Detailed description of change order and justification:
This DEDUCT chanae order allows the structural inspections to be performed bv the Structural Enaineer
thus insurina the structure is built within the design parameters. The amount of $30,360 is for inspections
bv the structural enaineer twice a week for 12 weeks. At the end of this 12 week period the inspections
will be completed bv MT Causlev for the duration of the proiect.
The proiect substantial completion will be extended by 38 days at no additional cost to the owner for
overhead and profit.
The new substantial completion date will be June 17. 2006

Structural Inspections
Dear Mr. Chalmers:
This letter will address the recent conversations we've been having regarding structural
inspections and delayed work progress due to the ongoing conflicts over how those
inspections have and will be conducted.
As you know, The Tower Group is uncomfortable retaining the Special Inspectors
required to perform the structural inspections. While there is a pay item in the
Contract Documents for inspections, The Tower Group is uncomfortable with a direct
contract with inspectors performing inspections of The Tower Group work. We know
you are sympathetic to our viewpoint, but we also recognize that your preference is to
have The Tower Group contract inspectors, so that the inspection work does not
become a public bid item.
In order to accommodate your preference, we previously retained M.T. Causley.
However, with regard to structural work, and the safety issues involved, Monroe
County has agreed that the preferred approach would be to have the Engineer of
Record inspect the structural foundation work.
Accordingly, we have agreed to credit the Owner with the amount of $30,000.00. This
$30,000.00 credit, as we understand it, will be paid to Gonzalez Architects who in tum
will pay the Engineer of Record for the following inspection work:
Pistorino and Alam will perform two structural inspections
each week for the next three months, or until the foundation
steel work and concrete pours are completed,
In so doing, The Tower Group's structural foundation work will be reviewed by the
Engineer of Record, and not by an inspector being paid by The Tower Group, pursuant
to the Contract Documents.

When the structural foundation work is complete and the vertical construction work
begins, columns, beams and joists, The Tower Group hopes you will choose to
continue with the Engineer of Record for structural inspections.
Regarding time, we are aII aware that the work has been slowed over recent weeks
over a number of issues, inclusive of structural inspections. In our most recent
conversation, The Tower Group proposed a time extension of eight (8) weeks. Mr.
Jose Gonzalez of Gonzalez Architects countered with a four (4) week time extension.
In order to conclude this time extension issue, The Tower Group has stated that a six
(6) week time extension would be acceptable. While Mr. Gonzalez's initial response
has been to decline the six week proposal, we hope this matter can be revisited.
Finally, let me say that The Tower Group understands that Article 8.3.3 of the General
Conditions states:
No claim for an increase in the Contract Sum for either acceleration
or delay will be allowed for extensions of time pursuant to this
Paragraph 8.3 or for other changes in the Construction Schedules,
While The Tower Group has reviewed this provision, we are also mindful of the idea
that a contractor is entitled to compensation for delay when there has been active
interference. As you are aware, this project is in its early state and The Tower Group is
not seeking a compensatory change order at this time. However, we hope that our
work, as it progresses, will not encounter the kinds of delays which may cause The
Tower Group to request delay compensation,
In closing, let's get back on track so that The Tower Group can oversee a productive
and successful project.
