A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF,:MONROE COUNTY, FLORIDA, AUTHORIZING THE SUBQlDINATION OF TWO MORTGAGES HELD BY THE COUNTY ON GULF SHORE APARTMENTS AFFORDABLE HOUSING PR~JECT IN MARATHON IN RETURN FOR CERTAIN cpmgDERATION AND PROVIDING THAT THE MAYOR IS AijT~RIZED TO EXECUTE ON BEHALF OF THE COUNTY ANY DOCUMENTS NEEDED TO CARRY OUT THE SUBORDINATION. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, Section 1. ~...- That the Mayor/Chairman of the Board hereby consents to the Subordination of its two mortgages for the affordable housing project GULF SHORE APARTMENTS, located at 999 41st Street Gulf, Marathon, Florida, upon the consideration that the owners of the aforementioned project will continue the affordable housing project. This Subordination shall be to FIRST NATIONAL BANK OF THE FLORIDA KEYS. Section 2. The Mayor is authorized to execute on behalf of Monroe County any documents necessary to carry out the subordination. PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a regular meeting of said Board held on the 28th day of August - 1991. WHEREAS, under date February 4, 1988 a mortgage was given by Clinton LeBaron, Juanita LeBaron, and Ralph Olson, in favor of Monroe County a political subdivision of the State of Florida, which mortgage was recorded in Official Records Book 1040, Page 1958, of the Public Records of Monroe County, Florida, and WHEREAS, a subsequent mortgage was given by Clinton LeBaron, Juanita LeBaron, and Ralph Olson, in favor of the Monroe County, which mortgage was recorded inOfficial Records Book 1089, Page 1695, of the Public Records of Monroe County, Florida, and WHEREAS, the legal description of the property subj ect to the said mortgages is attached hereto as Exhibit "A" and made a part hereof, and vffiEREAS, the undersigned, in consideration of the sum of Ten Dollars($10.00) and other good and valuable consideration, agree to subordinate these Mortgages to a new First Mortgage in favor of FIRST NATIONAL BANK OF THE FLORIDA KEYS, encumbering the subj ect property. The Mortgages first described above are by this instrument subordinated and made inferior to the Mortgage to be given by Juanita LeBaron and Ralph Olson, in favor of FIRST NATIONAL BANK OF THE FLORIDA KEYS. IN WITNESS WHEREOF, the party agreeing to subordinate these Mortgages have hereunto set their hands and seals on this ___ day of August, 1991. Notary Public My Commission Expires: EXHIBIT A Situated in the County of Monroe and State of Florida and known as being a parcel of land consisting of all Lots 9 and 10, Block 5, of the Resubdivision of part of Block 2, and all of Block 5, of MARATHON BEACH, a subdivision of part of Government Lot 3, Section 10, Township 66 South, Range 32 East on KEY VACA, as shown by Plat recorded in Plat Book 2, Page 21 of Monroe County, Florida, Public Records, and a parcel of contiguous, filled bay bottom land in the Gulf of Mexico, bounded and described as follows: Beginning on the Westerly line of First Street at the Southeasterly corner of Lot 9, Block 2, of MARATHON BEACH SUBDI- VISION recorded as a foresaid, bear North 15 degrees, 40 minutes, 00 seconds West along the said Westerly line of First Street, and Northerly prolongation thereof 166.82. feet; said prolongation being also a portion of the Easterly line of a parcel of sub- merged land described in Official Records Book 339, Pages 472 and 473 of Monroe County Public Records, thence bear South 74 de- grees, 20 minutes, 00 seconds West 200.00 feet to a point on the Westerly line of said submerged lands described in Official Records Book 339, Pages 472 and 473 as aforesaid; thence bear South 15 degrees, 40 minutes, 00 seconds East along the said Westerly line of said submerged lands and Westerly lines of said Lots 10 and 9, Block 2 of MARATHON BEACH SUBDIVISION recorded as aforesaid 166.82 feet to the Southwesterly corner of said Lot 9, Block 2; thence bear North 74 degrees, 20 minutes, 00 seconds
