A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, AUTHORIZING: 'JTHE
MAYOR TO SIGN AND EXECUTE ON BEHALF OF MONROE
COUNTY AN INTERLOCAL AGREEMENT WITH THE CITY OF
KEY WEST FOR THE JOINT CONSTRUCTION OF A GASOLINE
STORAGE AND DISPENSING FACILITY.

BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
The Mayor is hereby directed and authorized to sign and
execute on behalf of Monroe County an interlocal agreement with
the City of Key West, a copy of the agreement being incorporated
by reference, for the j oint County and City construction of
gasoline dispensing and storage facilities located at the PATA
facility on Palm Avenue, Key West, and for the County to provide
funding for such gasoline facility in the amount of $60,000.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 28th day of August 1991.

INTERLOCAL AGREEMENT FOR TRANSFER OF FUNDING
FOR THE CONSTRUCTION AND USE OF A
GASOLINE STORAGE FACILITY
THIS Interloca1 Agreement is being entered into under the
authority of F. S. 163.01 by and between Monroe County and the
City of Key West, to provide coordination for the joint use of a
gasoline storage and dispensing facility during declared
emergencies.
This facility will be located at the Port and
Transit Authority Facility, Palm Avenue, Key West, Florida.
~mEREAS, the Monroe County Board of County Commissioners and
the City of Key West, have determined and recognized that during
declared emergencies, there may be a need for the County to use
gasoline for health, welfare and safety of its citizens, and,
t<.1iEREAS, The City of Key West is prepared to construct a
gasoline storage and dispensing facility for government use, and,
WHEREAS, the Monroe County Board of Commissioners agrees to
fund to the City of Key West, $60,000.00 from state funds
received, for use of this facility during declared emergencies.
THEREFORE, p~rsuant to Florida Statutes 163.01, Monroe
County, a political subdivision of the State of Florida, and the
City of Key West, a municipal corporation, have determined and
recognized that the City of Key West will construct and operate
this facility for its normal, operational use, and that, in
consideration of the transfer of state funds cited above, Monroe
County will have access to this facility, and the rights to use
one-half of the fuel on hand at the time of the declared
emergency. Monroe County agrees to reimburse to the city, the
cost of said fuel within thirty (30) days of its being dispensed.
AND THEREFORE, this interlocal agreement shall be for the
purpose of establishing a method for the collection of the funds
for the fuel used by Monroe County, as well as for the transfer
of the initial $60,000.00 in funding for the construction.
Section 1.

Within thirty (30) days of the passage of
this interlocal agreement by the Monroe County Board of
Commissioners, the Board shall pay to the city the sum of
$60,000.00 for use in the construction of this facility. The
payment shall be contingent upon the County's receipt of $75,000
from the Department of Natural Resources (MAVRO Funds).
Section 2.

The Monroe County Board of Commissioners
agrees to remit to the City of Key West within thirty (30) days
of receipt of a statement regarding fuel use from this facility
the full amount of the undisputed invoice, or the undisputed
portion of said invoice. The basis shall be the cost paid by the
City of Key West for said fuel.
Section 3.

This agreement
shall take effect when
approved by the governing bodies of the City of Key \.:est and
Monroe County, filed with the Clerk of the Circuit Court of
Monroe County, and filed with the City Clerk of the City of Key
West.
