BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the Board hereby approves a Declaration of Easement for relocation of an existing easement, and authorizing the Mayor to execute on behalf of the County a Release of the existing Easement, a copy of same being attached hereto, concerning property located in Key Haven 10th Addition, Monroe County, Florida. DALY, party of the first part, and the COUNTY OF MONROE, party of the second part; WITNESSETH THAT, the party of the first part, for and in consideration of the sum of TEN DOLLARS ($10.00) AND OTHER GOOD AND VALUABLE CONSIDERATION, the receipt of which is hereby acknowledged by the party of the first part, has granted and does hereby grant to the party of the second part, its successors and assigns forever, an easement for drainage and utility transmission and distribution facilities and all appurtenances thereto, with full right of ingress thereto and egress therefrom, in and upon the property of the party of the first part described as follows to wit: Lot 13 and 14 of Block 5, KEY HAVEN - TENTH ADDITION, according to the plat thereof as recorded in Plat Book 5, at Page 114 of the Public Records of Monroe County, Florida. The party of the first part does hereby warrant that he has good and marketable title to the above-described property and that he has full power and authority to grant this easement.
