AN ORDINANCE CREATING THE MONROE COUNTY LIBRARY
ADVISORY BOARD; PROVIDING FOR MEMBERSHIP AND
QUALIFICATIONS ON SUCH BOARD; PROVIDING FOR THE
ORGANIZATION OF THE BOARD; PROVIDING FOR THE
FUNCTIONS OF SAID BOARD; PROVIDING FOR SEVER -
ABILITY FOR INVALID PORTIONS; REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
WITH THIS ORDINANCE; PROVIDING FOR INCLUSION
AND INCORPORATION OF THIS ORDINANCE IN THE CODE
OF ORDINANCES OF THE COUNTY OF MONROE, FLORIDA;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Florida Statutes, Section 125.01(6), as amended
by Chapter 71-14, Laws of Florida, gives the Board of County
Commissioners of Monroe County the power to provide libraries;
and
WHEREAS, it is the purpose of this ordinance to establish
a Monroe County Public Library Advisory Board and to operate
and maintain a free public library service with Monroe
County, now, therefore,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
SECTION 1. DECLARATION OF LEGISLATIVE INTENT
It is hereby declared that the purpose and intent of
the Board of County Commissioners of this ordinance is to
create and establish a library advisory board for the purpose
of obtaining the benefits of accurate, comprehensive information,
advice and counsel concerning all matters relating to public
libraries. This ordinance shall not be construed as delegating
to such advisory board or its members any power or authority
of a governmental, legislative or administrative nature.
SECTION 2. CREATION OF AN ADVISORY BOARD
There is hereby created and established in Monroe
County, Florida, an advisory board to be known as the Monroe
County Library Advisory Board.

SECTION 3. MEMBERSHIP, QUALIFICATIONS AND TERMS
The Monroe County Library Advisory Board shall consist
of five (S) members to be appointed by the Board of County
Commissioners of Monroe County. The five Commissioners shall
appoint a representative on this board who shall in turn be
a representative of that Commissioner's district, regardless
of the residence of the appointee. Each member shall be a
resident and elector of Monroe County; shall possess a reputation
for integrity, responsibility, civil accomplishment and profes-
sional or business ability; shall have demonstrated an active
interest in public library facilities and services, and shall
not be employed by a library.
The initial appointments shall be:

Subsequent appointments shall be for a period of four (4)
years each.
SECTION 4. REMOVAL OF MEMBERS
Any member of the Board who ceases to be a qualified
elector, resident or who becomes a candidate for public
office, shall immediately forfeit his office. Any member
may be removed from office with cause by a majority vote of
the Board of County Commissioners.
SECTION S. ORGANIZATION, QUORUM AND MEETINGS
The Advisory Board shall elect a Chairman and such
other officers as may be deemed necessary or desirable, who
shall serve at the pleasure of the Advisory Board. A majority
of the members of the board shall constitute a quorum. A
majority vote of the members present at any meeting shall be
sufficient to enable taking any action. The Advisory Board
shall meet normally at the Headquarters Library, but should
schedule meetings at the Branches as appropriate to provide
an input for Middle and Upper Keys residents. Special
meetings of the Board may be called by the Chairman, by
written notice signed by three (3) members of the Board, or
by action of the Board at any meeting, general or special.
The County Library Director shall attend all Advisory Board
meetings, other than those at which said Library Director's
tenure is to be taken under consideration. The library advisory
board may further adopt such rules of procedure and elect such
other officers as it may deem necessary.
SECTION 6. DUTIES OF ADVISORY BOARD
The Monroe County Library Advisory Board shall have the
following duties, functions and responsibilities:
(1) To serve in an advisory capacity to the Board of
County Commissioners, County Administrator and County
Library in respect to all matters pertaining to the Monroe
County Library System and Public Service;
(2) Furnish information, advise and counsel the Board
of County Commissioners in respect to the appropriate means
and methods by which adequate library facilities and services
may be provided to all residents of Monroe County;
(3) Recommend to the County Administrator the appoint-
ment of a county Library Director;
(4) Make continuing studies of all existing and future
needs of the County in respect to public library facilities
and services;
(5) Review the financial position of the library
system and make reports and through research efforts obtain
information regarding financing both through matching funds,
donations and other possible grants;
(6) Keep constantly aware of public library standards,
trends, regulations and legislation;

(7) Formulate or recommend actions to raise the
quality of service and utilization of professional and
financial assistance from State, National and other sources;
(8) Review with the Administrative Staff, book and
material selection programs, plans and policies;
(9) Promote and solicit bequests, donations and contri-
butions, for the County library system and recommend policies
governing acceptance for such donations;
(10) Establish, promote and participate in a planned
public relations program for the library system;
(11) Perform and carry out such other duties and
functions of an advisory nature as may be assigned by the
Board of County Commissioners; and,
(12) File an annual report on October 1 to the County
Government on the status of the Monroe County Library System
and such other times as the Advisory Board deems proper.
SECTION 7. SEVERABILITY
If any section, subsection, paragraph, clause, sentence,
phrase, or portion of this ordinance is for any reason found
invalid, unlawful, or unconstitutional by any court of compe-
tent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portions thereof. All
ordinances or parts of ordinances, or special/legal acts in
conflict herewith be and the same are hereby repealed with the
effective date of this ordinance. County Ordinance No,
24-1976 is specifically repealed.
SECTION 8. CODIFICATION
It is the intention of the Board of County Commissioners
that the provisions of this ordinance shall become and be made
a part of the Monroe County Code and the word "ordinance" may
be changed to "section", "article" or other appropriate word
or phrase and the sections of this ordinance may be renumbered
or relettered to accomplish such intention; providing, how-
ever, that Sections 7, 8, and 9 shall not be codified.

SECTION 9. EFFECTIVE DATE
This ordinance shall take effect upon receipt of official
acknowledgment by the Clerk of the Board of County Commissioners
from the Department of State that this ordinance has been filed
with the Department of State.
