Resolution 162-1991 FlLED FOP RECORO '91 liAl' 31 P 1 :26 RESOLUTION NO. 162 -1991 l"lDH'i" ; I I' ~ L_ A RESOLUTION CONFIRMING THE ADMINISTRATIVE BOUNDARY INTERPRETATION OF THE PLANNING DIRECTOR DENYING THE REQUEST TO REDRAW THE EXISTING BOUNDARIES IN LAND USE DISTRICT MAP BOUNDARY INTERPRETATION NUMBER 70, LOT 4, BLOCK 31 MALONEY SUBDIVISION, STOCK ISLAND, MONROE COUNTY, FLORIDA, APPROXIMATELY MILE MARKER 5. WHEREAS, the property described as Lot 4, Block 31, Maloney Subdivision, Stock Island, Monroe County, Florida, is currently zoned Urban Residential Mobile Home District (URM); and WHEREAS, the staff recommends denial of the boundary changes to Mixed Use (MU), as requested by the applicant, and as indicated in the staff report, dated December 26, 1990; and WHEREAS, the current Land Use district boundaries which were established with the adoption of the September 15, 1986, Land Devel- opment Regulations, and which indicated that the properties were lawfully changed from BU-2 to URM and therefore that the subsequent maps are correct; NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT: I) The action of the Planning Director, which recommends denial of a boundary change in Land Use District Map Boundary Interpreta- tion Number 70, dated March 21, 1991, is hereby found to be in conformance with the standards set forth in Section 9.5-3(m), Mon- roe County Code, and is therefore approved; and that 2) The above described property should not change to MU as requested but should remain as currently designated, that is, URM; and that 3) The Clerk of the Board is hereby directed to forward a certi- fied copy of this resolution to the Florida Department of Communi- ty Affairs. Earl Cheal, District 4 John Stormont, District 5 - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - I have reviewed the Land Use District Maps and the complete file from the attached boundary determination No. 70, and consid- ered the recommendation submitted by the Development Review Coor- dinator. And pursuant to Section 9.5-24(a) I have interpreted that the Land Use District boundary for the property legally described as Lot 4, Block 31, Maloney Subdivision, Stock Island, Monroe County, Florida is in the Urban Residential Mobile Home Land Use District (URM) and not in the Mix Use Land Use Dis- trict (MU). LAND USE DISTRICT MAP BOUNDARY DETERMINATION #70 Pursuant to section 9.5-24(h) the Planning Director the Land Use District Map and interprets that district boundary for the property has reviewed the land use with RE #00124380 and legally described as Lot 4, Block 31, Maloney Subdivision, Stock Island, Monroe County, Florida, is designated as Urban Residential Mobile Home District (URM) and the Land Use District Map should remain as precisely shown on the attached map. This decision relies documentary evidence: upon the following information and Application by Edgar & Carolyn Braswell. A copy of the Land Use District Map PROPOSED. A copy of the REDI Strip Maps, 24th Edition, 1989, page 3. A copy of the RED I Aerial Photo Map Atlas from the 25 Edi- tion, dated 1990, at a scale of I" = 600', page 6. A copy of Monroe County zoning Maps Pre-September IS, 1986, page 5. A copy of the Land Use District Map signed by Charles Pattison, page 1. A copy of the Land Use District Map signed by Donald Craig, page 576. A copy of the Existing Conditions Map of the scale I" = 2,000', page 1, dated July 2, 1985. and is based upon the following findings of fact: I. The current use of the land is storage of construction ma- terial. A review of the REDI microfiche of property owners depicted that the surrounding area has established businesses which were formed between 1928 to 1968. a) Four lots have businesses which are conforming under the Mix Use district. b) Six lots have businesses which are nonconforming under the Urban Residential Mobile district. c) Eight lots are either vacant or have residences under the Urban Residential Mobile district. 2. The previous zoning (before september IS, 1986) of the prop- erty was BU-2, which allowed storage. 3. A review of the records from the drafting of the Land Devel- opment Regulations found that the Board of County Commission did not specifically consider this site during the prepara- BBRASW.03/TXTDR tion of the Land Use District Maps. However, the Pattison Maps which were approved by the B.O.C.C., February 28, 1986, clearly indicates the zoning designation of URM for the prop- erty in question. 4. The continued use of the premises is lawful as a nonconforming use. 5. The nonconforming use may continue pursuant to Section 9.S-144. 6. The property may at a later time be considered as the sub- ject for an amendment to the Land Use District Maps.
