A RESOLUTION OVERTURNING THE ADMINISTRATIVE
BOUNDARY INTERPRETATION OF THE PLANNING
DIRECTOR IN LAND USE DISTRICT MAP BOUNDARY
INTERPRETATION NUMBER 66, PART OF GOVERN-
MENT LOT 3, SECTION 14, TOWNSHIP 67S, RANGE
27E, AND PART OF GOVERNMENT LOT 1, SECTION
15, TOWNSHIP 67S, RANGE 27E, SUGARLOAF KEY,
MONROE COUNTY, FLORIDA, APPROXIMATELY MILE
MARKER 16.
WHEREAS, the property more specifically described by metes and
bounds in exhibits 1, 2, 3, & 4 attached, described as Part of
Government Lot 3, Section 14, Township 67S, Range 27E, and Part of
Government Lot 1, Section 15, Township 67S, Range 27E, Sugarloaf
Key, Monroe County, Florida; and
WHEREAS, the staff recommended approval of the boundary changes
as indicated in the Staff Recommendation by Antonia Gerli and
Diana Stevenson dated June 21, 1990; and
WHEREAS, the current Land Use district boundaries which indicat-
ed that the property is Native Area District (NA), were not placed
in error with the adoption of the September 15, 1986 Land Develop-
ment Regulations, and therefore the subsequent maps are not in
error;
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA THAT:
1) The recommendation of the Planning Director is overturned
as being inconsistent with Land Development Regulations; and that
2) The above described property shall remain Native Area Dis-
trict (NA) as currently indicated; and that
3) The Clerk of the Board is hereby directed to forward a
certified copy of this resolution to the Florida Department of
Community Affairs.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe
County, Florida, at regular meeting of said Board held on the 2nd

I have reviewed the Land Use District Maps and the complete
file from the attached boundary determination No. 66, and consid-
ered the recommendation submitted by the Development Review Coor-
dinator. And pursuant to Section 9.5-24(a) I have interpreted
that the boundary line between the Suburban Residential Limited
(SRL) and Native Area (NA) Land Use Districts be moved so
that the property legally described as part of Government Lot 3,
Section 14, Township 67S, Range 27E, and part of Government Lot 1,
Section 15, Township 67S, Range 27E, Sugar loaf Key, Monroe Coun-
ty, Florida be included in the Suburban Residential Limited Land
Use District.

A copy of the BOCC transcript of February 18, 1986.
A copy of minutes of the BOCC minutes dated February 18, 1986.
A copy of the map from the BOCC meeting February 18, 1986.
A staff report by Antonia Gerli and Dianna Stevenson to Ty
Symroski dated June 21, 1990
and is based upon the following findings of fact:
1. The Pattison maps are imprecise and require interpretation
to correctly delineate the land use district boundaries.
2. The BOCC specifically directed which premises were to be
designated to be Suburban Residential Limited (SRL) and
Native Area (NA).
3. The land use district map signed by Donald craig and dated
January 19, 1990 incorrectly placed the subject property in
the Native land use district.
Recommended Decision: Approval of the application so that, the
above described premises east of RE: #00119480-000500 for
BJULIAN.02/TXTDR,

INTERPRETATION NUMBER 66, PART OF GOVERN-
MENT LOT 3: SECTION 14, 'TOWNSHIP 67S, RANGE
2 7E, AND PART OF GOVERNMENT LOT 1, SEC.TION
15, TOWNSHIP 675, RANGE 27E, SUGARLOAF KEY,
MONROE COUNTY, FLORIDA, APPROXIMATELY MILE
MARKER 16.
WHEREAS, the property more specifically described by metes and
bounds in exhibits 1, 2, 3, & 4 attached, described as Part of
GnveTnment Lot 3, Section 14. Township 67S, Range 27E, and Part of
Government Lot 1, Section 15, Township 675, Range 27E, Sugarloaf
Key, Monroe County, Florida; and
WHEREAS, the staff recommends approval of the boundary changes
as indicated in the Staff Recommendation by Antonia Gerli and
Diana Stevenson dated June 21, 1990; and
WHEREAS. the current Land Use district boundaries which indicat-
ed that the property is Native Area District (NA), were placed in
error with the adoption of the September 15, 1986 Land Development
Regulations, and therefore the subsequent maps were also in error,
as they did not follow the previously demarcated Suburban Residen-
tial Limited (SRL) boundary; and
WHEREAS, the Board of County Commission Minutes of February 18,
1986, already show the intent to zone these properties Suburban
Residential Limited (SRL); so
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA THAT:
1) The administrative decision of the Planning Director, in
Land Use District Map Boundary Interpretation Number 66, dated
February ~, 1991, is hereby found to be in conformance with the
standards set forth in Section 9.5-3(m), Monroe County Code, and is
therefore approved; and that

2) The above described property should have been originally
designated as Suburban Residential Limited (SRL) and not Native
Area District (NA) as currently indicated; and that
3) The Clerk of the Board is hereby directed ~o forward a
