Resolution 020-1991 Planning Department "RESOLUTION NO. 020 -1991 A RESOLUTION CONFIRMING THE ADMINISTRATIVE BOUNDARY INTERPRETATION OF THE PLANNING DIRECTOR DENYING THE REQUEST TO REDRAW THE EXISTING BOUNDARIES IN LAND USE DISTRICT MAP BOUNDARY INTERPRETATION NUMBER 63 f LOTS 2 THROUGH 8, BLOCK 5, WINDWARD BEACH ESTATES, LITTLE TORCH KEY, MONROE COUNTY, FLORIDA, APPROXIMATELY MILE MARKER 28. WHEREAS, the property described as Lots 2 through 8, Block 5, Windward Beach Estates, Little Torch Key, Monroe County, Florida, is currently zoned Native Area (NA); and WHEREAS, the staff recommends denial of the boundary changes requested, as indicated in Antonia Gerli's reports dated September 5, 1990, and Diana Stevenson's report dated September 7, 1990; and WHEREAS, the current Land Use district boundaries were not placed in error with the adoption of the September 15, 1986 Land Development Regulations, and therefore the subsequent maps were not in error, as they did follow the previous demarcated Native Area boundary; and NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT: 1) The administrative decision of the Planning Director, which recommends denial of a boundary change in Land Use District Map Boundary Interpretation Number 63 dated January 16,1991, is hereby found to be in conformance with the standards set forth in Section 9.5-3(m), Monroe County Code, and is therefore approved; and that RESOLUTION NC" -1991 BOUNDARY DET__.____~ATION NO. 63 2) The above described property should remain as currently designated, t3at is, Native Area (NA)i and that 3) The Clerk of the Board is hereby directed to forward a certi- fied copy of this resolution to the Florida Department of Communi- ty Affairs. Re INTRODUCTION: The applicants have requested a boundary determination for lots 4, 5, and 8. The Planning Department has requested that the adjacent lots 6 and 7 be considered together with their re- quests. Therefore, all lots were reviewed. The lots are present- ly located within the Native Area (NA) land use district. The applicants have requested that they be changed to Improved Subdi- vision (IS) so that single family residences can be built. SITE DESCRIPTION: The lots were created years ago by dredge and fill methods. It appears that very little fill was placed on the lots at that time. The lots are now completly revegetated with Black man- groves and associated salt marsh species. The canal banks have been stabilized with a healthy fringe of Black, White, and Red mangroves. No exotic species are present. Although the lots are designated as Disturbed (740) on the 1" - 200' aerials, signifi- cant regrowth has occured since they were taken in 1985. This Disturbed designation should be ammended to Scrub Mangrove (620), which would accurately describe the lots at this point in time. The lots are designated as Salt Marsh and Buttonwood (640) on the 1" - 2000' existing conditions map. There is a single family residence under construction on Lot 1 that was permitted prior to the 1986 land use district maps. The lots north of Lot 8 are zoned Improved Subdivision (IS). There are 3 houses across the street on block 3 that also must have been permitted prior to the 1986 land use designation changes since the lots are not large enough to meet the density provi- sions for the NA district under current code. There are no hous- es on blocks 1 and 2 directly to the west and most of these lots are not buildable due to either Salt Marsh or Mangrove habitat. EVALUATION: Lots 2 through 8 more closely fit the criteria and purpose of the NA land use district than the IS land use district, not only by definition but by the present community character. Although previously disturbed these lots now support a healthy Mangrove and Salt Marsh community. Pursuant to Monroe County Land Develop- ment Regulations Section 9.5-345 only piers, docks, utility pil- ings and walkways can be permitted on submerged lands and man- groves. RECOMMENDATION: It is recommended that the IS/NA boundary line is correct and that Lots 2 through 8 retain their NA land use district designa- tion.
