Resolution 157-1991 " "'t' ncrnRI1 F\ l E 0 r \ '!-; ~, "'-' " '91 W'\V 15 P 1 :39 \1/ I RESOLUTION NO. 157-1991:; 1 : , , L_ ; A RESOLUTION CONFIRMING THE ADMINISTRATIVE BOUNDARY INTERPRETATION OF THE PLANNING DIRECTOR IN LAND USE DISTRICT MAP BOUNDARY INTERPRETATION NUMBER 65, LOTS 1, 2, 3, & 4, BLOCK 1 AND LOTS 1, 2, & 3, BLOCK 19, BREEZESWEPT BEACH ESTATES, RAMROD KEY, MONROE COUNTY, FLORIDA, APPROXIMATELY MILE MARKER 27 WHEREAS, the property described as Lots 1, 2, 3, & 4, Block 1, and Lots 1, 2, & 3, Block 19, Breezeswept Beach Estates, Ram- rod Key, Monroe County, Florida, is currently zoned Native Area (NA); and WHEREAS, the staff recommended approval of the boundary chang- es as indicated in the report by Antonia Gerli and Diana Steven- son dated July 2, 1990; and WHEREAS, the current Land Use district boundaries which indi- cated that the property is Native Area District (NA), were placed in error with the adoption of the September 15, 1986 Land Develop- ment Regulations, and therefore the subsequent maps were also in erroL, as they did not follow the previously demarcated Improved Subdivision boundary; NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT: The administrative decision of the Planning Director in Land Use District Map Boundary Interpretation Number 65, dated February 8, 1991, which reconunends approval is hereby acknowledged and found to be in conformance with the standards set forth in Sec. 9.5-3(m), Monroe County Code, and is therefore approved; and that The above described property should have been designated as Improved Subdivision (IS) and not Native Area (NA) as currently indicated; and that This Resolution supercedes Resolution No. 080-1991 which overturned the Administrative Boundary Determination of the Plan- ning Director in Land Use District Map Boundary Interpretation Number 65; and that The Clerk of the Board is hereby directed to forward a certified copy of this resolution to the Florida Department of Conununity Affairs. And pursuant to Section 9.5-24(a) I have interpreted that the boundary line between the Improved Subdivision (IS) and Native Area (NA) Land Use Districts be moved so that the proper- ty legally described as Lots 1, 2, and 3, Block 19 and Lots 1, 2, 3, and 4, Block 1, Breezeswept Beach Estates, Ramrod Key, Monroe County, Florida be included in the Improved Subdivision Land Use District. ... ... LAND USE DISTRICT MAP BOUNDARY DETlSl<l"IT.NATION #65 Pursuant to section 9.5-24(h) the Planning Director has reviewed the Land Use District Map and interprets that the land use district boundary for the property with RE: #00200790, #00200800, #00200810, #00200820, #00205890, #00205900, and #00205910 legally described as, Lots 1, 2, and 3, Block 19 and Lots 1, 2, 3, and 4, Block 1, Breezeswept Beach Estates, Ramrod Key, Monroe County, Florida is designated as Improved Subdivision (IS) and not as Native Area (NA) and the Land Use District should be corrected accordingly and as precisely shown on the attached map. This decision relies upon documentary evidence: the following information and Application by Castle Builders of America, Inc.. Application by Marvin Sager A copy of the zoning map from Pre-September 15, 1986. A copy of the Existing Conditions Map of the scale 1 inch equals 2,000 feet, sheet 2 dated September, 1985. A copy of the Land Use District Map signed by Charles Pattison, sheet 7. A copy of an aerial photograph from Real Estate Data, Inc. dated 1990 at a scale of 1" = 600' . A copy of the Land Use District Map signed by Donald Craig, sheet 387. A staff report by Antonia Gerli and Dianna Stevenson to Ty Symroski dated July 2, 1990. And is based upon the following findings of fact: 1. The Land Use District Map signed by Charles Pattison is imprecise ahd requires interpretation to correctly delineate the land use district boundaries. ... 2. The existing conditions map shows the lots to be disturbed (740); 3. A field visit by the County Biologist and the County Planner found the lots to be disturbed; ~ . II ANALYSIS 1) The current use of the land is vacant. 2) The current use of the surrounding land is single family residential and vacant. 3) The previous zoning of the property was RU-2. III SUMMARY OF INFORMATION AND DOCUMENTARY EVIDENCE (ATTACHED) 1. Applications by Marvin Sager and Castle Builders. 2. A copy of the zoning map from pre-September 15, 1986, sheet 143. " 3. The following findings of fact are recommended: 1. On February 28, 1986, the Board of County Commissioners adopted the current land use maps with the subject parcel in the Native Land Use District. 2. The Existing Conditions map shows the parcel to be disturbed (740) . J ..I . The existing conditions map boundary line was incorrectly interpreted at the time of preparation of the "Pattison Maps", labeling the site as native. )I .." . To the east of the site, the land is zoned Suburban Commer- cial and is both vacant and being used as a resort. 5 To the north, the land is zoned native and is vacant. 6 . To the east, the land is zoned native and is vacant. 7 . To the south, across the canal, the land is zoned improved subdivision and is occupied by single family residences. 8 . Mr. Sager has submitted a vegetative survey for Lots 1 & 2, Block 1. The survey states that the lots are scarified and sparsely vegetated. Native vegetation does exist on the site, together with invasive exotics. 9 . Inspection of the site by the Planner and the Biologist con- firm that the vegetative survey was correct and that damage from cars driving over the site is fairly extensive. The site inspection also determined that all subject lots are disturbed. 10. The subject lots are already legally platted in a subdivi- sion and is consistent with Section 9.5-213 - Purpose of the Improved Subdivision District (IS). The boundary determination recommended is Improved Subdivision.
