A RESOLUTION CONFIRMING THE ADMINISTRATIVE
BOUNDARY INTERPRETATION OF THE PLANNING
DIRECTOR IN LAND USE DISTRICT MAP BOUNDARY
INTERPRETATION NUMBER 73, PART GOVERNMENT LOT
4, SECTION 01, TOWNSHIP 66, RANGE 32, KEY
VACA, MONROE COUNTY, FLORIDA, APPROXIMATELY
MILE MARKER 52.
WHEREAS, the property more specifically described by metes and
bounds in exhibits 1 through 12 attached, correctly described as
Part of Government Lot 4, Section 01, Township 66, Range 32, Vaca
Key, Monroe County, Florida, but had been incorrectly shown to
contain the Palms Subdivision, between Buttonwood Acres and
Gulfstream Village, on the Monroe County Land Use District Mapsj and
WHEREAS, the Palms Subdivision was duplicated in error on the
current zoning maps, thereby resulting in Maps which show the same
subdivision occupying two different geographical locationsj and
WHEREAS, the current zoning underlying the incorrect duplicated
subdivision is correctly shown as Suburban Commercial (SC) and
Suburban Residential (SR)j and

WHEREAS, the staff recommends approval of the correction to the
base map removing the duplicate of Palms Subdivision and also locat-
ing the Government parcel and property lines as indicated in the
Staff Recommendation by Tiffany Stankiewicz and Ty Symroski dated
March 14, 1991; and
WHEREAS, the current Land Use district boundaries were not
placed in error with the adoption of the September 15, 1986, Land
Development Regulations, and therefore the subsequent maps were
not in error, as they did follow the previous demarcated BU-2-T
and RU-l boundary; and
WHEREAS, the boundary line is to be adjusted slightly to cor-
rectly follow the property line, and prevent the zone from cutting
across the middle of an individual parcel; and
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA THAT:
1) The action of the Planning Director, which recommends approval
of the correction to the base map between Gulfstream Village and
Buttonwood Acres in Land Use District Map Boundary Interpretation
Number 73, dated July~, 1991, is hereby found to be in confor-
mance with the standards set forth in Section 9.5-3(m), Monroe
County Code, and therefore approved; and that
2) The above described property should remain as currently

designated, that is, Suburban Commercial (SC) and Suburban Residen-
tial (SR), except for those changes noted above; and that
3) The above conclusion of law, is predicated upon the finding
of facts and conclusions outlined in the staff recommendation which
this Board hereby adopts as its own.
4) The Clerk of the Board is hereby directed to forward a certi-
fied copy of this resolution to the Florida Department of Communi-
ty Affairs.

I have reviewed the Land Use District Maps and the complete
file from the attached boundary determination No. 73, and consid-
ered the recommendation submitted by the Development Review Coor-
dinator. And pursuant to Section 9. 5-24( a) I have interpreted
that the boundary line for the property legally described as Part
Government Lot 4, Section 01 F Township 66, Range 32, Key Vaca,
Monroe County, Florida was not placed on the Land Use District
Maps. Therefore, the above legally described premises should be
on the map and the boundary line should be adjusted slightly to
correctly follow the property line to prevent the zone from cut-
ting across the middle of an individual parcel.

An application for a Boundary Determination has been completed
for premises legally described as Part Government Lot 4, Section
01, Township 66, Range 32, Key Vaca; and bay bottom south and
adjacent to Government Lot 4, Section 01, Township 66, Range 32,
Key Vaca.
Listed below are the recommended findings & conclusions.

A copy of the REDI Aerial Photo Map Atlas from the 25 Edi-
tion, dated 1990, at a scale of 1" = 600', page 60.
A copy of Monroe County Zoning Maps Pre-September 15, 1986,
page 219.
A copy of the Land Use District Map signed by Charles
Pattison, page 11.
A copy of the Land Use District Map signed by Donald Craig,
page 231.
A copy of the Existing Conditions Map of the scale 1" =
2,000', page 3, dated July 2, 1985.
III RECOMMENDED FINDINGS OF FACT
The Land Use District Maps show a duplication of The Palms
Subdivision in place of Part Government Lot 4, Section 01,
Township 66, Range 32.
The previous zoning (before September 15, 1986) of the prop-
erties were BU-2-T and RU-l.
The review of the records found that the Board of County
Commission did not specifically consider this site during
the preparation of the Land Use District Maps.
IV RECOMMENDED DETERMINATION
That the subdivision shown as the Palms on Lime Lane (94th
Street) and between Gulfstream Village and Buttonwood
Acres should be deleted and replaced with the correct par-
cels shown on the attached map.
The boundary should be drawn so that the parcels which have
RE: #00101140, #00101120, and #00100800-000100 are included
in the Suburban Commercial Land Use District and that the
parcels which fall south of the above mentioned parcels are
included in the Suburban Residential Land Use District.
