RESOLUTION NO. 007-1991
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, ACCEPTING THE
WASTE TIRE SOLID WASTE GRANT FROM THE FLORIDA
DEPARTMENT OF ENVIRONMENTAL REGULATION AND
AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT IN
FURTHERANCE THEREOF.
WHEREAS, by Resolution 420 1990, the Board of County
Commissioners of Monroe County, Florida authorized the
submission of a grant application to the Florida Department
of Environmental Regulation for a Waste Tire Recycling
Grant, and
WHEREAS,
the Florida
Department of Environmental
Regulation has awarded Monroe County a Waste Tire Recycling
Grant in the amount of $44,182 and,
WHEREAS,
the Florida
Department of Environmental
Regulation has issued Grant Agreement WT91-41 as part of
the grant awards, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA: that the said grant is hereby
accepted and the Mayor is authorized to execute the said
contract.

Third Year Recycling and Education Grants and Waste Tire Grants
We are pleased to award third year RecycJing and Education grants totaling
twenty-five million dollars. This figure is based on oredicted revenue
collections which will provide money for the Solid Waste Management Trust Fund
during state fiscal year 1990-1991. We are also pleased to be able to award
Waste Tire grants totaling six million five hundred thousand dollars.
Two signed copies of each Grant Agreement indicating your s~are of these funds
are attached for your acceptance and signature.
Each year we attempt to improve our reporting process using suggestions from the
grants staff and the grantees. The third year grant conditions remain nearly the
same as those for year two. Payments will continue to be made by reimbursement
method only with no provisions for advances. The changes. in processing
requirements and grant conditions are listed below.
1. Only an original of the payment request with summaries and appropriate
contracts attached is required for processing. Two additional copies were
r~uired in year two.
2. Summary sheets should reflect the following information when submitted
with the payment requests:
A. The date of the invoice and the date it was paid.
B. The name of the vender.
C. The amount the vender was paid.
D. t.. description of the items and services purchased which clearly
identifies them (i.e., using "equipment" as a description would not
be sufficient. The types of equipment and numbers purchased should
be detailed, as in 2 bailers, 200 bins, etc.).

3. A final request for payment must be submitted no later than November 15,
1991.
4. If there is a change in the authorized representative during the grant
peri od, the Department must be not ifi ed of the new representative by
resolution or minutes of a commission meeting.
Finally, our records indicate that a number of counties are not in compliance
with the financial reporting requirements of previous grant agreement(s) and the
corresponding grant rule. If your county is one of those not in compliance, you
will find a checklist attached indicating areas where there are deficiencies.
All of the requirements must be met before YOU will receive reimbursement for
third year Qrant exoenditures. As soon as these deficiencies are corrected, we
will notify you and reimbursements will proceed as usual.

Department of Environmental Regulation, Solid Waste Section, 2600 Blair Stone
Road, Tallahassee, Florida 32399-2400, ATTN: Bobby Adams. These must be post
marked on or before January 31, 1991. After signing and returning the Grant
Agreements you may begin submitting completed payment request packages if you
have incurred any expenses from October 1, 1990 to the present. If you have any

PART II - GRANT CONDITIONS
A. GENERAL CONDITIONS:
1. The method of payment, for the period October 1, 1990 through
September 30, 1991, will be on a reimbursement basis only.
2. The grantee shall submit payment requests on a quarterly basis.
An original of the payment request, with summaries and appropriate
contracts attached, shall be due on the last day of the month
following the end of the reporting period.
3. Grant funds may be obligated for allowable expenditures until
September 30, 1991. The grantee may expend grant funds and
liquidate obligations until October 31, 1991. A final request
for payment must be submitted no later than November 15, 1991.
4. Payment requests must be signed by the-nesignated Authorized
Representative. This should be the same person who signed the
grant agreement. If there is a change in the authorized
representative during the grant period, the Department must be
notified of the new representative by resolution or minutes of a
commission meeting.
5. Expenditures shall be limited to allowable items as listed in
Section 17-716.620 of the Solid Waste Grants Program Rule:
(a) Construct or operate, or contract for the construction or
operation of, a waste tire processing facility and equipment
purchases therefore;
(b) Contract for a waste tire processing facility service within
or outside the county or state;
(c) Remove or contract for the removal of waste tires from the
cou~y, region, or state;
(d) Perform or contract for the performance of research designed
to facilitate waste tire recycling;
(e) Establish waste tire collection centers at solid waste
disposal facilities or waste tire processing facilities;
(f) Provide incentives for establishing or expanding privately
operated waste tire collection centers for the public.

6. Up to five percent of a county's grant for fiscal year 1990-91
may be used for administrative costs and planning or research
studies to assess the feasibility of eligible projects within a
county, or to assess the feasibility of establishing a regional
waste tire program.
7. Each recipient of grant funds shall maintain accurate records
of all expenditures of grant funds and shall assure that these
records are available at all reasonable times for inspection,
review or audit by Department personnel and other personnel
authorized by the Department. Records shall be kept for a
period of at least 3 years following the end of the grant period.
The grantee agrees that it will expeditiously initiate and
complete the program work for which assistance has been awarded
under this agreement in accordance with all applicable provisions
of Florida Statutes and the Florida Administrative Code.
8. Allowable costs incurred on or after the !budget period start date,
October 1, 1990, may be charged to this agreement.
9. Grant funds shall be included in the grantee's Annual Audit
performed under the Single Audit Act (AI28). Any subgrants made
by the grantee shall also include a provision for the subgranted
funds to be included in the subgrantee's Annual Single Audit. A
copy of all Single Audits shall be submitted to the Department of
Environmental Regulation, Solid Waste Section, by March 31st of
each year.
10. The Department has the right to terminate a grant award and demand
refund of grant funds for non-compliance with the terms of the award
or the Solid Waste Grants Program Rule 17-716. Such action may also
result in the Department declaring the local government ineligible
for further participation in the program until the local government
com~ies with the terms of the grant award.
11. Grantee shall obtain all necessary construction-related permits
before initiating construction.
12. The State of Florida's performance and obligation to pay under this
grant agreement is contingent upon receipt of funds presently
anticipated from the Florida Department of Revenue.

OFFER AND ACCEPTANCE
The State of Florida, acting by and through the Department of
