make continuing studies of all existing and future needs
of the County, with respect to improving and developing the serVlces
provided to the public by the translator system facilities;
(5) Review the financial position of the system, make reports,
and through research efforts, obtain information regarding financing
through matching funds, public finance, grants, etc.
(6) Keep constantly aware of public broadcasting standards,
trends, regulations, and legislation;
(7) Formulate or recommend actions to raise the quality of
service, utilize professional and financial assistance from State,
National and other sources, and evaluate such developments as they
occur, to take advantage of whatever sources may become available

to lmprove the services that can be made available to the citizenry
by the television translator system facilities;
(8) Review with the operating and maintenance personnel the
current and projected system needs, programs, plans and policies;
(9) Prepare reports and recommendations to the Board of County
Commissioners related to budgetary, income supplement potentials,
and other matters related to finaHcial support of the operation of
the system;
(10) Establish, promote, and participate in a planned public
relations program for the television translator system;
(11) Perform and carry out such other duties and functions of
and advisory nature as may be assigned by the Board of County Com-
missioners; and,
(12) File an annual report to the County Government on the
status of the Monroe County television translator system immedi-
ately propr to the expiration of the term of the Advisory Board,
and such supplemental reports at such other times as the Advisory
Board deems proper.
SECTION 7. SEVERABILITY
If any section, subsection, paragraph, clause, sentence, phrase,
or portion of this ordinance is for any reason found invalid, un-
lawful, or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct and independent
prOV1Slon and such holding shall not affect the validity of the
remaining portions thereof. All ordinances or parts of ordinances,
or special/legal acts in conflict herewith being and the same are
hereby repealed with the effective date of this ordinance. County
Ordinance No. 24-1976 is specifically repealed.
SECTION 8. CODIFICATION
It is the intention of the Board of County Commissioners that
the provisions of this ordinance shall become and be made a part
of the Monroe County Code and the word "ordinance" may be changed
to "section", "article" or other appropriate word or phrase, and

the sections of this ordinance may be renumbered or relettered to
accomplish such intention; providing, however, that Section 7, 8,
and 9 shall not be codified.
SECTION 9.
EXPIRATION OF ORDINANCE
This Ordinance shall expire at the conclusion of one (1) year
from the effective date thereof unless renewed by the County Com-
mission.
SECTION 10. EFFECTIVE DATE
This Ordinance shall take effect when a certified copy of this
Ordinance has been accepted by the postal authorities of the
Government of the United Staes for special delivery by registered
mail to the Secretary of State of the State of Florida in accordance
with the provisions of Florida Statute 125.66(3).
